I want to thank you for the conservation work you have done in the city . I am appreciative of you hiring
Laurel Florio, Tom Daniels, and getting Randall in last week to talk about the conservation subdivisions.
I think we are really on the right track. I want to present a framework for thinking and talking about
conservation. It is a little difficult to put all these pieces together and figure out how they relate to each
other. So, I have a few minutes of a power point presentation to help you think about it a little
differently. There are really just two main steps in city conservation. The first step is detennining how
much land you want to conserve and which parcels of land to conserve and prioritize according to the
importance to the community. Tom Daniels recommended a land preservation advisory committee to be
fonned. I believe he asked that this committee identify and prioritize this land. We may want to
preserve environmentally sensitive land such as marsh land; chicken creek marsh land on Hopewell
Road and other spaces around that area. The natural attributes of a property may be considered worthy
such as very large specimen trees or a natural spring. Other reasons we may want to save land is
because the location of the property. In addition, we can consider saving historically significant areas
such as the location of the old county voting booth which was originally the post office on the comer of
Binningham and Freemanville. Other areas may promote connectivity such as the Milton trail. The
second step is how to preserve the land. We can buy the land but for the most part we do not have the
funds to do that so the best choice we have is to use conservation easements. Conservation easements
can be used on all of the property or just portions of the property. It is a legal agreement between a
landowner and a land trust or government agency that pennanently limits the use of land by taking away
developmental rights in order to protect its conservation value. It allows landowners to continue to use
and own the land. So, we are not taking ownership of this land . Tom Daniels recommends that we
preserve about 4,000 acres of land before 2050. We can acquire these easements by TDRs, conservation
subdivisions, donation of easements, and the purchase of developmental rights. The purchase of
developmental rights is the one avenue we have not discussed. It will probably take a bond initiative.

I am speaking tonight as Chainnan of the Milton Grows Green environmental committee to report to
you on the work that was done this weekend on our River's Alive Stream Clean Up. This is a yearly
event that has been going on for about two decades and is sponsored by the Environmental Protection
Department. It is a volunteer effort where children are brought together to go out and clean up the
streams in the City. This past weekend we had approximately 40 middle and high school students and
about 18 adults that came out to volunteer for this effort. The way this works is we have members of the
Milton Grows Green committee go out ahead of time and survey various parts of the City to try to find
sites that are appropriate (the most trashy sites). This year we identified about 20 sites. There are
approximately 50 sites in the City where streams cross roads and that is where most of the trash
accumulates. After identifying 20 sites, we actually cleaned up 17 sites. Two of those sites were
particularly environmentally sensitive: swamp area on Hopewell Road and swamp area at the comer of
Morris Road and Bethany Bend. These two areas were in bad need of cleanup and that was
accomplished. The report from the crew that finished with collecting all the trash estimated that over
2,000 pounds of trash was collected. Thank you for your time.

Good evening. We are here to tell you how successful Crabapple Fest was this year.
Again, this year we had a great partnership with CCA, and with Peyton Jamison, President of CCA.
Peyton Jamison was responsible for planning and executing all the vendors.
We had a conservative estimate of over 30,000 attendees, which is over twice what we had last year.
Budget came in under by $1100.
Brought in $33 ,750 in sponsorship dollars (last year only $10 ,000 in sponsorship dollars) with an
additional $12,000 in-kind items.
Next year, we are considering doing a two day festival or two times a year festival.
Any feedback or how we can improve? We would love to hear it and make it even better next year.
Peyton Jamison, President of Crabapple Community Association
On the CCA front we made about $14,000, net of expenses, from the vendors.
That money goes directly into the community.
We will do more events and up our scholarships.
It was a great partnership.
One vendor, Grand Champion, said it was their biggest day, so please let's do it again.
Very special day for all the businesses, antique stores, restaurants, etc.

I want to thank you Peyton and the Crabapple Association, as well as, Angela and the rest of our staff
for a great time at the Crabapple Festival. People are really grasping the whole community feel and the
numbers are proving that with how many showed up .

The first time I ever came to what is now the City of Milton, was to go to the Crabapple Festival.
Initially, this is what I fell in love with about Milton was the festival and its small town feel. And is why
we eventually moved here. The festival can really make a big difference in people and how they
perceive the area.

Department Recommendation:
The Community Development Department recommends approval of the proposed text amendments as
follows:
Executive Summary:
At the October 13, 2014 Council Work Session there were discussions regarding the status of the CUP
and NUP zoning districts. Based on these discussions, Staff now proposes to preserve the CUP zoning
district with some amendments and to delete the NUP zoning district. We are essentially combining the
NUP and CUP into one ordinance. Below are the changes proposed to the CUP district.
1) Include properties with a minimum of 4 acres (this type of property required a NUP district).
2) Delete all uses except for single family residential and golf, country club, pool and recreation
court. In the original CUP, triplexes, two family dwellings, townhomes, and multi-family
residential as well as daycares were all allowed uses. Those all have been deleted now we are
only talking about single family residential, golf and country club, pool and recreation.
3) For properties not served by sanitary sewer, require the applicant to provide a site plan to
determine the maximum number of lots that can be developed under the AG-I district. That is so
we can determine what the yield is under an AG-1 zoning. In the past, there might had been a
way that the CUP would increase density, so by determining what the AG-I zoning would allow
on a particular parcel would be the maximum amount of density that would be allowed under the
CUP.
4) Staff has deleted the requirement for open space but will amend the Rural Milton Overlay to
require open space not only for CUP districts but also for all developments including AG-1.
The reason we want to put that into the Rural Milton Overlay is as I mentioned, that is the

