The Regular Meeting of the Mayor and Council of the City of Milton was held on November 2,
2015 at 6:00 PM, Mayor Joe Lockwood presiding.

Motion and Vote: Councilmember Hewitt moved to approve the Meeting Agenda with the following

PUBLIC COMMENT

I am here tonight to comment on the emails that are circulating regarding the formulation of the CSO. I
ended up with a copy of them so I just wanted to make some observations to you all as I did the
Planning Commission. Three experts stated that the CSO was not a good fit for our city. It seems to me
in reading the emails , that the process was somewhat flawed. Based on that , I am asking you as the
council who will have ultimate weigh in , to deny it. We obviously will continue to spend taxpayer's
money looking into the emails with our city attorney. We have spent quite a bit of money on consultants
and they have decided it was not a good fit for our city. I have some other suggestions. I know that
everyone in the spirit of the initiative wanted to find solutions to a problem that we are having, but

perhaps there are other ways to get to that AG-1 Enhancements that are not related to a CSO , which does
not seem to be a good fit. I think it is great that we engaged stakeholders. We need to do so
transparently. There are many examples on how we have done this in the past. We had stakeholder
groups that have met with consultants and we have had Planning Commission meetings where citizens
have worked with the commission, etc . There are all kinds of examples where citizens and stakeholders
can improve or help the process , but sidebar emails to consultants is not a good way to go about doing
that. Staff always puts great effort into bringing quality development to our community. We just need
to be really sensitive to conflicts of interest when the y arise. We also really need to listen to the
Planning Commission. There are some reall y smart people sitting up there that you all appointed and
when they vote three times that something is not a good fit , you need to listen to that. They work very
hard as community volunteers and they spend a lot of time doing it. I watched them for hours last
Wednesday night trying to work through something that is still related to the CSO and they do not
believe in it. They do not think it is a good thing for our community. In conclusion, I feel strongly that
this initiative of the CSO , as it is today , is not a good fit for us and I hope you will deny it.

My appointee to the Board of Zoning Appeals , Gary Willis , has moved from the City of Milton. I
certainl y want to commend him and his work and his nine years of service . As many of you know, Bill
O 'Connor, who served us in the role of Economic Development Director is who I would like to appoint
in the place of Gary Willis. Everyone here knows of Bill 's qualifications and I am very proud to choose
Bill as my appointee for the Board of Zoning Appeals and would ask Council on approval of that.

PUBLIC HEARING
1. City ofMilton 2035 Comprehensive Plan 5-Year Update Public Kick Off.

I want to give you a brief update on the upcoming planning sessions with the Comprehensive Plan. The
Milton's 2030 Comprehensive Plan was adopted back in 2011 and we are due for an update. This is a
smaller update than the ten year update. The new plan will be called City of Milton 2035
Comprehensive Plan. We have discussed with the Atlanta Regional Commission and they have agreed
to help us work on that planning process . We have Alison Duncan and Jared Lombard here tonight from
the Atlanta Regional Commission.
The updates to the plan would include:
• The Land Use Map -which would be all of our small area plans
• The Community Goals -needs and opportunities
• The Community Work Program
• The Capital Improvement Elements-required since we are collecting Impact Fees
• The Transportation Component
• Housing and Economic Development
Our schedule:
• Kick Off -tonight-November 2, 2015
• Steering Committee and Public Information Meetings -three of each
• Council Workshop in June 2016
• Council Meeting in June 2016 to transmit the Plan to the Atlanta Regional Commission for
their 60 day review
• Adopt the Plan in September 2016
• The State deadline is Oct 31 , 2016 so we are giving ourselves a month 's cushion
Per our Code Section 2-183 , we are required to inform the Comprehensive Planning Committee to work
on this plan, which consists of the seven Planning Commission members , the Chair of the DRB and the
Chair ofthe BZA. All seven of you , councilmembers , are required to appoint seven additional members
from your district to that committee. How do you want to proceed with that?

Feel free to forward to me who you might want to appoint to the CP AC for this project for the next year.

