Councilmember Longoria seconded the motion. The motion passed unanimously (7-0). PUBLIC COMMENT Scott Reece, 13685 Highway 9, Milton, Georgia 30004 I am here tonight to seek your guidance. I have a client that has a thirty acre parcel. He is seeking to create approximately five 6 acre tracts of land. He is an elderly gentleman that has owned the property many years . The land has some topography on it and is not really suited for horse farms but in his mind he wants five 6 acre wooded lots . We went through the process and met with Robyn and Carter and everyone and thought we had a plan to work with . As we moved further into the process , the fire code inhibits or stops what we were planning to do. The property is located down a public gravel road that I does not have Fulton County water accessibility. There is no water main down the road. I cannot find the written fire code ordinance that states how the city handles individual house construction. I know in a subdivision there is a hose lay distance but in this particular case , we cannot go forward without doing I about $200 ,000 of infrastructure work. So , now the client states that we will have to market the land to a developer and have 30 one acre lots built. You and I just spent two years of trying to figure out a way not to go down that path. I am at my wits end. I am not disparaging anyone on staff; they are trying to help too. But, I would like for you to guide me in how we can go forward. I have two other tracts that are very large , 100 plus acres each, and they are both on gravel roads . They are looking at developing 20 acre lots but if we would have to invest in infrastructure work like we would on a major one-acre lot subdivision, it will not happen. I am looking for ideas or options of how we could go through limiting our infrastructure costs in order to preserve Milton 's larger tracts of land with bigger lots. I think everyone understands that as people age and inheritance comes into effect, some of these parcels are going to have to be sold . It is not a choice it is a must and if we can keep them from being divided into one acre lots , I think it would benefit everyone. I am here seeking your guidance. I know the SMSA that we are precluded ; I know we do it in Cherokee County . I thought everybody played by the same rules as far as the state on the infrastructure or storm water management and I would have thought the fire code too. Margaret Lootens, 3515 Peacock Road, Milton, Georgia 30004 I have come this evening to follow-up on my comments from last week. I would like everyone to know that our City Manager did reach out to me and offered to have a meeting with the Mayor, Police Chief, Councilmember Thurman, and himself. Councilmember Mohrig offered to attend the meeting as well. I would like to let you know that I have not heard back from Mr. Seeba yet. My male neighbor has flooding issues as well and received a call back from Mr. Seeba. I have flooding not only in my yard but on the Greenway Trail; people across the street from me , down the street from me in Alpharetta and Roswell. I The Camp Creek runs through my HOA property and it , unfortunately , has become a dumping ground for a lot of trash which is what brought me to City Hall to comment for the first time in December 2014. I am bringing up the issue of people not being treated eq ually which is something that is in our Ethics Code which is up for discussion this evening. I live at the comer of Bethany Bend and Morris . There has been a Walmart shopping cart on the sidewalk for about a week now. It was in the storm water. I am concerned I I I Regular Meeting of the Milton City Council Monday , January 4, 2016 at 6:00 pm Page 3 of 12 about our community picking up the trash and enforcing our ordinances in regards to solid waste. It is a matter of respect for the environment and everyone who lives in the city. Last time, I came to City Hall to question why the budget was not posted online and we were all told that a copy of the budget would be available at the Finance counter. When I came to City Hall to get a copy, there was not one available. I was told that I would have to complete an Open Records Request and pay a per page copying fee to take a copy home with me. I don 't think that was handled very professionally or of high integrity by the City Manager. I hope as you look at the Ethics Code this evening you will keep in mind how much you care about ethics as much as I do. I would suggest that you postpone your vote on the Ethics agenda item tonight and perhaps take a look at how the city has performed and produce a report card on how the city is doing. This past year, 2015, has been very contentious. There has been a lot of discord in the city. We had the email scandal as well as other incidents, so I think it would be prudent to take a look at what the city is doing in regard to ethics. Mayor Lockwood As a general comment, I want all our citizens to know that I as well as all of our councilmembers are available to our citizens to help resolve issues. Jack Lindon, 14810 East Bluff Road, Milton, Georgia 30004 At the Milton Grows Green Meeting on December 17th, a Milton resident attending his first MGG meeting, made a public statement criticizing MGG and the committee 's advocacy role on environmental issues for the public and city council. I want to set the record straight on this issue. In 2008, the resolution that created MGG , stated that the committee was formed , "for the purpose of recommending action to the city with regard to environmental matters." And , the latest MGG bylaws adopted by the city in December 2014 , states that , "the purpose ofMGG includes identifying policies and practices