I oppose approval of ZM 18-01 NC 18-04, Zoning Modification and Concurrent Variances for the Southeast Quadrant of the Birmingham Crossroads at Birmingham Hwy and Birmingham Road. The attached drawing is marked up to show the extent of the approximately one acre of undisturbed land protected by the 75 foot buffer that the developer is requesting to eliminate and replace with high density mixed uses. The zoning modification and variance request to delete the 75 foot undisturbed buffer and 10 foot improvement setback along the south property line of the MIX -zoning district adjacent to AG -1 should be denied for the following reasons: If approved, this variance would allow more density than is currently allowed. In addition to creating a transition between high density and low density development, buffers server to reduce density by requiring a portion of the property to remain undisturbed. Undisturbed buffers and setbacks preserve greenspace. The 75 foot buffer protects approximately an acre from being developed with high density mixed uses. Citizens are being taxed specifically so that the City can purchase and preserve greenspace. It is inequitable that the City would approve a variance request the elimination of a protected undisturbed greenspace buffer. Approval of this variance request essentially gives this protected area to the developer for the sole purpose of increasing density and maximizing profits without providing any common benefit to the community. The granting of a variance request requires the precondition of a hardship. The developer has not demonstrated any hardship. The Southeast quadrant of the Birmingham Crossroads can be developed according to the Birmingham Master Plan, the Milton Overlay and the current approved zoning. The City of Milton staff is recommending denial with well-developed reasoning. Fulton County specifically required that the southern buffer be maintained. How this highly visible area is developed is important to the long-term character of our community. What is allowed in high profile crossroad areas sets the tone for the preservation of the rural values and greenspace buffers throughout the City of Milton. For the reasons expressed above this zoning modification and variance must be denied.
