I would like this email entered in the public record.) (I am copying Leonard Jacklett, who is President of the property owners association for the SW corner of Birmingham Crossroads. I am also copying Joe Whitley, a building owner and government attorney) Other than the applicant (Mr. Curtis Mills, owner of building 400) for the music venue use permit, the building owners on the southwest corner are united in strong opposition to the use permit for a music venue on the NW corner. See the below petition. All of these owners have expressed opposition in emails. 5 of the 6 owners have sent emails that they assent to the petition; I am waiting for email assent from the 6th owner. Upon request, I will provide the building owners' emails assenting to the petition. My sense is that the value of these 6 buildings is over $3M. These owners have legal standing to challenge the outcome of this zoning proceeding in court. These business owners have deep concerns about the impact of this music venue on their businesses and on the value of their property. Council, you need to listen to the concerns of nearby business owners --the ones that will be most impacted by this proposed venue --and deny this request for a use permit. Please support our local business owners. Respectfully, Tim Becker 15625 Canterbury Chase Milton, GA 30004 Birmingham Crossroads Business/Property Owners Petition Dear Mayor, City Council, and City Manager: I am a business owner in The Village on the southwest corner of Birmingham Crossroads. I am aware of a proposal to locate a music venue on the northwest corner of the Birmingham Crossroads. I strongly believe that this music venue will negatively impact my business and/or lower the value of my property. In signing this petition, I am expressing my opposition to this music venue. I request that City Council deny the applicant the use permit and associated 9 concurrent variances. Should City Council grant the use permit for this music venue, I request that the City deny the variance to eliminate the 3 -year renewal period, thereby allowing local business owners recourse if our concerns (e.g., excessive traffic, excessive noise) about the music venue become manifest. We also request that any approved variances be tied to the use permit. At such time when concerts are no longer hosted at the site and the northwest corner is re -developed, the variances should expire. The applicant should be required to abide by all requirements of the Birmingham Crossroads Overlay and Rural Milton Overlay to ensure the northwest corner's development is congruous with the other three corners of the Birmingham Crossroads. As conditions of approval, I also request that the city 1) require a vetted parking plan, 2) conduct a traffic study, 3) make pedestrian safety improvements to the intersection, and 4) require off- duty police presence at concerts.