that promote sustainable development and encouraging sustainable development that preserves green space in collaboration with other environmental entities." It is clear that the MGG involvement in environmental policy issues is appropriate and it has been consistently since our inception . MGG according to its mission statement is , "a citizen's committee advocating responsibly managed growth and conserving and protecting natural resources while preserving Milton 's heritage and natural landscape for future generations ." For those who are not aware of what MGG does for the community , we are presently involved in approximately twenty different programs and projects driving us towards our continued goal which is the protection of natural resources and green space. These projects and programs include the Adopt a Road Program, Rivers Alive Clean Up, Twice Annual Paint Collection, the Annual Earth Day Festival , and the Evergreen Schools Program just to name a few. With respect to policy , MGG has been directly involved with most of the city 's recent developments regarding land use such as the transfer of the development rights program, form based building codes and Impact fees. MGG members have been an integral part of each of the citizen committee 's set up to review these programs. More recently , MGG has examined and provided information to city staff and city council regarding the concept ofland development using the conservation subdivision approach as originally recommended by Milton 's Comprehensive Land Use Plan . Finally , the CLP adopted unanimously in 2011 by the Planning Commission and the City Council. It states that the city will work with the MGG committee to implement environmentally responsible policies and practices throughout Milton . So , the idea that MGG is overstepping its mandate does not stand up to the facts or history and it is clear that our programs and 'knowledge add much needed input and value to the City of Milton. The motion passed unanimously (7-0). REPORTS AND PRESENTATIONS (N on e) FIRST PRESENTATION (No ne) PUBLIC HEARING (No ne) ZONING AGENDA (No ne) UNFINISHED BUSINESS 1. Consideration of an Ordinance to Amend Chapter 4 , Alcoholic Beverages , to Provide for Sales of Wine and/or Beer by the Package by Licensed Retail Consumption Dealers . ORDINANCE NO. 16-01-267 (Agenda Item No. 15-318) (Fir s t Presentati on at Dece mb er 2 1, 2 015 Mee tin g) (Stacey In g lis, Ass is tant City Manager) Stacey Inglis, Assistant City Manager I I The amendment for the ordinance before you is to add the ability for a consumption on premise dealer , which is a restaurant , to have the ability to also hold a package license for wine and malt beverages onl y. I This is simply a restaurant owner asking if this was possible. He has several patrons that wanted to purchase bottles of wine to consume off the premises that he has current access to. This amendment will allow for this to happen. Our Georgia rules and regulations do allow for this type of behavior to happen and allows for an owner to have two different licenses. Stacey Inglis I did not check that but can certainly do so. Councilmember Thurman So it is actually two separate licenses where one person holds both, correct? Stacey Inglis Correct. Both licenses for the same location. Motion and Vote: Councilmember Hewitt moved to approve Agenda Item No. 15-318. Councilmember Thurman seconded the motion. The motion passed unanimously (7-0). NEW BUSINESS I. Consideration of Subdivision Plats. (Agenda Item No . 15-322) (Def erred at Decemb er 2 1, 2 015 Regular Co un cil Mee tin g) (Kathleen Fi eld, Co mmunity Developm ent Dir ec tor) Kathleen Field, Community Development Director This is a revised plat for your review. As you may remember at our last meeting we did identify a few discrepancies in the chart that is in front of you and those corrections have been made and have been reflected in this list dated January 4 , 2016. In addition , we did add an additional column, per your request. It is the last column entitled Density. Before you are the 11 subdivisions for your review and approval. Councilmember Lusk With respect to number 7 on this list that involves two lots on Francis Road at the intersection of Thompson Road , do these lots have the same zoning that falls within the Crooked Creek area? Kathleen Field Yes , these lots are over one so the zoning is more than an AG-1 zoning. Councilmember Lusk We are getting two lots on one and half acre. Are the y on sewer? Kathleen Field Yes they are. Councilmember Lusk On number 10 , Parkside at Silos Green Road , three and one third acres with fourteen lots , what zoning classification does that fall within? Kathleen Field Yes. Councilmember Lusk Just to make a point, there are still provisions out there for more than just one home per acre. This really points that out. In spite of all of the resistance to the contrary, we are still building at a higher density than what most people really realize. It is allowed by code and our zoning ordinance. Kathleen Field Correct. Motion and Vote: Councilmember Kunz moved to approve Agenda Item No . 