The Regular Meeting of the Mayor and Council of the City of Milton was held on February 3,
2014 at 6:00 PM, Mayor Joe Lockwood presiding.

Mayor Joe Lockwood called the meeting to order.

Motion and Vote: Councilmember Thurman moved to approve the Meeting Agenda with the following

PUBLIC COMMENT

I am in partnership with Laura Rencher for Preserve Rural Milton. I wanted to let you know some
feedback that we have gotten from the community. We've worked really hard, as I'm sure you already
know. You've seen the signs and magnets. If you have been on our website you have seen an
overwhelming response from the community about our efforts. Just to give you some numbers, we set
up a website about three weeks ago and we have over 1,000 unique visitors on a daily basis. Then, we
started a Facebook page and in three days we have had over 521 likes; 991 use; and as of today we have
received over 1,000 signatures on the petition that you are aware of. We decided to gain momentum for
effort for conservation for Rural Milton by creating yard signs and car magnets. In just two weeks, I
have delivered over 190 yard signs, I have knocked on 190 doors, and we have sold just under 400 car
magnets. The response from the community has been overwhelming. I think they like you again. There
was a big divide as you well know in the last four or five years from all the controversy that we have
had. I've made great stride and effort in trying to talk with everybody door by door; literally door by
door. They are asking if you are listening to us, I say, yes, you are listening to us. We are working
together. Do you agree with us? Yes, you agree with our initiatives. Are there any problems? No, no
problems, no issues, we are working together. So, I am trying very hard to bridge the gap between the
community and what Laura is working with you on the different initiatives. I'm getting handwritten
notes and verbal thank you for our work. I've come across people who are angry; they have shouted at
me because they are mad at you; not me, but because they are mad at you. They are disappointed, they
are tearful, they are distrustful of the city and many people have just given up to complacency and are
welcoming a new effort. One of the two big things that have come up with conversations with everyone
is that I am trying to educate them on what a green print is; that is the very first step to defining what
steps we need to take moving forward. Those folks who have a slight understanding of what that is.
They are in agreement and are looking for you to do something about it. The other big bit of feedback
that I am getting is clear cutting. People are really upset about the clear cutting. They don't understand
the building business, they don't understand the development business, and they don't understand the
numbers that go along with it. I try to explain to them that it is the easiest and most effective cost
efficient way for them to do their business; they don't care, obviously, I don't care. They don't want to
see the trees clear cut. So, I am asking you if there is anything we can do about that. I don't know what
that means, I don't know what that looks like, I don't know where we go from here, but I am asking you
if we can stop clear cutting. Maybe the City of Milton can be one of the first to start that effort. I know
that clear cutting is completely legal within forest practices within Georgia. Developers and builders
have taken that route because it is easier for them. I get that; I understand but there are consequences to
all of that. So, I've told them that I would ask you if we can put some motions in place where we can
end clear cutting within the City of Milton.

This is an ordinance amendment to update our radar permit to include the Cambridge High School zone .
I do need to make one correction. The Birmingham Falls School zone was also included in this
amendment. So, this would update our overall speed table to include those two school zones.
Motion and Vote: Councilmember Hewitt moved to approve Agenda Item No . 14-024.
Council member Longoria seconded the motion. The motion passed unanimously (7-0).

NEW BUSINESS
1. Consideration of A Resolution Reappointing a Member to the City of Milton Board of
Zoning Appeals for District 3/Post 1.

Nancy Plesnarski, who has been serving on the Board of Zoning Appeals since I took office in 2010, has
agreed to serve for another term. The term is for four years. She has done an excellent job and I would
like to reappoint her.
Motion and Vote: Councilmember Kunz moved to approve Agenda Item No. 14-031 appointing
Nancy Plesnarski to the Board of Zoning Appeals for District 3/Post 1. Councilmember Thurman
seconded the motion. The motion passed unanimously (7-0).
2. Consideration of A Resolution Reappointing a Member to the City of Milton Historic
Preservation Commission for District 3/Post 1.

Travis Allen has been serving on the Historic Preservation Commission since its inception . This
appointment is a two year term. Travis would like to continue serving on the commission. He is
currently the Chairman.
Motion and Vote: Councilmember Mohrig moved to approve Agenda Item No. 14-032 appointing
Travis Allen to the Historic Preservation Commission for District 31P0st 1. Council member Hewitt
seconded the motion. The motion passed unanimously (7-0).
3. Consideration of A Resolution of the City of Milton, Georgia Enacting A Moratorium for 180
Days to Bar The Acceptance of Applications for Rezonings to the CUP, NUP, TR, R-2 and R-2A
Zoning Districts.

