Official Meetings are audio and video recorded. The Work Session of the Mayor and Council of the City of Milton was held on June 9, 2014 at 6:00 PM. Councilmembers Present: Councilmember Karen Thunnan, Councilmember Matt Kunz, Councilmember Bill Lusk, Councilmember Burt Hewitt, Councilmember Joe Longoria, and Councilmember Rick Mohrig. Mayor Joe Lockwood: • Work Sessions are an informal setting to update Council on business items. • No .votes will be taken during these sessions. • There are five (5) items on our Agenda tonight. • Public comment is allowed that is germane to an Agenda Item. • If you wish to speak you are required to fill out a comment card and turn it into the City Clerk staff. • Public comment will be allowed for a total of 10 minutes per agenda item and no more than 2 minutes per person. • Public comment will be heard at the beginning of each Item. • Once the item is called, no other comment cards will be accepted. Agenda Item #1 was read. 1. Discussion ofRZ13-22 -To Amend Chapter 64, Article VII, Division 6 Northwest Fulton Overlay District. (Kalhleen Field, Community Developm enl Direclor) Kathleen Field, Community Development Director The Planning Commission spent three meetings reviewing all of these proposed amendments . In most cases, they agreed with staff s changes. We have made a note of the instances where they did not agree with staffs recommendations. The Northwest Fulton County Overlay District was adopted by the Fulton County Board of Commissioners in 1999 and amended in 2003. Since the incorporation of the City of Milton in 2006, there have been a few minor changes to this overlay district. So, it was staffs opinion that it was time to make some major changes. Some of the highlights of these changes are as follows: Work Session of the Milton City Council Monday, June 9, 2014 at 6:00 pm Page 2 of 5 • We have changed to the name from the Northwest Fulton Overlay to the Rural Milton Overlay. • We have rearranged the organization of the overlay. • We have divided it by type of use; not categories like landscaping, lighting, architecture, etc. which is how it is currently organized. • We have it organized by use such as, single family, corrunercial, etc. • We have suggested that demolition permits no longer go before the Design Review Board. • However, the Planning Corrunission has requested that demolition permits remain for review by the ORB. • Single family residences require the following conditions: • 60 foot viewshed; 40 foot undisturbed; 20 feet to allow grading but no structures • This is the rural viewshed that we have wanted to establish. • Maximum percentage of lot coverage is 20%. • The height requirement is a maximum of 2 stories with a maximum height of 28 feet from average grade to the bottom of the roof eave. • Staff has recommended that verbiage be included to encourage barrier free design to include a no step entrance, one bathroom door wide enough for a wheelchair, etc. • The Planning Corrunission, however, recorrunended that this request be deleted. • We added more flexibility and design of accessory buildings within the institutional uses, for example, not requiring windows for gymnasiums, storage buildings for schools, etc. • The Planning Corrunission recorrunended, however, that accessory buildings remain under the same development standards as primary structures. • We deleted the section regarding towers and antennas because it is already controlled by Chapter 54-telecorrununications. • We also amended the map to reflect the area minus the Crabapple Crossroads which is now under the Form Based Code. • We worked with the City Arborist for verbiage to better clarify what is clear cutting and timber harvesting. • The Planning Corrunission discussed the prohibition of clear cutting. • We have improved and added requirements for stormwater management. Councilmember Lusk Could you please give the definition of race tracks. We are an equestrian community and there are several equestrian race tracks in our area. Robyn MacDonald, Principal Planner There is not a definition for race tracks. We will research the issue and bring revised language for you to review. Councilmember Thurman I'm a little concerned that we are getting too heavy handed with all the restrictions we are placing on what can and what can't be built. Work Session of the Milton City Council Monday, June 9, 2014 at 6:00 pm Page 3 of 5 Agenda Item #2 was read. 2. Discussion ofRZ14-01 -To Amend Chapter 64, Article I, Section 64-1 Definitions. (Kathleen Field, Community Development Director) Kathleen Field, Community Development Director Staff is making changes to this because there is a need to propose new definitions and amend existing definitions to better clarify the intent of the Overlay District as well as the use permits that we are creating. The newly proposed definitions are as follows: • All weather surface • Alternative screen design • Artist Studio • Barrier free housing • Detention facility • Drive thru • Fence • Fence equestrian • Impervious cover • Lot coverage • Mausoleum • Non-structural storm water management practice • Rural Agricultural event facility • Stormwater better site design • Stormwater management • Storm water management facility • Timber harvesting Also, regarding fences, it should state that the height shall not exceed 60 inches. Agenda Item #3 was read. 3. Discussion ofRZ14-02 -To Amend Chapter 64, Article IX, Administrative Permits and Use Permits. (Kathleen Field, Community Development Director) Kathleen Field, Community Development Director There is a need to propose minor edits to the use permit section of the ordinance. The Planning Commission recommended that quarries, surface mining sites and racetracks be deleted entirely. Currently, our use pennits expire and we have been told that is illegal. They do not expire. Even if there is no action on them, they are still in effect. • We need to delete the Rural Residential District because we have not created it yet. We will create it in the next couple of months. • Amend the buffer requirements for various use pennits as needed. • Include the Crabapple and Deerfield Fonn Based Codes where appropriate. • Within the festivals or events, outdoor/indoor use pennits. • Corrected the required access for curb cuts. • Where applicable, included the requirement and citation of the Night Sky Illumination ordinance. Agenda Item #4 was read. 4. Discussion of RZ14-03 -To Amend Chapter 64, Article IX, Administrative Pennits and Use Pennits to Create a New Use Pennit for a Rural or Agricultural Event Facility. (Kathleen Field, Community Development Director) Katbleen Field, Community Development Director The City Council asked the staff to create a new use pennit for this use to encourage event facilities within the AG-I zoning district. Staff proposed use pennit is intended to take advantage of special rural characteristics such as natural features, historic structures and landscapes, open vistas, and secluded pastoral locations. The standards are created to be flexible depending on the location and size of the subject site. Instead of a one size fits all, buffers are detennined by the Mayor and City Council. Staff has also recommended that this use pennit be placed under agricultural type uses in the chart located in the Rural Milton Zoning Overlay District. Agenda Item #S was read. 5. Discussion ofRZ14-04 -To Amend Chapter 64, Article IX, Administrative Pennits and Use Pennits to Create a New Use Pennit for Artist Studio. (Kathleen Field, Community Development Director) Katbleen Field, Community Development Director There are artistic businesses that operate in the city that do not meet the standards for home occupation pennitted as an accessory use. The biggest obstacle to the artist is that they conduct their business in an accessory structure. These types of artists include photographers, painters, and sculptures that require larger work spaces. The intent is to allow these types of businesses to operate with an AG-I, RI, R2, R2-A, Commercial, Office, and Fonn Based Codes. If this type of business is located within a residential area, a minimum of three acres would be required with no other buffer or setback requirements other than the district standards for accessory structures. Since this use pennit would be a public hearing before the Planning Commission and City Council, additional conditions may be proposed if needed. For your review, staff has drafted a proposed use pennit for artist studio.
