Official Meetings are audio and video recorded. The Regular Meeting of the Mayor and Council of the City of Milton was held on May 5, 2014 at 6:00 PM, Mayor Joe Lockwood presiding. INVOCATION Remco Brommet, Chaplain for City of Milton Police and Fire CALL TO ORDER Mayor Joe Lockwood called the meeting to order. ROLLCALL Councilmembers Present: Councilmember Thurman, Councilmember Kunz, Councilmember Lusk, Councilmember Longoria, and Councilmember Mohrig. Councilmembers Absent: Councilmember Hewitt Arrived at 6:43 p.m. Councilmember Mohrig PLEDGE OF ALLEGIANCE APPROVAL OF MEETING AGENDA (Agenda Item No. 14-116) Motion and Vote: Councilmember Lusk moved to approve the Meeting Agenda. Councilmember Kunz seconded the motion. The motion passed unanimously (5-0). Councilmember Hewitt was absent from the meeting. Rick Mohrig arrived late to the meeting . Regular Meeting of the Milton City Council Monday, May 5, 2014 at 6:00 pm Page 2 of7 PUBLIC COMMENT Robert Bohensky, 15975 Freemanville Road, Milton, Georgia 30004 I would like to bring to your attention all the bicyclists that are clogging up our streets. I have seen them block traffic, disobey stop signs, and run red lights. They ride in packs of 30 or 40 at a time. It is a safety issue. They are blocking traffic. I would hate to see what it would be like if there was an emergency when they are on the road. They are riding in groups with sponsorship names on their uniforms and on the chase cars. It seems to me that would be a permit issue such as a parade or organized event, which it is. The problem is very bad on Freemanville Road. CONSENT AGENDA 1. (Presented by Mayor J oe Lockw oo d) 2. Proclamation Recognizing Mayas Mental Health Awareness Month . (Presented by Mayor J oe Lockw oo d) 3. Presentation of the City of Milton FY 2013 Annual Audit. (Presented by Tim Lyon s, CPA , Mauldin & Jenkins, LLC) Tim Lyons, CPA, Mauldin & Jenkins, LLC For the Fiscal Year ending in September 2013, we issued an unmodified opinion. This means that we issued a clean opinion on the city 's financial status. The city prepares a Comprehensi ve Annual Financial Report (CAF A). This is not required. Local governments in Georgia are only required to produce a set of audited financial statements. The City of Milton has gone above and beyond the requirements to produce a CAF A which is a more involved and detailed report . Despite a relatively sluggish economy the past few years, the city's tax digest has moved steadily upward. The General Fund has about a $15 million budget every year. Analysts like to see at least 3-4 months of expenditures in the fund balance at the end of the year. The city has a strong financial position , about 61 % or $9.25 million , of the general funds expenditures in the fund balance. We had to issue a single audit report because the city spent more than $500 ,000 of federal funds in which the largest part of that was the Department of Transportation grants. The city ' s pension plan is in a strong position . FIRST PRESENTATION 1. Consideration of ZM14-02 -805 Honors Circle (Lot 25), Jalil Poorak, to Modify Condition I.e. (RZ85-l8l) to the following: To Reduce the 100 Foot Building Setback from the Property Line of the C.U.P. to 60 Feet Along the South Property Line for Lot 25. (Agenda Item No. 14-123) (Kathleen Field, Community D evelopment Director) Motion and Vote: Councilmember Lusk moved to approve the First Presentation Item. Councilmember Kunz seconded the motion. Consideration of an Ordinance to Amend Chapter 34, Section 24, of the Milton City Code Creating Parks and Recreation Fees and Other Charges. ORDINANCE NO. 14-05-200 (Agenda Item No . 14-111) (First Presentation at April 28. 2014 Regular City Council Meeting) (Ken Jarrard, City Attorney) Ken Jarrard, City Attorney This ordinance, if approved, would set forth in your city code fees with respect to the use of Park and Recreation facilities. If approved, this ordinance and the next ordinance for consideration would allow the city code to be modified by authorizing the city to assess and collect certain fees and charges for access and use of city owned and controlled parks, recreational fields, and cultural amenities. This would be in accordance with a schedule of fees approved to Appendix A to the city code and which may be amended going forward when necessary. Motion and Vote: Council member Kunz moved to approve Agenda Item No. 14-111. Councilmember Longoria seconded the motion. The motion passed unanimously (5-0). Councilmember Hewitt was absent from the meeting. Council member Mohrig arrived late to the meeting. 