Summary : Action on the proposed enhancements to the rural views hed shou ld be deferred until significant issues with the proposed amendment are resolved. The proposed enhancements eliminate the prohibition against disturbing the existing 40-foot undisturbed rural viewshed buffer. The proposed amendments replace the existing 40- foot undisturbed buffer with a 40-foot primary setback. Penalties are added for disturbing the 40-foot primary setback if disturbance occurs before permits are issued. However, there are no specified penalties for disturbance after permits are issued. Penaltie s for disturbing the rural v iew shedinclude the option of a financial recompense payment. Replanting of the disturbed area is not mandatory and should be required if the viewshed is disturbed before or after permits are issued. Recommendations: •Maintain the existing 40-foot undisturbed bufferrequirement. Do not replace the undisturbed buffer that protects all of the vegetation within the buffer with a setback that protects only select tress and prohibits the construction of structures in the setback. AG-1 already has a 50 foot minimum rear yard setback. A 40 -foot rural viewshed setback is not required to prohibit structures in the rural viewshed. • Provide penalties for disturbing the views hed after permits are issued . Replanting sho uld be required to restore the disturbed area to its original condition. • Eliminate the recompense option for disturbing the rural viewshed before permits are issued. • Provide an exception that permits disturbances to the rural viewshed for bona fide agriculture purposes. Specific Issues: 1 Because the proposed Rural Viewshed enhancement eliminates the current 40-foot undisturbed buffer and replaces it with a 40 -foot primary setback, action on the proposed enhancement shou ld be deferred . The majority of the City of Milton is included in the Milton Rural Overlay District including Birmingham Crossroads as described in the attached map . Sec. 64-1119 . The Rural Milton Overlay District requires rural viewshedprotection for single family residential uses. The existing rural viewshed protection prescribes by the Rural Milton Overlay District states: Provide a 40 -foot undisturbed buffer and an additional 20 -foot no improvement setback for single-family lots adjacent to exterior streets . Where sparsely vegetated , replant the undisturbed buffer in a natural fashion , per the approval of the city arborist. Submit landscape plan to arborist for the preservation of the rural view shed. Sec. 64-1141. -Single-family type uses. Three provisions in the Milton Rural Overlay District currently protect Milton's rural viewshed . A) 40-foot Undisturbed Buffer: Disturbances are prohibited. No grading is allowed and no removal of understory trees and vegetation is allowed. B) 20-foot no improvement setback:The constructions of structures are prohibited in the 20 feet adjacent to the 40-foot undisturbed buffer. C) Enhanced Natural Buffer: Where the existing undisturbed buffer is sparsely v egetated and therefore inadequate, planting to provide addit ional vegetative screening per the approval of the city arborist is required. No disturbance , including grading, is allowed except for the initial planting in a natural fashion of the undisturbed buffer. The proposed rural viewshed "enhancement" eliminates the 40-foot Undisturbed Buffer and replaces it with a 40-foot primary setback. A setback in land use is the distance that a building or other structure is set back from the road. Within the 40-foot primary setback disturbances are allowed with the approval of the city arborist. The proposed rural viewshed enhancement eliminates the prohibition on grading and removal of trees within the existing 40 -foot Undisturbed Buffer. The protection of the rural viewshed shifts from a prohibition against disturbance to an allowance of clear cutting and grading and minimal replanting subject to the appro val of one individual. One individual and his subjective opinion is the only protection of the rural viewshedprovided in the proposed rural v iewshed "enhancement". One individual regard less of his determination to protect the rural viewshed must be able to stand strong when challenged by a developer and his team of land planners, engineers , landscape architects and attorneys. This is an unfair burden to place on any individual and a taking of the protections provided by the existing rural viewshed ordinance from citizens. Due to the lack ofrecent enforcement of the 40-foot undisturbed buffer requirement for recent residential subdivision developments , many people may not be aware that Milton currently has a rural viewshed ordinance . The proposed rural viewshed enhancement includes several good first efforts at providing additional enforcement standards. Sec. 64-416 (k) (5) requires the installation of tree save fence at the 60 foot primary setback. However the paragraph notes the purpose of the fence is to protect heritage trees , protected trees and 2 specimen trees. Protection of a few select trees is a significant departure from the current requirement to maintain a 40-foot Undisturbed Buffer. Sec. 64-420 provides penalties for any disturbances of the rural viewshed before the appropriate approvals for disturbances are issued. However the proposed enhancements remain silent regarding any penalties for disturbances after permits are issued. And that is exactly why we have a problem today with enforcement of the existing ordinance. There is no stated penalty for violating the existing undisturbed buffer requirement. Without adding a substantial penalty for violating the viewshed requirements , there is no enhanced compliance requirement. The rural viewshed is one of the most important features of our City. It is very important to correctly make the appropriate enhancements to the rural viewshed ordinance. Please defer action on the rural viewshed ordinance until an ordinance is drafted that addresses these concerns and provides the protections necessary to ensure the rural viewshed is maintained. As always , thank you for your service to our wonderful Milton community. Regarding tonight's agenda , I respectfully request your consideration of the following. I also ask that these comments be officially spread onto the minutes of each applicable zoning item . I. Community Septic: While there will be no vote tonight on Community septic systems in Milton, I am asking that yo u prohibit the use of community septic systems in Milton. This is not a new issue , yet an issue that needs to be put to bed. The citizens of Milton, on multipl e occasions, in multiple forums and over multiple years , have voiced their strong opposition to the extension of sewer, whether it be public or private, including community septic systems . Rather than debate the semantics of the term "sewer", the citizens of Milton view community septic as the extension of sewer. And rather than debate the technological aspects of community septic , the majority of citizens have voiced concerns and opposition to the use of community septic systems for a variety of reasons , including the fact that community septic systems ultimately allow for greater density than what is currently allowed under current requirements of single septic systems. This is not debatable. Community septic systems would allow for greater density in Milton as these systems bypass the natural constraints of the soil types and topographies of the land including stream buffers , steep slopes , wetlands , flood plains, etc. The natural constraints of the land today are a natural barrier to higher density. Additionally , the treatment of waste water via community septic systems does have a financial risk to the city; a financial and legal liability that the City has not been prepared to accept. When systems fail , and the y do fail , the liability will ultimately be borne by the city, and taxpayers . This is unacceptable. The Environmental Protection Division (EPD) has addressed the issue of failures , and has been on record as stating that these systems do fail. They also have noted in public forums that they do not have 1 adequate staff to monitor the systems. Nor does the City of Milton have staff in place to monitor these systems. All the questions and risks that existed surrounding community septic systems when the Conservation Subdivision Ordinance was denied, and when the Ebenezer Road rezoning was denied , still exist and answers are no more available now than they were then. The list of questions is long regarding community septic , and the risks to the community, the city and the taxpayers are simply too great. The citizens of Milton do not want community septic systems in Milton. Citizens want to maintain every avenue possible to preclude the increase of density upon our lands . The use of community septic systems allows for higher density than what would otherwise be allowed. Please prohibit the use of community septic systems. II. Education and New Requirements for Individual Septic Systems Separately, as it relates in individual septic systems , I ask that you please put in place: 1) Educational measures in place to help citizens better understand what is required to properl y maintain their individual septic systems, and 2) Basic requirements to have individual septic systems pumped out and drain fields checked ev ery so many years. A matrix could be created for various houses sizes , number of bathrooms , residents living in the home, etc. to determine the timeframes that would be applicable . And when resident s pay their annual taxes to the city of Milton, they could simply provide evidence that they hav e complied with the basic requirements . III. Contract with David Hodges for Providence Park Bridges There is an item under the consent agenda related to the design of two bridges at Providence Park. Nowhere in the published documents was there mention that the design of the bridges needed to be in