The Work Session of the Mayor and Council of the City of Milton was held on August 11,2014 at
6:00 PM.
Councilmembers Present: Councilmember Karen Thurman, Councilmember Matt Kunz,
Councilmember Bill Lusk, Councilmember Burt Hewitt, and Councilmember Rick Mohrig.
Mayor Joe Lockwood was absent from the meeting and Councilmember Joe Longoria acted as
Mayor Pro Tern.
Mayor Joe Lockwood:
• Work Sessions are an informal setting to update Council on business items.
• No votes will be taken during these sessions.
• There are four (4) items on our Agenda tonight.
• Public comment is allowed that is germane to an Agenda Item.
• If you wish to speak you are required to fill out a comment card and turn it into the City Clerk
staff.
• Public comment will be allowed for a total of 10 minutes per agenda item and no more than 2
minutes per person.
• Public comment will be heard at the beginning of each Item .
• Once the item is called, no other comment cards will be accepted.

I am here tonight representing the Manor Golf and Country Club. I am speaking to you regarding the
overlay district that was approved in June 2014. The overlay first came out and was affecting The
Manor in 2007-2008. At that time, there was a community discussion occurring and a lot of issues were
being discussed but it was exempting The Manor primarily due to some language that is in the preamble
that states that The Manor code city ordinance or code standards are perceived as being more rigid.
understand these standards are not city code and not a part of the city documentation; however, it was
adopted at that point in time and is currently in use by your staff. For instance, the city arborist yields to
The Manor in regards to any tree matters in the community. The community is a private, gated
community with limited imposition on any surrounding properties. Typical lot coverage ranges from
8,000 to 12,000 square feet and some are approaching 15,000 square feet. What this means is that a
minimum lot must range from 50,000 square feet to 80,000 square feet. When the property was
designed, this was not a condition that we anticipated. At this time, all lots in the community are plated.
There is no design work occurring on any new lots. To further compound this affect, easement areas are
currently deducted from the base lot size computation. So, you might buy a lot that is an acre and a half
if you have easements that involve a quarter of an acre, that is deducted, and then the lot computation
created after that. This impacts not only new structures but potentially any replacement structures that

would be construed as non-conforming. So, the way the ordinance is currently written, if a resident in
The Manor was to lose their house, and they came back and applied, and that 20% factor was applied
and they didn't meet that maximum, then that would be a non-conforming structure. It has always been
our approach to work within the context of the Milton community to align ourselves out at The Manor
and to meet your objectives whenever possible. That attitude continues to prevail. We, at The Manor,
to include myself that is representing the lots that are yet to be sold, the investor that has bought those
lots, as well as the HOA and anybody else that has a position in The Manor. That approach continues to
this day and will continue in the future. We look forward to working with you to find a mutually
beneficial solution to this situation. We do not feel that the overlay accomplishes what its intended
affect was at The Manor, in fact, at this time it creates a serious imposition for that community to
continue to do business as it has in the past. Thank you.

1. DiscussionlUpdate of "Welcome to Milton" City Signs.

As an update to our "Welcome to Milton" signs, I am happy to tell you that our first sign has been
installed at Highway 9 and Webb Road.
We have eight proposed locations for the big signs.
The second sign will be installed at the Blue Valley site located on Birmingham Road near the Cherokee
County line.
A black fence will be used behind each sign.
Our arborist will incorporate the Dogwood tree that exists at the Birmingham Road site so it will not
need to be removed.
The smaller signs will be located in 17 different locations throughout the city.
Our next step is surveys and right of way acquisitions for the sign locations.
We have added a line item in the budget for this work.
We will use ODOT's survey information at the Forsyth County line in order to put a sign at that
location.
Ifwe do not have enough right-of-way then we will have to acquire easements.
Agenda Items #2 and #3 were read and discussed in unison.

The proposed text amendments for both the Crabapple and Deerfield Form Based Code are almost
identical with the exception of one item. I will ask our City Attorney to talk about the two issues that are
identical and then I will discuss the remaining issue that is different.

There was some language that needed minor tweaking because there were references in the code to an
overlay that could be considered confusing. The Form Based Code is the zoning; it is not an overlay so
we wanted to make sure that was clear. In addition, within the context of the TDR we wanted to make it
clear that the city is able to sell its own TDR rights so a modest amendment to the definition of a TDR
was required. On page 36 of the ordinance (RZ14-12) it will now read: TDR: Transfer of Development
Rights, a method of permanently reducing development potential of areas to be preserved as open space
and transferring development potential to areas to be more densely urbanized.

The amendment that we are proposing is minor but has been problematic in the past. It only relates to
the Crabapple Form Based Code. The proposed amendment is to delete the requirement for half round
gutters. Over the past two years since the adoption of the ordinance, every builder has requested a
variance to this requirement. It will remain as an option but not a requirement. Staff proposes to allow
ogee gutters which are the typical type of gutter installed on homes.
Agenda Item #4 was read.
4. Discussion of City of Milton Budget -Revenue and Expenditures/Capital Improvement Project

Tonight is the first opportunity you will have among many to review and discuss the budget. However,
since the Mayor is absent from the meeting tonight, we will not pursue an in-depth discussion. It is a
balanced budget. This budget is different from past years. Instead of a five year outlook we have
incorporated a seven year realistic outlook based upon anticipated funding. I would like for you to
notice the operational costs due to the capital projects. The five page letter that I have included in the
budget is to help you understand how we got to the numbers in the budget. That is not the budget
transmittal letter that will be included in the final budget. We need to prioritize all of the capital projects
that have been proposed. If everyone can meet on Saturday, August 23 rd at 10:00 a .m. then I will
contact the Mayor and make sure that date is a good time for him as well. At that time, we will engage
in an in-depth discussion about the budget.
