COUNTY OF FULTON RESOLUTION NO. 14-10-314
RESOLUTION TO ABANDON THE PUBLIC RIGHT-OF-WAY
WITHIN THE CROOKED CREEK SUBDIVISION
WHEREAS, THE CROOKED CREEK HOMEOWNERS ASSOCIATION, INC, has requested
that all of the existing right of way located within the Crooked Creek Subdivision identified as Autumn
Close, Bunker Court, Cheltenham Walk, Cherington Way, Chipping Wood Court, Club Circle, Copper
Creek Circle, Creek Club Drive, Creek Ridge Chase, Crown Cove, Eagles Pass, Eighteenth Fairway,
Greenview Terrace, Hawks Circle, Heron Run Court, Legends Walk Circle, Majestic Cove, Morning
Mountain Way, Pinehurst Walk, Riley View Court, Rissington Passage, Wolf Willow Close, Wolf
Willow Court, York Cove, (the "Roads") lying in Land Lots 610, 611, 612, 613, 614, 615, 682, 683,
684, 685, 686, 687, 754, 755, 756, 757, 758, 759 of the 2nd District, 2nd Section of the City of Milton,
Fulton County, Georgia, be abandoned; and
WHEREAS, said right of way lies within property identified in Plat Book 181 page 125, Plat
Book 184 page 98, Plat Book 213 pages 38-39, Plat Book 185 pages 83-84 (as amended by the Quit
Claim Deed filed in Deed Book 47862 pages 23-26 and right of way deed filed in in Deed Book 47862
pages 13-14) , Plat Book 228 pages 109-110, Plat Book 185 page 57, Plat Book 218 page 106, Plat
Book 224 pages 147-148, Plat Book 182 pages 99-100, Plat Book 190 pages 87-88, Plat Book 226
pages 90-91, Plat Book 194 pages 44-46, Plat Book 200 pages 132-133, Plat Book 199 pages 24-25,
Plat Book 211 pages 9-11, Plat Book 213 pages 62-63, Plat Book 211 pages 337-339, Plat Book 205
pages 118-119 Fulton County Records; and
WHEREAS, the plats of the above-referenced right of way have been tendered and are
attached hereto as Exhibit "A" showing the location of the right of way within Crooked Creek
Subdivision which has been requested to be abandoned; and
WHEREAS, Section 32-7 -2( c) of the Official Code of Georgia Annotated authorizes a
Municipality to abandon a section of the Municipal road system which has for any reason ceased to be
used by the public to the extent that no substantial public purpose is served by it, or because its
removal from the Municipal road system is otherwise in the best public interest, after notice to
property owners located thereon; and
WHEREAS said Section 32-7-2(c) of the Official Code of Georgia Annotated provides that
upon the certification by the Municipality, recorded in its minutes, accompanied by a plat or sketch,
after notice to property owners located thereon, the Municipality may declare that section of road to no
longer be a part of the Municipal road system, and the rights of the public in and to the section of road
as a public road shall cease; and
WHEREAS pursuant to Section 32-7 -2( c) of the Official Code of Georgia Annotated notice
had been provided to the Owners; and
WHEREAS, a public hearing was held on September 8, 2014 and October 6, 2014 at the
appointed time; and
WHEREAS, Crooked Creek Homeowners Association, Inc., as the representative of the
owners of property that abuts the referenced right of way sought to be abandoned, has requested the
action which is the subject of this Resolution in order to privatize the roads in the Crooked Creek
Subdivision and, therefore, has actual notice of the proposed abandonment described herein, and no
other legitimate objections thereto have been made.
NOW, THEREFORE, BE IT RESOLVED by the City Council, and it is hereby resolved by
the authority of the same, as follows:
I. It is certified that the removal of the right of way within Crooked Creek Subdivision as
shown on the attached legal description and plats (see Exhibit "A") from the Municipal
road system is in the best public interest.
2. That the abandonment of said right of way herein described be and is approved.
3. That the best interest of the City of Milton would be served by the conveyance of said
property to the Home Owner's Association so that it may be subject to taxation by
Fulton County.
4. That a deed of abandonment be executed by the Mayor conveying interest in said right of
way within Crooked Creek Subdivision in Land Lots 610, 611, 612, 613, 614, 615, 682,
683, 684, 685, 686, 687, 754, 755, 756, 757, 758, 759 of the 2nd District, 2nd Section of
the City of Milton, Fulton County, Georgia, as shown on the attached plats to Crooked
Creek Homeowners Association, Inc., its assigns, transferees and successors in interest.
THIS RESOLUTION is hereby adopted this 6th day of October, 2014, the public health,
safety and general welfare demanding it. This Resolution shall become effective upon the occurrence
of the following: 1) the submission by Crooked Creek Homeowners Association to the City of a
revised subdivision plat meeting the requirements of Chapter 50 of the City of Milton Code of
Ordinances; and 2) approval of such plat by the City of Milton and Fulton County; and 3) the
submission to the City of the duly recorded subdivision plat with Fulton County.

Section, City of Milton. Fulton County, Georgia and being more particularly described

Commencing at a point formed by the right-of-way intersection of the Southerly right
of-way of Morning Mountain Way (50' r/w) with the Easterly right-of-way of Cherington
Way (44' r/w); thence along the right-of-way of Cherington Way a distance of 439.77' to
a point; said point being the POINT OF BEGINNING; thence along a curve to the left a
distance of 26.51', said curve having a radius of 20.00' and being subtended by a
chord bearing of S66°53'47"E a distance of 24.61' to a point; thence along a curve to

DEED OF ABANDONMENT
THIS INDENTURE, dated and effective as of the (; 1!l day of !2ty. ,2014, between CITY OF
MILTON, GEORGIA, a municipal corporation of the State of Georgia, as party of the first part (hereinafter
referred to as "Grantor"), and Crooked Creek Homeowners Association, Inc., as parties of the second part
(hereinafter referred to collectively as "Grantee")(the words "Grantor" and "Grantee" to include the respective
heirs, executors, legal representatives, successors and assigns of said parties where the context requires or
permits);
WITNESSETH:
THAT Grantor, for and in consideration of the sum of TEN DOLLARS ($10.00) and other good and
valuable consideration in hand paid at and before the sealing and delivery of these presents, the receipt of which
is hereby acknowledged by Grantor, has granted, bargained, sold, aliened, conveyed and confirmed, and by
these presents does bargain, sell, remise, release and forever quitclaim unto said Grantee, all the right, title,
interest, claim or demand which the said Grantor has, or may have had, in and to the following described
property, to-wit:
All that tract or parcel of land lying and being in Land Lots 610,611,612,613,614,615,682,683,
684, 685, 686, 687, 754, 755, 756, 757, 758, 759 of the 2nd District and 2nd Section of Fulton County
Georgia being more particularly described as the public right of way shown on the plats in Exhibit "A,"
attached hereto and incorporated herein by this reference.
TO HAVE AND TO HOLD the said described premises unto the said Grantee, so that neither the said
Grantor, nor any other person or persons claiming under Grantor shall at any time claim or demand any right,
title or interest to the aforesaid described premises or its appurtenances.
This deed is given pursuant to that certain Resolution of Roads Abandonment duly adopted by the
Mayor an~,Council of the CitY of Milton, Georgia, at a public meeting following a public hearing thereon, held
on the ft..!1!::.... day of Oc-r· ,2014, it be ing determ ined that abandonment of said Roads is in the best
public interest.
This deed is also given to divest the Grantor of any interest it may ever have acquired in said property to
make a right of way for a city maintained Roads.