regulating plan for all zoning districts, including the AG-1 as well as the CUP. We will capture
both zoning districts by putting it in the Overlay.
Those are the changes we are preparing to make to the CUP that is before you this evening. However,
as part of the discussion, on Oct. 13,2014, we also talked about other changes that you had requested to
be made but they fall under other documents. So we are going to follow those changes and amend those
documents but I just wanted to bring those to your attention so that we appropriately capture them.
In terms of the "Rural Milton Overlay District", we are going to make the following proposed changes:

1) Require open space for all single family developments (see #4 above) within the Overlay.
2) Increase the percentage of "Lot Coverage" from the existing 20 percent up to 25 percent with
the administrative approval of the Community Development Director.
3) To amend the Rural View shed requiring the City Arborist to review and approve a landscape
plan for the 40 foot undisturbed buffer adjacent to exterior streets.
Definitions
1) Under definition of "lot coverage" delete golf courses and bodies of water below.
" .... For purposes ofcalculating lot coverage, total lot area shall be the area ofthe lot reduced
by the area ofall ofthe following that are located within the boundaries ofthe 10t:(1) Golf
courses ; (2) Bodies ofwater and (3) Streets. "
The Planning Commission recommended approving the deletion of the CUP and NUP zoning districts
on June 25, 2014. The City Attorney recommended that there is a need to keep the NUP district since
there are existing zonings within the City. Instead, there is a provision that there shall not be any
additional requests for the NUP zoning district.

When we talk about open space that really means open space or recreational areas including pools,
tennis courts and things like that, correct?

Yes, it does include recreation.

So it really is not open space but open space in recreational areas ...just common area space, basically.

Can you clarify that comment on the arborist approval?

Yes. We felt that the previous language was a little to arbitrary in terms of defining vegetative
coverings and what not, and so rather than make it subjective and trying to reall y figure out what that
really meant , we thought it would be tighter to leave it up to the arborist to make that determination on a
parcel-by-parcel basis .

OK and that's just along the public roads?

Yes.

I know we belabored that point at the work sess ion so I guess that is in conformance with what we
finally agreed upon.

And , it is only the side?

For the rural view shed.

It is any street; we call it an exterior street, that is not within a platted subdivision; so Freemanville,
Birmingham, etc.

But, as far as what is required to have ...

The Arborist to do? So, what exists now in the rural view shed is to provide a 40 foot undisturbed buffer
for an additional 20 foot no improvement setback for single family lots adjacent to exterior streets.
Where sparsely vegetated replant the undisturbed buffer in a natural fashion for the approval of the City
Arborist. Submit landscape plan to the Arborist for the preservation of the rural view shed. So , in the
discussions from last Monday, what staff got from your suggestions as the council was to read as
follows: Provide a 40 foot undisturbed buffer and an additional 20 foot no improvement setback for
single family lots adjacent to the exterior streets. Submit landscape plan to Arborist for review and
approval. So , as Kathy said we were taking out that point of sparsely vegetated so that was too general
so we were trying to speak to your request about let 's not just put it in a hole but allow the Arborist to
decide how it should be planted. Whether it is a pasture now or whether it is woods and we just go case
by case.

Or, whether it is a kudzu field that needs ...

I commend the staff for making revisions to the CUP provisions and looking at these different
directions. I guess, like you, the only thing I am not 100% clear on is the amount of open space that is
being asked for in this zoning district. I know it mentioned the overlay and that is the only thing I've got
concerns about but I do commend them for making these changes and looking at different things and
keeping this ordinance in place. Thank you.

The comment made by Kathy originally is that we are going to combine the CUP and the NUP in one
ordinance. I that correct?

That is correct and then the next item I will ask you to delete the NUP but that will be in the next item.

And, you just changed the CUP so it covers the same as the NUP?

Thank you. Mr. Mayor and members of the council , under this item we would now like to propose that
we delete the NUP zoning district. However, at the advice of the city attorney, he recommends that
there is a need to keep the NUP district for existing zonings. So, if you see on the actual language that
we put together for this NUP, we specifically say the regulations set forth in this division are the NUP
district regulations for those properties that were zoned to the NUP district prior to December 17, 2013.

After October 20, 2014, no additional property shall be rezoned to the NUP district. So, that maintains
those that were created but going forward there shall be no more properties zoned to the NUP.

So, if you are anything like me, to support the position that Kathy just suggested, the motion would be to
approve, even though it might seem that we are asking you to do something in the negative, it is actually
in the positive that will cause the condition that she described to occur.

