'" Ile\ M'E ~.f''LL£ r .. ?tts ~tuil ~ z~ My name is Travis Mills My address is 2983 Oakside Circle , Milton , GA 3it\'04 of l.Aj.f._,S ' Mayor Lockwood and Members of the City Council: Paragraphs 6.35 and 6 .36 of the Milton City Charter require that H o mestead Exemptions for Milton 's senior citizens be determined by using the citizen 's Adjusted Gross Income (AGI) minus a portion of their retirement income. And, that portion of retirement income is limited to the maximum benefit payment amount from Social Security used for the current year. Paragraphs 6 .35 & 6.36 are not complicated. Their instruction s a rc simple and specific. They don 't require anything beyond grade school reading for full understanding or anything beyond middle school arithmetic to do the calculations . Attempts to portray the clear language of these paragraphs a s being legally confusing, requiring extensive legal researc h or legal clarification are both condescending and patronizing to the citizens of Milton. On Feb. I 0 , 2016 , I brought to the attention of City official s that they were failing to subtract a portion of senior's retirement income when determining eligibi l ity for Senior Homestead Exemptions as required by the specific provisions of Par. 6.35 & 6.36. Th e matter was referred to the City Attorney and two weeks later, on Feb. 24th, I received a courtesy telephone call to tell me the City Attorney said I was right and the provisions of Par. 6.35 & 6 .36 o f the City Charter were not bein g properly followed . For the next 36 days, however, rather than the City Administratio n working on corrective measures , by trying to find those Milton senior citizens who have been im p roperly informed regarding their eligibility and who have been unlawfully taxed in the past , the City Attorney 's law firm somehow became involved and began searching every avenue of state la w and beyond in search of some rationale to justify the use of AGI as the sole determinant of Senior Homestead Exemptions in Milton , this despite the clear and simple language of Par. 6.35 & 6 .36 . Following their 36 days of searching, the law firm inexplicably is sued another opinion on April I st revers ing the City Attorney 's earlier opinion and concluding , out of thin air and with much legal gobbledygook, that the City of Milton "has been correctly applying" senior exemption s by comparing senior's adjusted gross income to the max imum social security benefits. That is undeniably in error as can be seen by simply reading Par. 6.3 5 & 6.36 of the Charter. And, needless to say, their conclusion flies in the face of the clear instructio n to include only a portion of AGI with that portion to be determined by removing part of retirement income. It is almost certain that Senior Homestead Exemptions were pro p erly administered in Milton at one time , just as the Charter paragraph s require. That is because th e application forms , even last week, required full disclosure of all retirement income . The applicant has to furnish his "Social Security, Pension , Retirement, Railroad Pen s ion , VA disability and , as it says , Other Pension, Retirement, Disability Income not listed above". The only possible reason for requiring that information would be to follow the instructions in Par. 6.35 & 6 .36 of the Charter; othe rwise , all that needs to be asked for is AGL The City Attorney and his law firm seem obsessed by the potenti a l income that a 65 or 70 year plus Milton senior citizen living on retirement income might have and still qualify for a homestead exemption. They simply ignore the fact that Par. 6.35 & 6.36 require that a huge portion of the senior's retirement income be s ubtracted from his AGI in order to qualify . ln addition , they pay no attention whatsoever to the effect their recommendation would have on 65 & 70 year plus Milton senior citizens at lower income levels . For example , if their recommendation were to be followed , an elderly senior citizen living almost entirely on Social Security but with an AGI of $63 ,337 would be ineligible for a Senior Homestead Exemption because it is one dollar over the Social Security maximum of $63 ,336 this year. ln a brochure now being distributed by Milton 's Finance Department entitled "Policy Statement Regarding Low Income Homestead Exemptions", the claim is made , regarding the City Attorney 's AGI recommendation that "This approach is consistent with how similar exemptions have been applied in other counties and municipalities as well ". While that may be true of some unidentified locations, somewhere , it should be noted that Fulton County and the City of Alpharetta both subtract retirement income , up to the current Social Security maximum , just as is presently required by Milton 's Charter but which is being ignored. I live in a community nearby with 96 individual living units , 118 residents , of which 64 are elderly women or widows living alone. Nearly all residents receive Social Security and retirement income and qualify for Milton Senior Homestead Exemptions by the terms and provisions of Par. 6.35 & 6.36 of the City Charter. By using the City Attorney 's recommendation , their Senior Homestead Exemption, for which Par. 6.35 & 6 .36 now legally qualifies them , would be denied and their property tax liability would go from as low as $0 with their present legal exemption to $400 or more, depending on their property evaluation. That can only be construed as a huge tax increase. The City Attorney 's recommendation should be viewed from two standpoints . First, he recommends that you , the City Council , remove the part of the Charter that now gives legal tax exemption to 65 and 70 year plus Senior Citizens living on retirement income . Second , his recommendation targets those same 65 and 70 year plus citizens living on retirement income for a substantial property tax increase. The City Attorney was wrong with his opinion that the City has been correctly applying Senior Exemptions, he is wrong with his recommendation to use AGJ alone to qualify for those exemptions and it would be wrong for the City of Milton to target 65 and 70 year plus citizens living on retirement income for a substantial property tax increase . The City Attorney 's opinion and hi s recommendations should be rejected . And finally , it should be noted that the City Charter's plain language both in the past and today means what it says and should be followed to the letter beginning today for the lawful benefit of Milton 's 65 and 70 year plus seniors living on retirement income.
