Official Meetings are audio and video recorded. The Work Session of the Mayor and Council of the City of Milton was held on June 10, 2013 at 6:00 PM. Mayor Pro Tern Bill Lusk presiding. Councilmembers Present: Mayor Pro Tern Bill Lusk, Councilmember Matt Kunz, Councilmember Lance Large, Councilmember Karen Thurman, and Councilmember Burt Hewitt. Mayor Lockwood and Councilmember Joe Longoria were absent. Mayor Pro Tern Bill Lusk: • Work Sessions are an informal setting to update Council on business items. • No votes will be taken during these sessions. • There are three (3) items on our Agenda tonight. • Public comment is allowed that is germane to an Agenda Item. • If you wish to speak you are required to fill out a comment card and tum it into the City Clerk staff. • Public comment will be allowed for a total of 10 minutes per agenda item and no more than 2 minutes per person. • Public comment will be heard at the begirming of each Item. • Once the item is called, no other comment cards will be accepted. Sudie Gordon, City Clerk, read Agenda Item #1. 1. Discussion of an Ordinance to Amend Chapter 4, Alcoholic Beverages, Sec. 4-168, Temporary Special Event License (Pouring Permit). (Ken Jarrard, City Attorney) Ken Jarrard, City Attorney: I am going to defer this discussion to Jason Wright, Communications Manager. Jason Wright, Communications Manager: I wanted to give you an update on the Crabapple Fest and explain to you why we are bringing this discussion to you tonight. The reason for this ordinance is because at last year's Antique Fest, I realized that the event was too big for us to have traffic flowing through the Crabapple intersection . There are over 10,000 people walking all over the place and it is just a safety concern. In addition, the Milton Round Up has declined in popularity over the years since the height of participation in 2010 when we had 5,000 participants. In addition, it is a very expensive event to produce . Work Session of the Milton City Council Monday, June 10, 2013at .6 :00 pm Page 2 of4 More than likely, the reason for the decline in participation is because we have a lot of other events going on around that same time. Also, Birmingham United Methodist is a little out of the way for most people. So, after these two events last year, I met with the Crabapple Community Association and asked them if they would be interested in partnering with the City of Milton to create a "Downtown Destination Festival" for the city. They seemed very interested in the idea, so through a series of meetings, we have been working out the details. This ordinance is one of the things they asked for which is the ability for open container consumption during the festival. According to this ordinance, when the special event permit is applied for, the applicant has to define the boundaries of the event. Then, any business that has an alcohol beverage license can apply for a special pouring permit to serve alcohol during the event. In addition, we are going to close Crabapple Road for this event. The closure will be from Isaka Walk to the main intersection. We are also going to close Mid-Broadwell from Dunburdy Drive to the main intersection to allow for the festival to be held within the entire area of downtown Crabapple. The children's activities will be in the Crabapple Government Center parking lot. The Olde Blind Dog beer truck and live music will be in front of the Olde Blind Dog restaurant. The vendors will incorporate the Mid-Broadwell area by the Broadwell House and along that road where they have been in the past. Mayor Pro Tern Lusk: Will the actual boundary of the event be well-marked so participants will know where they can and cannot have an open container of alcohol? Jason Wright: Our Special Events Coordinator, Angela Thompson, saw an ordinance similar to this one when she worked for the City of Gainesville, GA. She explained that at each place where participants can purchase alcohol, there is a map that shows the boundaries of where an open container is allowed. They marked the boundary within the special event and had volunteers and/or police officers standing at the boundary lines letting people know they couldn't leave the area with an open container. Karen Thurman, Councilrnernber: Why is the special use permit for 60 days? That seems too long. Ken Jarrard, City Attorney: The special event license is not for 60 days, just the alcohol license. Jason Wright: We really want all the businesses in the Crabapple area to be a part of the festival. I would like for us to build this festival so that over the years this is what we are known for and it grows in popularity. Discussion of RZ13-11 -To Adopt a New Use Pennit within Article IX, Division 5, Miscellaneous Uses, Section 64-1840 -Rowhouses (Townhouses). (Kathleen Field, Community Development Director) Kathleen Field, Community Development Director: The current DeerfieldIHwy. 9 Fonn Based Code allows for the development of rowhouses/townhouses with a use pennit within certain transect zones. We are here tonight to discuss the standards that establish that use pennit. This use pennit is only for the DeerfieldIHwy. 9 area; not the Crabapple area. A use pennit means a nonnal public hearing process will be required. It is not an administrative use pennit. It will come through the nonnal use pennit process which is through the Planning Commission and then to the City Council for review and approval. The use pennit states that rowhouses/townhouses will not be adjacent to areas designated as T2 (T2 is comparable to AG-1). The maximum number of rowhouse/townhouse attachments is eight (8) and they have to be part of a mixed use development. Rowhouses/townhouses cannot be more than fifty percent (50%) of any mixed use development. Sudie Gordon, City Clerk, read Agenda Item #3. 3. Discussion of RZ13-12 -To Amend Chapter 64, Zoning Ordinance, Article I, in General, Section 64-1 Definitions as it Pertains to Rowhouses (Townhouses). (Kathleen Field, Community Development Director) Kathleen Field, Community Development Director: We are proposing that the definition of a rowhouse/townhouse is a single family dwelling that shares a party wall with another of the same type and occupies the full frontage line. The tenn dwelling unit, townhouse, and dwelling unit, rowhouse, are synonymous. Work Session of the Milton City Council Monday, June 10, 2013 at 6:00 pm Page 4 of4 ST AFF REPORTS Carter Lucas, Director of Public Works: I wanted to make you aware of an emergency contract that we are in the process of executing. We had a culvert failure and a headwall failure on Darby Road which is a gravel road that connects to Hickory Flat road on the north side of town. It has grown since we have gotten so much rain over the last few days. We had to close the road. The headwall failure turned into finding a culvert failure so we are going to replace the entire unit. We are in the process of hiring a contractor so we can replace the culvert and re-open the road. I would like to ask that instead of our normal 72 hour review period for a contract that we can get it back within 24 hours. We will have the contract to you by the end of this week or early next week. We are going to obtain three (3) bids.