The only question I have on the NUP is if we have areas that do open up into additional sewered areas
by saying that everything has to be under the CUP and then also under the new CUP it excludes certain
townhomes and more dense features, you are sometimes limiting yourself by what could be allowed in
the l\JUP. So, although I am not a great user of NUPs because I typically deal with much larger lots, I
would just say that there is a chance that you could be not having the flexibility that the NUP offers for
multi-family and sewered areas, although I know we don't have many areas that area sewered, it could
cause you some limitations in that respect so, that is my only comment by purely eliminating it. Thank
you.

3. Consideration of RZ14-08 -To Amend Article VI, Division 4 -R-2 (Single Family

Mr. Mayor, the Community Development Department recommends withdrawal of Rz14-08 and that is
essentially because as a result of the discussion on the October 13, 20 14 work session there were
discussions regarding the status of the R2 and the proposed RR zoning districts and based on these
discussions, we now recommend withdrawing the proposed changes to these districts because, in
essence, what we have done is we have combined the intent of the R2 into the CUP with even more
flexibility so there really is not a need any more for the RR .

I'm not exactly sure what I understand if the R2 is being completely eliminated and if it is and that is a
district which you could seek potential use, it does have some requirements for smaller lots, but again, it
has to be in a sewered area. I have no problem with eliminating the RR district because as you stated
that is going to be the new CUP, but the R2, there are some elements in it which you could have smaller
lots and basically smaller homes within those areas and even the smaller homes aren't exactly that small.
They are 1,600 square feet for a two story dwelling and on the ground level over 1,800 square feet so
again, they are not really small but they are something that could be done so, I would not recommend

eliminating or deleting it. But, that is one where I would keep that one open but get rid of the RR
provision. Thank you.

This is an ordinance change that relates to two aspects of our ordinances on the proper usage of parks.
The first one puts our ordinances in compliance with House Bill 60 which became law on July 1, 2014.
It is commonly referred to as the Open Carry Law. This is just a wording change to make sure that our
ordinance matches state law. The second one changes the times that parks can be open. We have
deleted the parks that have athletic fields that are lit. They can be open until 10:30 p.m. except on
Sunday. Parks that do not have lit athletic fields would be closed from dusk until dawn. We worked
with the City of Milton Police Department in an effort to continue to keep our parks safe. By changing
the ordinance, it gives our police the authority to enforce the law. We will modify the existing sign that
is at the entrance to Birmingham Park to state that the park is open from dusk until dawn. We will tum

the lights off at all the lit parks at 10:00 p.m. in respect for the neighbors. Any event that is still being
played at 10:00 p.m. will have to be postponed until another day .

Staff continues to receive interest from the private sector in terms of potentially using their land for sale
with TDRs. The staff is also working through the TDR process and therefore we would like to request
an additional two weeks before we bring this item back for your consideration. We are requesting that
you defer this item tonight.

I am in opposition of TDRs. When I first heard about selling a TDR for Bell Memorial Park it was at
the Planning Commission meeting a few months ago. My first response was that it was perhaps a
misprint. Primarily, the really big problem is that we have a public park that we are in the process of
spending $9 million to build ball fields and the chances of this councilor any council in the near future
selling the park for development land is essentially zero. Therefore, this does not make sense to sell a
TDR on a piece of property that is never going to be developed anyway. In my circle of friends who are
environmentally conscientious, most of them do not understand the need for this transaction. I
appreciate Councilmember Thurman's comments that if they city did engage in this type of transaction,
the money would go into a conservation fund. I could understand if we were talking about land at
Birmingham Park or Providence Park. But, land that is currently under a $9 million renovation for ball
fields does not make sense for a TDR transaction. That land will never be sold for development.
Motion and Vote: Councilmember Mohrig moved to defer Agenda Item No. 14-281 until the

My appointee on the DRB, Steve Check, has reluctantly stepped down due to his professional life
presenting more demands so I put him in charge of finding his replacement. Tonight, I would like to
propose that replacement, which is Tony Sheppard. Tony is a resident of Nettlebrook Farms, comer of
Thompson Road and Redd Road. Tony has lived in the Milton area for 17 years. He has been an
employee ofVerizon for over 21 years. Tony has been active in the community holding the positions of
HOA President for Nettlebrook Subdivision and Chairman of the Board for North Atlanta Christian
Flight Inc. (a non-profit Christian sport organization that provides Home Schooled students to
participate in organized competitive sports). He has been married to his wife, Shannon, for over 21

years and has four children. Tony is a graduate of University of Alabama and holds a B.S . in
Accounting from the University of Alabama . Tonight, I would like to propose and move that we
appoint Tony Sheppard to District2/Post 1 to replace the vacated chair on the Design Review Board .
Motion and Vote: Council member Kunz moved to appro ve Agenda Item No. 14-288 to appoint Tony
Sheppard to the Design Review Board for District 21P0st 1. Councilmember Thurman seconded the
motion. The motion passed unanimously (7 -0).
