It is my understanding that Agenda Item No. 18-083 is the request from the developer to change the previously passed variance to delete the 75 -foot undisturbed buffer and 10 -foot improvement setback along the south property line of the MIX -zoning district adjacent to AG -1- Sec. 64-1142(a)(3)(b). I am against any further changes to this property. The current zoning and modifications somewhat parallels the Milton Overly. These newly requested variances are in direct conflict with the Birmingham Master Plan, the original zoning and the zoning modifications that have already been sought. These concurrent variances would allow more density and visibility than what could be accomplished otherwise. Our City claims to care about greenspace as evidenced by the passing of the Greenspace bond, and the large purchase of Milton Country Club, and the creation of a new Tree Ordinance. Removing green buffers with trees when they are required by a zoning is inconsistent with the City's mission to preserve greenspace. No public good has been demonstrated by these variance requests. These variances should be denied. There is no hardship. These variance requests do not meet the four legal requirements for approval. Staff's analysis makes it very clear that these variances do not meet any of the four legal criteria. They must be denied.