2. Consideration of an Ordinance to Amend Appendix A, Parks and Recreation Fees and Other Charges, Chapter 34, Section 24 of the Milton City Code. ORDINANCE NO. 14-05-201 (Agenda Item No. 14-112) (First Presentation at April 28,2014 Regular City Council Meeting) (Ken Jarrard, City Attorney) Ken Jarrard, City Attorney This is the other component of the above Agenda Item that was just adopted. This is the fee schedule. If you adopt this ordinance, it will establish the fees for the use of Park and Recreation facilities. Motion and Vote: Councilmember Longoria moved to approve Agenda Item No. 14-112. Councilmember Lusk seconded the motion. The motion passed unanimously (5-0). Consideration of a Resolution Reappointing Ron Hill to the City of Milton Parks and Recreation Board for District 1 !Post 2. RESOLUTION NO. 14-05-296 (Agenda Item No. 14-124) (Mayor Joe Lockwood) Mayor Joe Lockwood Council member Burt Hewitt has nominated Ron Hill for the District 1 !Post 2 Park and Recreation board member position. Ron Hill has moved his residence from the District 31P0st 2 (Councilmember Rick Mohrig's district) to Councilmember Hewitt's district. Motion and Vote: Councilmember Thunnan moved to approve Agenda Item No. 14-124. Council member Kunz seconded the motion. The motion passed unanimously (5-0). Councilmember Hewitt was absent from the meeting. Councilmember Mohrig arrived late to the meeting. 2. Consideration of a Resolution Authorizing the Recordation of a Lien on Property Located at 14220 Cogburn Road, Milton Georgia in the Amount of $44,626.49, Pursuant to Court Order and Otherwise to Insure Reimbursement to the City for the Costs of Property Remediation. RES OLUTION NO. 14 -0 5-2 9 7 (Agenda Item No. 14-125) (Ken Jarrard, City Attorney) Ken Jarrard, City Attorney This is a resolution that would authorize the recordation of a lien in the real property records of Fulton County with respect to the parcel at 14220 Cogburn Road. We are requesting $44,626.49 to be placed in a lien and filed with Fulton County. That is the actual cost that the city has incurred with respect to the remediation. Motion and Vote: Councilmember Longoria moved to approve Agenda Item No. 14-125. Councilmember Thunnan seconded the motion. The motion passed unanimously (5-0). Councilmember Hewitt was absent from the meeting. Councilmember Mohrig arrived late to the meeting. Councilmember Mohrig arrived at 6:43 p.m. MAYOR AND COUNCIL REPORTS Councilmember Lusk I have met with Mr . Bohensky and I agree that there is a problem with large groups of bicyclists on our roads. I am concerned because it is a safety issue. Our roads are narrow with many curves and hills. I do not want an accident to happen. Regular Meeting of the Milton City Council Monday, May 5, 2014 at 6:00 pm Page 6 of7 Mayor Lockwood Chris Lagerbloom and I met with a group of bicyclists to discuss their concerns. There are issues on both sides of the problem. We have asked staff to research what we can and cannot do to keep all of our citizens safe. ST AFF REPORTS Chris Lagerbloom, City Manager Our staff has been looking at our options regarding bicyclists and we have met with large groups of cyclists who have also shared their concerns regarding safety. We have scheduled training for all our Board and Committee members on Saturday, May 17th from 8:30 a.m. to 1 :30 p.m. We would like to present to you tonight information on the new Broadwell Park. That is not the official name of the park but that is what we are calling it for now. It is located in Crabapple across from the Alpharetta Government Center on Broadwell Road. We are hoping to cut the ribbon on this park at the Crabapple Fest in October 2014. Jim Cregge, Parks and Recreation Director We are calling this project the Broadwell Pavillion. The picture in front of you is the building which was built in the early 1950's as a community center for the Crabapple Community. A few years ago some scouts painted the outside of it to improve it aesthetically; however, the building is in need of major repair. The roof has failed and there are buckets that are catching the leaks. We are having it inspected for asbestos. It is currently being used for long term storage of articles needed for events. If we decided to repair this building, it would require a significant rebuild. So, with our desire to repurpose this building to benefit all citizens, Bob Buscemi, our architect, has established a proposed plan for it. Bob Buscemi, City Architect We would like to utilize the site for gourmet food trucks and events such as Christmas in Crabapple and a farmer's market. We are proposing a pavilion type open air structure consisting of approximately 2,000 square feet. The proposed pavilion will consist of the following: Pavilion size: 40' x 52' = 2080 Sq. Ft. with a large fireplace as the centerpiece Bathrooms: Men's and Women's Rooms each with 3 stalls and 2 sinks, 242 Sq. Ft. Each Storage room: Includes the utility and janitor's closets 22' x 22' = 484 Sq. Ft. Lot size: .756 Acres ADA Parking: 1 space Play set: For ages 5 -12 re-used from Bell Memorial Park 18' x 17' Budget Allocation: $500,000 (This funding currently exists in the Parks and Trails Expansion Capital Fund) Regular Meeting of the Milton City Council Monday, May 5, 2014 at 6:00 pm Page 7 of7 Jim Cregge The playsets will be reused from Bell Memorial Park . They are approximately 8 years old and have been well maintained. They will be properly removed from Bell Memorial Park and installed at this new Broadwell Pavilion location. A four board horse fence will be built around the area. We will use gravel for parking and around the pavilion because there are several large trees and grass will be difficult to grow. In addition, the food trucks will have to travel in and out of the area making gravel the better choice.