We hope to have those appointees from you all by the next meeting in order to have the first Steering
Committee meeting by mid-December. With discussions with ARC , we are looking at having three
Steering Committee meetings and three Public Information meetings throughout the planning process
before we get to a draft . I will look forward to receiving your appointees so we can start with the
process.

ALCOHOL BEVERAGE LICENSE APPLICATION PUBLIC HEARING

This is a matter of formality that ownership has changed. The new owner is corning forth asking for

City Attorney Jarrard
As I had forecast at the adoption of the agenda, I will be asking council to go ahead and move this to the
next regular Council Meeting agenda. The consent order has been approved in a means to ready in case
that does become right with the court. This contains a lot of moving parts . Milton is one of the only
jurisdictions that has ensured that everything is in order with respect to the government agreement.
There are a lot of cities in Fulton County that have not done this , so we are waiting for all of them to get
their modifications complete in order to proceed. My recommendation is to postpone.
Motion and Vote: Councilmember Lusk moved to defer Agenda Item No. 15-272 to the November 16 ,
2015 City Council Meeting. Councilmember Mohrig seconded the motion. The motion passed
unanimously (7-0).
NEW BUSINESS
1. Consideration of an Intergovernmental Agreement between the City of Milton, Georgia and the
City of Alpharetta, Georgia Regarding Lease and Joint Use of Municipal Court Facilities.

City Manager Lagerbloom
This is an Intergovernmental Agreement that was contemplated during our planning and budget process ,
where we would form an agreement with the City of Alpharetta to begin using the court facility that is in
Crabapple for our municipal court. We have court on Mondays and Fridays and Alpharetta has court on
Tuesdays , Wednesdays , and Thursdays so it seems to be a good fit. This IGA has a term of five years
with five one-year extensions. It also contemplates that we would be able to build out the interior space
to meet our needs which has been budgeted. We will also be able to change the sign in front to
incorporate the City of Milton name so the public will know where we are. We are asking for your
approval of this IGA tonight. It will cost the city $3 ,000 per month.
Councilmember Lusk
Article C, regarding the lease and lease premises; previously and up until recently , we have been using
that facility for other purposes such as community meetings , etc. I didn't see any provision in here for
continued use of that arrangement. Is it implied?
City Manager Lagerbloom
This agreement is specific to the court functions. It talks about the spaces that we will have access to
Monday through Friday and guaranteed Monday and Friday. Alpharetta is still open to us using the
facility when they do not have other uses for it to meet their community needs, but that is independent of
this agreement. This agreement only speaks to the court needs that we have. Alpharetta will still allow
us to use their facility for special circumstances, upon request, as we have always been allowed to in the
past.

Councilmember Kunz seconded the motion. The motion passed unanimously (7-0).
MAYOR AND COUNCIL REPORTS
Mayor Lockwood
There was some interest in talking about the AG-1 enhancements at our next work session . However ,
the Planning Commission has requested to move the CSO discussion out further so I'm not sure which
direction we are going.
City Manager Lagerbloom
The CSO was voted on by the council to have it proceed currently with modifications to the AG-1;
enhanced AG-1. There are text amendments that need to go along with this as well. However, this
action was taken before the Planning Commission met last week and deferred the text amendments until
their February 2016 meeting.
City Attorney Jarrard
The Planning Commission deferred the text amendments to the zoning code. They passed the rural view
subdivision regulations. They scaled them down quite a bit but they passed them along. So , now if the
council wanted to take action, you would have a CSO subdivision regulation and a rural view
subdivision regulation but you would not have the modified text amendments that cross reference those
subdivision regulations. I advised the Planning Commission that the council was looking for a package.

