The Regular Meeting of the Mayor and Council of the City of Milton was held on August 1,
2016 at 6:00 PM, Mayor Joe Lockwood presiding.

CALL TO ORDER
Mayor Joe Lockwood called the meeting to order.

Councilmembers Present: Councilmember Thurman, Councilmember Kunz, Councilmember
Lusk, Councilmember Hewitt, and Councilmember Mohrig.

APPROVAL OF MEETING AGENDA

Motion and Vote: Councilmember Thurman moved to approve the Meeting Agenda with the
following changes:
Add an Executive Session to discuss Personnel, Potential Litigation and Litigation.
Add after the Executive Session a discussion regarding Coker versus the City of
Milton Settlement Agreement.
Councilmember Hewitt seconded the motion. The motion passed unanimously (6-0).
Councilmember Longoria was absent from the meeting.

motion passed unanimously (6-0). Councilmember Longoria was absent from the meeting.

Motion and Vote: Councilmember Lusk moved to approve the Consent Agenda Item Number 4
as listed above. Councilmember Thurman seconded the motion. The motion passed unanimously

FIRST PRESENTATION
1. Consideration of RZ16-03 — Donegal Lane (Northern End) by 1699 Land Co., LLC to
Rezone from AG -1 (Agricultural) to R -3A (Residential) to Develop 26 Single Family
Homes on 17.25 Acres of an Overall Density of 1.5 Units per acre and a Concurrent
Variance to Reduce Setback for a New Street from 50 Feet to 0 Feet (Section 64-2397).

PUBLIC HEARING
1. Consideration of A Resolution of the City of Milton, Georgia Extending Through October
2, 2016, An Existing Moratorium Barring the Acceptance of Applications for Permits
Authorizing the Use of Community Sewerage Disposal Systems.

This is a public hearing of an existing moratorium regarding applications involving the use of
community septic or sewage disposal systems. This was originally enacted on a time sensitive
basis on April 11, 2016 which was a 30 day moratorium. It was then followed by a public hearing
on May 2, 2016 for a 90 day moratorium. Now, tonight, this is a public hearing for an additional
60 day extension. This places a moratorium on the acceptance of applications for permits to install
community sewerage disposal systems until October 2, 2016. This is so staff and council and
consider amendments to Section 50-184 of the Code of the City of Milton.

This is the time when you can vote on the extension of this moratorium. The public hearing was
previously held tonight.
Motion and Vote: Councilmember Lusk moved to approve Agenda Item No. 16-170 with the
following change:
Add the following language between WHEREAS number 4 and WHEREAS number
5:
"WHEREAS the city is mindful that community sewerage disposal systems have been used
successfully in Milton, in Georgia, and throughout the United States for many years, and"
Councilmember Kunz seconded the motion. The motion passed (5-1). Councilmember Hewitt
was opposed. Councilmember Longoria was absent from the meeting.

Carter Lucas, Public Works Director
We are paving and striping on the Deerfield/Webb project. Weather permitting, we should be
done with the project by August 12'`. The Hopewell/Birmingham roundabout looks like it will be
completed by the end of September. We also have landscaping scheduled for the center of the
roundabout as well as the Byrd House. The Crabapple Road project is still on schedule for a June
2017 opening. Paving work throughout the city is almost complete. We are getting one more
evaluation on the trees at the Broadwell Pavilion to determine whether they will have to be cut
down. We have been in contact with Urban Timber Rescue, a company that specializes in reusing
wood in various creative ways. The Cogburn Road sidewalks will probably be completed in 30
days. Lastly, Highway 9 repaving will begin tonight. The repaving of Highway 9 will be done at
night.
Bob Edgar, Fire Chief
Last month, I gave you our fire response times. Tonight, I want to share with you the things we
are doing for fire prevention and community outreach. Last year, we conducted over 1,000 hours
of fire safety and community education. We have conducted 645 fire inspections on businesses
which consists of 443 hours from our Fire Marshal's office. In addition, the Fire Marshal's office
has looked at 116 plan reviews. Our department has also investigated 107 fire instances. From
2010 to 2016 there has been $12,960,000 in fire loss/property damage. We have also compiled
reports of churches, businesses, etc. of the layout of their buildings so that if we ever get a fire call,
we are familiar with the property. We got a perfect score on the fire prevention part of our ISO
report.

As you know, the city has begun the FYI budget process. The City Manager and myself have
met with most of the departments and have begun the discussion of maintenance and operating
budgets as well as some new initiatives. The first budget workshop is scheduled for Monday,
August 8t` so you will be seeing some preliminary ideas at that time. We are also working on
streamlining and outlining the different processes to obtain an Alcohol Beverage License, Business
License, Pouring Permit, etc. so it is easier for our citizens to understand. They will be put on our
website upon completion.

Our IO h anniversary is quickly approaching. December 1, 2016 is the date which is a Thursday
and we have thought about having an event on that night. That following Saturday, December 3rd
is Christmas in Crabapple so we are really wanting it to be an entire weekend celebration. We
want to brand every event during the next year as a celebration of our 10'h anniversary. We thought
we could have a very lovely party at the Broadwell Pavilion. We would remove the picnic tables
and replace them with high tables, bring in commercial heaters as well as have a fire. We would
expect about 100 people to come to the celebration. We would decorate the pavilion with white
lights as well as put white lights in the surrounding trees. We would serve wine and soft drinks,
birthday cake, and light finger food. It would be from 5:00 to 7:00 pm and would include short
speeches from city officials. We could also have a special souvenir Christmas ornament made as

a souvenir of the event. We polled a focus group of mother's regarding a parade and they thought
it would be best to have a parade on the Saturday before December 1 st during the day. mad
Regarding the grand opening of the new City Hall, as you know, we have to be out of the Deerfield
space by April 1St. In order to give employees plenty of time to get moved in, we thought Saturday,
April 291h would be an appropriate time for the grand opening celebration. The event would be
from 6:00 to 10:00 p.m. We have set aside space in the parking lot behind the new City Hall where
a tent could be set up. We would like to have a casual horse type theme to include dinner, dancing,
cocktails, and the official ribbon cutting. We looked at other cities that have charged for events
like this so we are proposing $30 per person with a cash bar.

Motion and Vote: Councilmember Hewitt moved to go into Executive Session to discuss
Personnel, Potential Litigation and Litigation.at 6:40 p.m. Councilmember Mohrig seconded the
motion. The motion passed unanimously (6-0). Councilmember Longoria was absent from the
meeting.
RECONVENE
Motion and Vote: Councilmember Kunz moved to reconvene the Regular Meeting at 6:50 p.m.
Councilmember Thurman seconded the motion. The motion passed unanimously (6-0).

The following Agenda Item was added by Motion and Vote under Approval of Meeting
Agenda:
Add after the Executive Session a discussion regarding Coker versus the City of
Milton Settlement Agreement and Full and Final Release of all Claims.
Motion and Vote: Councilmember Hewitt moved to approve the Settlement Agreement between
Chris Coker and the City of Milton to include $20,000 and various forms of release in exchange
for a full and final release of all claims in favor of the City of Milton and all its employees, officials,
etc. Councilmember Mohrig seconded the motion. The motion passed unanimously (6-0).
Councilmember Longoria was absent from the meeting.