compliance with the Milton Overlay design guidelines nor is it clear who has the authority and responsibility to review the designs before they are finalized. As such I ask that you please add language to the contract with David Hodges that requires the bridge designs to be in concert with the Milton Overlay, and that there be a review/approval at a minimum by the Town Architect and the Design Review Board but to also include the Community Development department. IV. Zoning Agenda Item: RZ15 18 Generally speaking, I strongly support AG 1 enhancements and improvements to the Tree Ordinance . In some cases , I do not think we have gone far enough . In addition to specific comments on the language of this zoning item, it is important to also acknowledge the importance of code enforcement as well as complete and thorough reviews of developments when the y are first submitted. I would ask that beyond changes to the zoning code , we give appropriate attention to the need for stepped up code enforcement of our existing zoning laws and standards , as well as identifying ways to improve and ensure a complete review of all standards at the time any development is submitted whether it be an AG 1 development or those in other zoning categories . Within RZ 15, 18 (Chapter 64), I have the following suggestions and/or comments: 2 1) Please apply the rural view shed requirements to all parcels , not just those of 3 plus lots . It is important that we have a consistent application of the required rural view shed. 2) In reference to entrances , the document references the allowance of materials that have "the appearance of natural materials ". I ask that you consider replacing this language simply with "natural materials ". 3) Regarding the rural view shed , it seems we may have lost something when the language move d away from a 40 ft . undisturbed view shed . It seems that an undisturbed rural view shed may still be in order. The new language eliminates the prohibition on grading and removing of trees within the existing 40 foot undisturbed buffer. This shift allows for instances when clear cutting , and grading in the undisturbed buffer could take place with the approval of a singular staff member. This seems contradictory to what the rural view shed language was intended to do. Perhaps have a variance process for exceptional situations , but generall y speaking require the current undisturbed view shed. 4) Regarding those to review rural view sheds , it is not adequate nor appropriate that only one person would have this responsibility. Rather than one person, and in this instance the Arborist , I recommend the rural view shed, and perhaps any AG 1 subdivision , be reviewed by a committee to include as an example , the Arborist, the Community Development Director, the Town Architect and possibly the Chair of the Planning Commission, and/or a member of the PC as voted on by a majority of the PC. Whatever the configuration, there needs to be more than one individual overseeing these important enhancements including the rural view shed . 5) Development Notification. This is a great step towards a more transparent process regardin g AG 1 developments. I would ask , however , that this be applied to all subdivisions not only those with 3 or more homes. Even those with two homes should be required to have the same development notification requirements to ensure AG 1 standards are upheld. 6) Violations and penalties. As noted previously, having only singular staff member responsible for reviewing the rural view shed is not appropriate. Nor is it appropriate that onl y one person determine what the necessary tree recompense should be in the case of violations of the rural view shed. I suggest the same committee noted previously also have responsibility for reviewing and signing off on any tree recompense required. Furthermore , this should not be subjectiv e , but instead there should be standards by which each situation can be gauged. 7) Please remove the Community Unit Plan (CUP) as an option within each of the applicable zoning districts. We have seen a misuse of the CUP zoning category in recent times. It has prov ided evidence that the CUP does not provide a vehicle for AG 1 enhancements , but instead a vehicle to undermine the very protections of our AG 1 lands that citizens seek . 8) Regarding gravel roads , anything adjacent to a gravel road , regardless of whether there is also a paved road for access , must require a 3 acre minimum per house. This is currently within our existing code , but recently , during the Ebenezer Road rezoning , it became clear that perhaps there had been instances of misinterpretation of the legal language in the current code . Tonight is the perfect time , the appropriate time , to clarify and restate that the language is not one of "this or that", but clearly if land is adjacent to a gravel road, the homes must be on 3 acre minimums. Please add this expressly to Chapter 64 and any other place within the zoning code necessary to ensure there is no ambiguity from this day forward. If these changes cannot be incorporated tonight, I respectfully request a deferral of these zoning items to ensure the language can be made as specific as necessary to enhance our AG 1 standards to the greatest extent possible. 