I am not able to bring that to you until the Planning Commission has reviewed the text amendments and
passed them along which I believe will happen during their February meeting.
Mayor Lockwood
I would like to hear from the council and make sure everyone is okay with waiting until February to
make a decision .
Councilmember Lusk
Taking five months to discuss this issue is an inordinate amount of time. I think if we look at our
calendars we can find some type of holiday in each in every month and probably each and every week.
We have talked about his in the past about issues postponing or deferring them and I'm not sure who we
are catering to. We have Thanksgiving this month and Christmas and New Year's. My wedding
anniversary is coming up next month . We have holidays in January and Groundhog Day in February
and it goes on and on. In the spring , all the schools will be out for spring break. In May, people leave
for the summer for two or three months so we defer items for a few months. Things move slowly
enough in government as it is without coming up with reasons to defer something. I think it has been an
inordinate amount of time to consider this issue. There are other groups out there working on alternative
plans for this ordinance and these changes. I'm wondering if a couple of joint meetings between the
Planning Commission and City Council may be in order. I think the going back and forth all the time
and allowing for breaks in the discussion because of holidays , etc. is counterproductive. I think it is an
obstruction of policy and procedure. I think the citizens of this city deserve better than that. We are
here to make decisions. If we can 't then maybe the citizens need to get rid of all of us. We have a
combined group of people here who have the experience and knowledge to make decisions. I think it is
time that we buckle down and come up with a final solution.
Councilmember Kunz
Ken , what is the worst case scenario . Obviously , if the council decides not to approve a CSO then
nothing happens. But , if the council votes to approve a CSO , what happens if we do it "piecemeal."
What are the risks we might face if we have to go that route?
City Attorney Jarrard
The concern I have is that the zoning codes , without a cross-reference to development regulations , put
individuals on notice to what their options are. That is the key to all of this. So, if the development
regulations are adopted in a vacuum and there is no reference to them in the zoning codes , then how are
we going to advise our citizens what their development options are because the information will not be
in the zoning codes that control the use of their property.
Councilmember Kunz
We are talking about a point of reference from the zoning codes to the subdivision ordinance. Is it as
simple as striking out a line that basically says , "in reference to."
City Attorney Jarrard
It is a little more complicated than that. The text amendments will set forth some triggers such as a
minor plat; 20 acres. It is more than just "reference this document." The division was for instance, if
you had AG-1 and you had less than 20 acres then you could develop by way of the regulations that are
already set forth in AG-1 , whereas , if you have more than 20 acres then you would either go into the
CSO or the Rural Viewshed Subdivision regulation. The Planning Commission had a lot to discuss at
their last meeting and they spent 3-4 hours talking about the Rural Viewshed Subdivision regulation. It

was interesting because it was what they call a Courtesy Review. The zoning text amendments , which
were the items to be discussed, were not discussed at all. They had a lot put on them and were not really
prepared to go through the detail that they are used to going through. They did not have sufficient time
to develop the package they wanted to so that is why it has been pushed out to February. One of the
biggest issues was that the Planning Commission has rejected the CSO three times; however, the text
amendments contain CSO and Rural Viewshed language. So , they were having a difficult time
embracing the text amendments because they have voted against the CSO several times.
Councilmember Lusk
I think we should be working on this concurrently rather than in series. Two or three years ago we
started to come out of the recession and a lot of development started to happen in Milton. People were
hollering all over town; you 've got to stop these guys from cutting down our trees and clear cutting and
grading the land . That has been the loudest outcry in Milton. They are expecting us to come up with a
solution to this problem. I think we need to have a joint meeting with the Planning Commission and
City Council to discuss it together rather than in separate meetings. The majority of the people in
Milton want this issue resolved. I think we need to accelerate the process.
City Manager Lagerbloom
We have gotten off track and are discussing the CSO which is not published on our agenda to talk about
tonight. We are trying to decide if the council is interested in discussing this issue in a joint meeting
with the Planning Commission.
Councilmember Thurman
I would like to have a joint meeting with the Planning Commission to discuss the issue .
Councilmember Hewitt
I would like the issue brought forth at the next meeting under First Presentation.
Councilmember Kunz
I agree with Burt.
City Manager Lagerbloom
It sounds like the majority would like to have a joint meeting with the Planning Commission.
Councilmember Longoria
I would hope that the City Council has had some communication with their Planning Commission
representative to obtain their feedback on these issues. The fact that the Planning Commission has voted
against something that we are continuing to discuss is not unusual. We do that all the time. We vote for
things that the Planning Commission votes against on a regular basis. But, because of the flexibility we
have as a council to make certain decisions and look at things in a different way than the Planning
Commission can , we can do that. We have been talking about this issue for a long time and it has been
delayed several times. We need to make a decision. Either it is not going to work, and we need to
recognize that fact , or we need to figure out what is going to make it work.
City Manager Lagerbloom
I am hearing that there is a consensus to schedule a joint work session with the City Council and
Planning Commission next Monday night , November 91h to discuss the Rural Viewshed and the CSO.

