Official Meetings are audio and video recorded. The Regular Meeting of the Mayor and Council of the City of Milton was held on July 9, 2018 at 6:00 PM, Mayor Joe Lockwood presiding. INVOCATION Rich Austin CALL TO ORDER Mayor Joe Lockwood called the meeting to order. ROLL CALL Councilmembers Present: Councilmember Jamison, Councilmember Kunz, Councilmember Bentley, Councilmember Longoria and Councilmember Mohrig PLEDGE OF ALLEGIANCE (Led by Mayor Joe Lockwood) APPROVAL OF MEETING AGENDA (Add or remove items from the agenda) (Agenda Item No. 18-194) Motion and Vote: Councilmember Kunz moved to approve the Meeting Agenda with the following changes: • Add an Executive Session to discuss land acquisition. Add an Agenda Item under New Business, "Consideration of the Adoption of a Joint Defense Agreement regarding Pending Tax Appeal Litigation". Councilmember Mohrig seconded the motion. The motion passed (6-0). REPORTS AND PRESENTATIONS Proclamation Recognizing MDA City of Milton Firefighter Appreciation. (Mayor Joe Lockwood) 2. Discussion of the Capital Improvement Element (CIE) and the Draft Transmittal Resolution. Consideration of an Ordinance to Revise the Alcohol Code to Allow Sunday Sales by the Drink Between 11:00 A.M. and 12:30 P.M. Conditional Upon Voter Approval, to Repeal Ordinances in Conflict, and Set an Effective Date. (Agenda Item No. 18-198) (Ken Jarrard, City Attorney) Motion and Vote: Councilmember Kunz moved to approve the First Presentation Item. Councilmember Longoria seconded the motion. The motion passed (6-0). PUBLIC HEARING (None) ZONING AGENDA (None) UNFINISHED BUSINESS 1. Consideration of an Ordinance to Revise Noise Restrictions Impacting the Use of Consumer Fireworks, to Repeal Ordinances in Conflict, and Set an Effective Date. ORDINANCE NO. 18-07-366 (Agenda Item No. 18-190) (First Presentation at June 18, 2018 Regular City Council Meeting) (Rich Austin, Police Chiej) Rich Austin, Police Chief This item was first presented on June 18, 2018. The main purpose of it is to bring the city in compliance with state law to allow our officers to have the authority to take action regarding the inappropriate use of fireworks. Councilmember Kunz How do our citizens report inappropriate use of fireworks? Police Chief Austin They can call 911 or our non -emergency number. Councilmember Mohrig Thank you for having officers patrol the surrounding neighborhoods. I think it really helped. Police Chief Austin Yes. Councilmember Bentley Do you know if they are allowed to sell commercial grade fireworks? Police Chief Austin I can get that information for you. Councilmember Bentley I think our citizens need to know when a permit is required for using fireworks; residential versus commercial grade fireworks. Mayor Lockwood Chief Austin, could you please let us know the requirements for using commercial grade fireworks versus residential grade? Motion and Vote: Councilmember Bentley moved to approve Agenda Item No. 18-190 Councilmember Mohrig seconded the motion. The motion passed (6-0). NEW BUSINESS Consideration of a Resolution to Dissolve the Milton Cultural Arts Committee (MCAC) and to Recognize the Work of Its Members. RESOLUTION NO. 18-07-481 (Agenda Item No. 18-199) (Sarah LaDart, Economic Development Manager) Sarah LaDart, Economic Development Manager We are here to discuss the request to dissolve the Milton Cultural Arts Committee. In October 2016, we voted to create the Cultural Arts Committee with the intent to advocate, promote, and participate in the selection and interpretation of cultural artwork and art events to encourage local exploration, generate civic pride, showcase local artists and increase tourism for the city. The committee that you brought together has, on their own, funded the creation of a 501(c) (3) which will increase their opportunities for grants and the collection of donations. Bill Purdie, our Chairman, is here tonight to talk to you about this opportunity. At the end of his presentation, we are asking for your approval to dissolve the Milton Cultural Arts Committee and formally give your support to the Milton Arts Council. Regular Meeting of the Milton City Council Monday, July 9, 2018 at 6:00 pm Page 5 of 8 Bill Purdie, Chairman Milton Cultural Arts Committee Since my last presentation to council on January 29, 2018, our committee has continued to try to reach our goals for an arts program in the city. One of our goals was to create a non-profit organization capable of raising funds. So, on May 1, 2018, we created the