J J e • To Mayor Joe Lockwood an the Milton City Council My name is Charlie Fisher and I live at 388 Taylor Glen Dr. Milton Ga. As a resident now for 3 year I have written to you about various items affecting our city. As a native New Yorker, Massapequa Long Island I traded a waterfront home where I had a boat and a few slips for people to visit for a home with a cattle farm at the end of my road and some horses along the road as well. I went from talking to people to talking to the animals, and I love the change. I want to keep it that way. The vote that you are taking tonight could be the most important one of your term with the city . It is not without controversy and has divided our city. I am for the formation and approval of the Conservation Subdivision Ordinance . One of the major points that everyone talk about is the type of waste treatment that will be installed . I have contacted Chris Kum nick with GPH he has facts about individual system failures as well as CSD failures if any exist. One of the things that should be kept in mind is the CSD waste plants have to be regularly inspected and the report filed with the state. An individual septic tank could fail and no one would know since there is no rule for individual systems. To me that is a very important issue. White December 7th, 2015 City of Milton Mayor and City Council 13000 Deerfield Parkway , Suite 107 Milton, GA 30004 Re : Conservation Subdivision Ordinance Dear Mayor and Councilmembers COUNCIL for QUALITY GROWTH The Council for Quality Growth is a not -for-profit trade association comprised of a diverse membership of developers , contractors, engineers, architects , planners , law firms and bankers with a vested interest in quality growth and development in the Region . As you consider adopting the proposed Conservation Subdivision Ordinance , the Council would like to offer comments and suggestions on how the ordinance language can be improved in terms of clarity and enforceability. The Council is in support of allowing conservation subdivisions as an option for residential subdivision development in Milton. Conservation Subdivisions provide effective regulatory framework to preserve large tracts of open space and the overall rural neighborhood character and natural beauty of the City . In an effort to refine and adopt a balanced , implementable Conservation Subdivision ordinance , the Council respectfully requests that the following considerations are addressed: • Rev isions are needed in order to clarify whether the Conservation Subdivision Ordinance is mandatory to all residential developments over 20 acres , or just those 20+ acre residential developments in the AG-1 , R- 1, and R-2 districts . Moreover, as currently written , the Ordinance does not clearly state whether the Ordinance's regulations are mandatory or voluntary . The Ordinance's use of "shall be the preferred" method of subdivision is vague and indefinite. Vague legislation gives rise to procedural due process claims because individuals do not have fair notice as to whether they are within the scope of the leg islation. o The Council recommends that Sec. 50-139.C.-D . regarding Use Permits be removed from the ordinance before adopting to clarify that Conservation Subdivisions are an encouraged, but voluntary option for residential subdivision development in Milton that provides additional flexibility to the developer and ensures greater preservation of greenspace and Milton 's rural character as laid out in Sec. 50-138. o Further, there is inconsistency with the inclusion of all residential zoning districts in the ordinance . Specifically, R-4 , R-4A, R-5 , and R-5A currently allow a base density of less than .25 units per acre which is in conflict with the Conservation subdivision Lot Design Standards in Sec. 50 -145.A. 5901-C Peachtree Dunwoody Road, Suite 500 I Atlanta, Georgia 30328 I councilforqualitygrowth.org I 770.813.3370 • Clearly specify the lot yield for conservation subdivisions in way that encourages developers to choose this option. Section 50-140.D. does not sufficiently specify the lot yield for proposed subdivisions. The Council recommends the following language: The maximum number of lots in the basic Conservation Subdivision option shall be calculated based on a conventional subdivision design yield plan where the number of units resulting from the yield plan plus 10 percent of total units yielded, or total units resulting from conventional subdivision yield plan multiplied by 1. 10. • The Council recommends considering additional incentives such as a Parks and Recreation Impact Fee waiver for conservation subdivisions . As additional greenspace is provided on site in new conservation subdivision developments, the per-home impact on the City's park system will be greatly diminished . My wife, Marilyn , and I have been on 13475 Birmingham Highway for 46 years. We have 7 . 72 acres that we want to subdivide and give to our 5 grown grandchildren to build a home if they so desire. I don't see why I have to give the government or anyone else part of my land for any reason . The existing AG-1 allows for plenty of green space on each acre after a home is built. I haven't seen too many homes that cover a full acre . Also , the beauty of riding up Birmingham Hwy is to see the homes, especially at Christmas time, not to have them blocked by unnecessary buffers and setbacks .