15-322. Councilmember Hewitt seconded the motion. The motion passed (7-0). I 2. Consideration of a Resolution ofthe Milton City Council to Re-Adopt the Five GMA Ethics I Principles for Recertification to be a Georgia Certified City of Ethics. RESOLUTION NO. 16-01-359 (Agenda Item No. 16-005) (Chris La gerbloom , City Mana ger) City Manager Lagerbloom This is presented every year for your consideration and continuation as being a GMA Certified City of Ethics. If you adopt this resolution which you are pledging, the city will conduct its affairs in these five ways: 1. Serve Others , Not Ourselves 2. Use Resources with Efficiency and Economy 3. Treat All People Fairly 4. Use the Power of our Position for the Well Being of our Constituents 5. Create an Environment of Honesty, Openness and Integrity This is more procedural than anything but I wanted to present this for your consideration. If you adopt this resolution we will forward the appropriate copy to GMA so that our Certification of Ethics remains in effect. Councilmember Longoria I know we do this every year and even if for some reason we were to drop our guard and not as compliant as we should be , that is no reason not to take the pledge every year and say we are going to be I a city of ethics but a citizen brought up an idea of gauging our performance in accordance with the ideas behind that. I was wondering does the GMA provide some type of audit or assessment that we could use . Or is there any idea how we can do a report card on that? I am not looking to create a whole big process and generate a lot of work because I do think we do really , really well in this particular area but I I I Regular Meeting of the Milton City Council Monday, January 4 , 2016 at 6 :00 pm Page 7 of 12 it would be good for us to somehow publish an activity or effort that we put into this area so that it is not just us reaffirming our adherences every year. It is actually backed up by some type of artifact that we can point to and say these are the things we accomplished in the previous year. City Manager Lagerbloom I do not know if there is something that is going to track exactly in line with the five principles I just read . We do publish an annual report and this is a year where we will be going back to the Public International Citizen survey to gain public confidence . We do this every other year. So we do have a couple of tools we use and publish the outcomes of those. If you recall at our last meeting the council adopted the Five Year Strategic Plan that we setup purposefully so we could have a report card to report against that Strategic Plan at the end of each calendar year. I anticipate we will have that scorecard in that format going forward but at this point it is a conglomeration of an annual report of outcomes and outputs , as well as our National Citizen survey that is public. Councilmember Longoria Would that all be available on our website ? City Manager Lagerbloom Yes. Councilmember Lusk Back in 2008 , I was one of two councilmembers down in Savannah that received the Certificate ofthe City of Ethics. I take it very seriously , as well as , personally. I feel like I have committed myselfto it as have others. But I feel like this is a time like in a marriage there should be a renewal of vows . We need to go back over it in some form trying to reinforce our belief in this code of ethics. It is not meant to be a menu driven code either. It should be all inclusive. I believe we all should be reminded occasionally of our code of conduct and our code of ethics and what it means to us as well as the entire community. We are setting an example up here every time we sit down up here or when we go out in the community. I know our city attorne y has conducted GMA courses on ethics and wonder if you have a condensed version of your presentation that you would be willing to give to us? City Attorney Jarrard I do a lot of ethics training for a lot of various groups including other governments. So if the City of Milton wanted me to provide an abbreviated overview hitting the high points , I would be glad to do so. I will tell you as your city attorney , this government does pay a lot of attention to this and candidly, a lot of attention you pay to it , I cannot disclose because it is things where we have discussions where you provide candid information to me and I provide candid counsel back to you therefore a lot of it citizens will not be aware of certain information. I can say you all take this very seriously though . I am happy Councilmember Lusk , to go over these with the council again . Councilmember Lusk Based on that Mayor, I would like to make a motion to defer this agenda item to our January 20th Regular Meeting and place it on our Work Session meeting on January 11th. Councilmember Longoria I hear what you are saying Bill and I support us trying to be a City of Ethics . I just question the delaying or deferring the acceptation that we are to take tonight because to me , regardless of anything , we should Regular Meeting of the Milton City Council Monday, January 4 , 2016 at 6 :00 pm Page 8 of 12 be able to do that on a regular basis . I was wondering if there is some other purpose you may have in I mind in deferring our affirmation. Councilm e mb e r L usk Well , I was thinking in a logical sequence of events . We would go through this process , it is like preparing for a ceremony , and you go thro ugh the educational part first and then say your vows afterwards. Very similar to getting married . Councilm emb e r Thurm an I understand where Bill is coming from but I think since this is something we do every year and being a reaffirmation , postponing it looks like we are not sure we are not there yet. I think we need to go ahead and readopt the GMA principles . They are not going to change and we need to make sure we adhere to them . If we need to make a follow up work session that the city attorney puts on then that is fine . I do not support postponing adopting the ethical principles because it makes us look like we are not sure we want the ethical principles . M ay or Lockw ood I agree with that. Councilm e mber M ohri g I wou ld like to see Ken give u s an overview. All of us who went through train ing when we became a newly elected official have gone through this but