Milton Arts Council, Inc. It is a certified Georgia non-profit corporation and I am the president. The Board of Directors of this corporation consists of the seven council appointed members of the Milton Cultural Arts Committee in addition to three other individuals; an attorney, a CPA, and Sarah LaDart who will be a non-voting director and will serve as the liaison between the committee and the city council. During our first meeting, we adopted articles on incorporation and bylaws that will support our federal tax filing as a 501(c)(3) corporation which will occur about one year from now. We have already conducted the "Milton's Got Talent" program and the winners were supposed to perform at the Beach Bash but it was canceled due to inclement weather. The winners will now perform at Crabapple Fest in October. In addition, we are now responsible for the Milton Literary Festival which is scheduled to be held in November. The following Agenda Item was added to the agenda by motion and vote under Approval of Meeting Agenda: 2. Consideration of the Adoption of a Joint Defense Agreement regarding Pending Tax Appeal Litigation. (Ken Jarrard, City Attorney) Ken Jarrard, City Attorney I have distributed the Joint Defense Agreement so each of you should have a copy of it. There are two class action lawsuits that were filed against the Fulton County Assessor's Office regarding the countywide assessments conducted by Fulton County challenging the valuations performed during the past three years. The lawsuits implicate not only Fulton County but also every municipality in Fulton County. There are several attorneys involved in this litigation so we are requesting a Joint Defense Agreement so all the lawyers involved can talk freely among each other regarding this lawsuit without waiving the attorney client privilege. It allows me to be able to discuss with you information that other jurisdictions have revealed. You will have to keep the information private as part of our common litigation defense strategy. I am requesting your approval of this Joint Defense Agreement. Communications Sara Leaders, Transportation Engineer As of today, we have received about 87% of the projected TSPLOST funds. Our TSPLOST Batch Two projects which consist of Hopewell/Hamby and Hopewell/Thompson are nearing the concept phase completion. A public survey has been sent out. As of Friday, we have received 890 responses of which 825 were Milton citizens. The northeast Crabapple project is beginning the right-of-way acquisition process and concluding the final design. Today, we issued a "notice to proceed" for the Morris at Webb Road roundabout. In the next few weeks, the "notice to proceed" for the Freemanville at Providence roundabout will be issued.. GDOT identified two quick response projects which consists of left turn lanes on Hwy. 372 at Batesville and Hwy. 372 at Green Road. Bob Edgar, Fire Chief Three of our staff members attended the MDA summer camp program with some of the funds that were collected during the boot drive which helped fund and send children with special needs to the camp.. We want to thank Councilmember Laura Bentley who helped us with our horse training program. We had many new firefighters who had never come face to face with a horse before, so she was able to help calm the nerves and assist with training. She also helped us get donations for equipment to keep on our trucks in case a horse gets loose in the community. We recently filled a vacancy in the fire department with a female firefighter, Chelsea McDonald. She is a state certified paramedic and started the fire academy training today and will be joining us in about ten weeks. Jason Howard, our chaplain, spent three days visiting all of our firefighters in an effort to get to know everyone in case a need may arise. The final tornado siren at Wood Road and Birmingham Highway has been installed. We just completed the purchase of a new ATV which will assist in transporting patients who are injured deep in the woods, especially in Birmingham Park. It was very well received and many citizens were appreciative of the educational awareness that was communicated throughout the city regarding loud noises and the potential damage that it can cause to animals. The motion passed (6-0). RECONVENE Motion and Vote: Councilmember Longoria moved to reconvene the Regular Meeting at 7:23 p.m. Councilmember Mohrig seconded the motion. The motion passed (4-0). Councilmember Bentley and Councilmember Kunz were absent from the vote.