Police Department, Steven Krokoff, Police Chief
Our officers were able to spend quality time with the local kids for Halloween and give out treat bags
with healthy items and coloring books. We did not have any incidents reported during Halloween.
We were given a $4 ,000 grant to help offset costs of vests , etc. for our department. We apply for this
grant every year and it is awarded to us each year.
Last month, we spent a lot of time improving communication channels throughout the department. We
are also focusing on output measures such as crime rate , tickets issued, etc. So far this year, we are at
about a 16% reduction in crimes. Larceny is what drives our crime in this area so we are seeing a
reduction in that.
Public Works Department, Carter Lucas, Assistant City Manager
Active Capital Infrastructure Improvement Projects
SR 372 (Birmingham Hwy/Crabapple Rd) Intersection Improvements (formerly known as Mayfield at
Mid Broadwell)
Status-Bids were received by GDOT and the low bid was approximately $5.4 million by Baldwin
Construction.
Next Steps-Additional funding is being requested to close the gap.
Completion -Begin construction late 2015 pending funding resolution.
Birmingham Road-Hopewell Road Intersection Improvements
Status -Utility relocation is still being completed by Sawnee. Baldwin is working on portions of the
project that can be completed around the utilities.
Next Steps -Contractor is coordinating utility relocations
Completion-June 2016
Webb Road-Deerfield Parkway Intersection Improvements
Status -Bids were received and are being evaluated. Apparent low bid was from Urey Construction in
the amount of $236,000.

Status -GDOT environmental review complete
Next Steps -Right of way acquisition contract approval.

sidewalk along Cogburn Road from Windward Parkway to the city limits.

4 radar signs for 12 locations. Try to leave the signs in place for 3 months.

Bridge Capital Planning
We are working on a comprehensive capital plan for all 34 of our bridges. Reports on 3 bridges have
been completed and are under review.
Dam Emergency Operations Plan

We are completing the first of the Category 1 dam emergency operation plans. The plan will provide
emergency responders with critical contact information and potential impact areas in the case of a failure
of one of the Category 1 dams. Draft report has been completed and is under review.

Fire Station 42 Replacement
Fire Station 42 is scheduled in the capital improvement program for replacement in 2017.
Fire Station 43 Fire Training Facility
Design of the site and bum building is programmed in this year's capital plan. We are conducting the
site surveys to determine the most appropriate location of the facility. Field work for the survey has
been completed. Working on the award of the engineering and construction package for bidding.
Fuel Management System
The city is implementing a new fuel management system. This system will automate the existing process
and accurately track fuel consumption for each department. Installation is complete and final network
connections are being made. Anticipate system to be operational in November.
Capital Funding Opportunities
ARC issued a call for project funding for various type projects. The city submitted 5 applications:

ARC action has been delayed. No new projects are being considered at this time. New projects may be
reconsidered in January-February. Existing projects, i.e. the additional funding for the Crabapple
Intersection Improvements is the only project to be consider in this funding round.

I have been asked to be in charge of the Innovation Academy which consists of eleven staff members
who volunteer to cross all departments. We are having our next meeting on Wednesday to create a
project that is meaningful to the team and organization and has the potential for lasting effect. The team
members are sending me ideas.
We are working on a business survey. One survey will be sent to businesses that have office space in
the city and another survey will be sent to home businesses.
In addition , I will be working with Michele Mcintosh-Ross on the Comprehensive Plan and updating the
Economic Development part of it.