I think it would be a good thing to do. I think it would I be good for the public to hear the things we are presenting and swear to upholding. I agree to look at it at our next work session. City M an ager L a gerbloom This is one of the few resolutions that is adopted by the council where every councilmember is a signatory to it. Usually the resolutions are executed by the Mayor and City Clerk but this one we ask each of you to affirm these statements to be true by indicating your signature on the resolution . Consideration of a Resolution Appointing Members to the City of Milton Board of Zoning Appeals by Appointing or Reappointing Members from District 1/Post 2 , District 2/Post 2 and District 3/Post 2 . RESOLUTION NO. 16-01-360 (Agenda Item No. 16-006) (Mayor Jo e Lockwood) Councilmember Hewitt Todd Chemik will be my appointment to the BZA. Todd has been serving for the last nine years and has graciously agreed to continue for another four years. He is not here tonight but will be available next week for a swearing in. Motion and Vote: Councilmember Hewitt moved to approve Agenda Item No. 16-006 appointing Todd Chemik to District 1/Post 2 to the City of Milton Board of Zoning Appeals. Councilmember Thurman seconded the motion. The motion passed (7-0). Councilmember Kunz For the BZA , I want to reappoint Christopher Bloor who has served in that role. I loved the fact he has been looking at every issue in a way that brings better development to our city . Motion and Vote: Councilmember Mohrig moved to approve Agenda Item No. 16-006 appointing Chris Bloor to District 2/Post 2 to the City of Milton Board of Zoning Appeals. Councilmember Thurman seconded the motion. The motion passed (7-0). Councilmember Mohrig It is my pleasure to nominate Sumeet Shah who has served the last two years on the BZA and also recently stepped up to volunteer for CP AC. I appreciate his service for the last two years and him stepping up to do it another four years. RESOLUTION NO. 16-01-361 (Agenda Item No. 16-007) (Mayor J oe Lo ckwood) Councilmember Kunz I would like to nominate Perry Mason for the Design Review Board. Perry has served faithfully for the last four years and has done a great job. He has served the last two or three years and I appreciate his service and looking forward to him continuing. Councilmember Longoria seconded the motion. The motion passed (7-0). Councilmember Mohrig It is my pleasure to nominate Tim Bryan to the Design Review Board. Tim has served on the DRB for the last four years. He is an architect that has his own firm. I have worked with Tim professionally and respect his work and really appreciate what he has done for the city . Motion and Vote: Councilmember Longoria moved to approve Agenda Item No. 16-007 appointing Tim Bryan to District 3/Post 2 to the City of Milton Design Review Board. Consideration of a Resolution Appointing Members to the City of Milton Planning Commission by Appointing or Reappointing Members from District 1/Post 2 , District 2/Post 2 and District 3/Post 2. RESOLUTION NO. 16-01-362 (Agenda Item No. 16-008) (Mayor Jo e Lockw ood) Councilmember Kunz I would like to reappoint Mark Bittner to the Planning Commission who is a neighbor of mine and has been on the HOA for my subdivision Sable Point. He and I probably talk more regularly about issues than anyone. I really appreciate his thoughtful ideas and his perspective that makes our city better. I am much honored to have him serving another four years. Motion and Vote: Councilmember Thurman moved to approve Agenda Item No. 16-008 appointing Mark Bittner to District 2/Post 2 to the City of Milton Planning Commission . Councilmember Lusk seconded the motion. The motion passed (7-0). Councilmember Hewitt I would like to reappoint Fred Edwards to my appointment to the Planning Commission. He has graciously agreed to come back. They have done a lot of work on the Planning Commission and he feels his work is not finished yet. Motion and Vote: Councilmember Lusk moved to approve Agenda Item No. 16-008 appointing Fred Edwards to District 1/Post 2 to the City of Milton Planning Commission. Gariel has served for the last four years and has done a great job. He is someone who has been very involved and takes the job very seriously . Consideration of a Resolution Appointing Members to the City of Milton Parks and Recreation Advisory Board by Appointing or Reappointing Members from District 1/Post 2, District 2/Post 2 and Di strict 3/Post 2. RESOLUTION NO. 16-01-363 (Agenda Item No. 16-009) (Mayo r J oe Lockwood) Councilmember Kunz I would like to renominate Joey Costanzo to the Parks and Recreation Advisory Board. He began as Rick 's appointee and since then moved to my district. He has done a great job. I am very glad to renominate him . Motion and Vote: Councilmember Longoria moved to approve Agenda Item No. 16-009 appointing Joey Costanzo to District 2/Post 2 to the City of Milton Parks and Recreation Advisory Board. Councilmember Thurman seconded the motion. The motion passed (7-0). Councilmember Hewitt I would like to reappoint Ron Hill to the Parks and Recreation Advisory Board. Ron has been serving on this board for several years. He too li ved in a previous district but we were luck y enough to keep him in the city. Motion and Vote: Councilmember Mohrig moved to approve Agenda Item No . 16-009 appointing Ron Hill to District 1/Post 2 to the City of Milton Parks and Recreation Advisory Board. Councilmember Lusk seconded the motion. The motion passed (7-0). Councilmember Mohrig My pleasure to reappoint Phil Cranmer as my nominee for Parks and Recreation Advisory Board. Phil has served for the last year when Joey left and Phil was gracious enough to step up.