The council may recall that on January 6, 2014, we adopted a temporary moratorium to prevent the
filing ofrezonings to the CUP, NUP, TR, R-2 and R-2A Zoning Classifications while we worked on the
performance standards. We are continuing to do that, however, what the law anticipates is that while
you can adopt an emergency moratorium, you need to have a Public Hearing before you adopt a longer

tenn moratorium. That is what we have done . We have advertised this for a Public Hearing. When the
Public Hearing is over, if you prefer , you can adopt the resolution and this will extend the moratorium
for the following three trigger points:
1. 180 days after the adoption of this resolution.
2. To the approval by the City Council of an extended moratorium.
3. Upon the adoption of amendments to the perfonnance standards for CUP, NUP, TR, R-2 and R
2A zoning classifications .

I will now open it up for Public Comment.

I am not speaking for or against this. However, the one thing I would like to request is that if you are
putting a moratorium; don't put a maximum time limit. Try to put a limit whenever you feel that the
project is completed and you have come up with a resolution that seems reasonable. Then, bring it back
to the council to be heard and resolved. The second thing is that if you do go through with this, I ask
that you create a committee and have that committee assembled with people who are within the
community including neighborhoods , developers, builders, real estate agents, bankers, etc. in order to
have a good cross-section of the community. I think to really look at something, it is best to have people
that can look at both sides of the process and see what could be resolved and come up with a good
product. This is a good way of looking at possible solutions and getting immediate input from those
individuals who are the most affected.

180 days is the longest amount of time that this moratorium can be in effect. However, if the council
decides to enact modifications, it could end sooner than 180 days.
Motion and Vote: Councilmember Hewitt moved to approve Agenda Item No. 14-033.
Councilmember Mohrig seconded the motion. The motion passed unanimously (7-0).
4. Consideration of A Resolution Adopting the City of Milton Parks and Recreation Department
Youth Sports Concussion Policy.

In 2013, the state of Georgia legislature passed a bill mandating that all agencies that provide youth
sports must have a policy that pertains to dealing with concussions to include education and how to
safely return to play. Before you is the City of Milton's policy that is very much in line with what the
law is calling for. We have also created a parent education verification form. In addition, we have also
created pocket reminders which highlight how to deal with concussions and when to safely return to
play. These concussion cards will be distributed to every single participant; players, parents , and
coaches . We have also included a waiver fonn that every parent of each player is required to sign.

Motion and Vote: Councilmember Kunz moved to approve Agenda Item No. 14-034.
Council member Lusk seconded the motion. The motion passed unanimously (7-0).
5. Consideration and Possible Approval of a Land Acquisition Contract for a +/-2.1404 Acre
Parcel of Property in the Crabapple Community of Milton. The Proposed Acquisition Involves
an Assemblage of Parcels Located between Crabapple Circle to the North and Crabapple Road to
the South, and is Otherwise Identified as Portions of Fulton County Tax Parcels 22
400111350092 , 22400111350258,22400111350126 , 22 400111350118 , and 22
4001113 50266. The Acquisition Price is $900,000 . The Seller is SHF Crabapple , LLC.

This is the first of two potential land acquisition contracts that are being brought to you tonight. This is
the first time they have been brought out of Executive Session and presented to the public . These
parcels are located in Crabapple immediately behind the stores such as the Twisted Thread, etc. These
parcels are owned by two individuals. This would make an excellent location for City Hall to be built.
This agenda item is for your approval to bring this proposal to these sellers in the hope that they will
accept our offer.
Motion and Vote: Councilmember Thurman moved to approve Agenda Item No. 14-035 and give City
Manager Lagerbloom the authority to sign all documents needed at the closing pertaining to the
purchase of these properties . Councilmem ber Lusk seconded the motion. The motion passed
unanimously (7-0).
6. Council Consideration and Possible Approval of a Land Acquisition Contract for a +/-.3277
Acre Parcel of Property in the Crabapple Community of Milton. The Proposed Acquisition
Involves a Parcel Located between Crabapple Circle to the North and Crabapple Road to the

With the same presentation as the prior agenda item , this is the other .3 acres that is needed to acquire all
the land that we are seeking. This particular parcel has a different owner than the previous parcels. This
is our proposed purchase agreement and if you approve this agenda item, I will present this offer to ]W
Homes , LLC.
Motion and Vote: Councilmember Kunz moved to approve Agenda Item No. 14-036 and give City
Manager Lagerbloom the authority to sign all documents needed at the closing pertaining to the
purchase of these properties. Councilmember Mohrig seconded the motion . The motion passed
unanimously (7-0).