3 · All o!the above statements similarly apply to RZ 15 19, RZ 15 20 , RZ 15 21, RZ 15 23 and RZ 15 24 . These same issues as outlined above also apply to each of these other zoning amendments. V. RZ 15 23, Community Unit Plan Please remove the Community Unit Plan as an option within Milton. The CUP has been misused and is counter intuitive to the efforts to enhance AG 1 developments. If you need more time to contemplate removing the CUP in it's entirely from the Milton Code, I request a moratorium on the use of CUP's until such time that the staff, City Manager, Mayor and Council have had time to determine the best course of action . The CUP has been misused and will continue to be misused if not removed all together. At a minimum , a significantly modified CUP is required to ensure all loopholes are closed and all unintended consequences are addressed. As an example, a CUP should never be allowed to undermine the underlying zoning of a parcel of land. Please eliminate the CUP from our zoning code. And if this is not the action of tonight , please put a temporary moratorium on the use of CUP's. VI. Chapter 50, 162 I concur with the removal of the amendments to this chapter of the code. VII. Chapter 48 (Please note , there was no red lined version of this document available within the packet on the City of Milton website making it difficult to ascertain what was new language): Regarding gravel roads , and as noted during comments related to Chapter 64, anything adjacent to a gravel road, regardless of whether there is also a paved road for access, must require a 3 acre minimum per house. This is currently within our existing code, but recently , during the Ebenezer Road rezoning, it became clear that perhaps there had been instances of misinterpretation of the legal language in the current code . Please add this expressly to Chapter 48 and any other place within the zoning code to ensure there is no ambiguity from this day forward. Page 50 outlines ways in which gravel roads can be paved. These exceptions should not exist. The expectation of citizens and elected officials has been stated in numerous ways , policy documents , etc. regarding the importance of protecting our gravel roads, an asset of the city and of all citizens. Therefore, the three exceptions that would allow for paving of gravel roads should be removed . Expressly the current draft of Chapter 48 allows for the following: "Existing unpaved (gravel) roads shall not be paved except by the following processes": a. Petition of homeowners located on the road; (See public works policies.) b. Approval by city staff and, when that section of road has been identified as part of the trails plan, approval by the recreation and parks committee; and c. City council approval. 4 As if relates to the paving of gravel roads, please add language instead that would prohibit the paving of our gravel roads. A petition to pave gravel roads is simply not protective enough. Our gravel road network is part of what differentiates Milton from other communities; it is part of the rural fabric of our great community. A complete prohibition of paving the gravel roads is the only way to truly protect these treasures for perpetuity. In contrast, if a petition is allowed as a way to allow for gravel roads to be paved , there will be instances when the incentive to certain land owners, i.e. higher profits from more density , will motivate their signing of such a petition in an effort to pave a gravel road. This would negatively impact the gravel road/trail network which is an asset of the entire community, and therefore needs to have the necessary protections. Please prohibit the paving of our gravel roads. Similarly, neither the parks & recreation committee nor City Council should be able to vote to pave our gravel roads . Please prohibit the paving of these treasures. Still on page 50, Section 48 561, item #7 reads, "Proposed public unpaved (gravel) roads shall not be allowed". Please remove this sentence given there could be some instances when a public gravel road wo uld meet the needs of the community. Such an example could be within a public park whereby a more rural environment and look is desired . At a minimum, to prohibit any such consideration in the future would seem counter intuitive to the goal of maintaining and enhancing our rural environment. It was not that many years ago when the Department of Transportation told me we could never have roundabouts, yet today , fortunately roundabouts are being used widely. Please modify this language to at least keep the possibility of a public gravel road. Page 51 Creation of Sidewalks While concrete sidewalks are appropriate in the more urban areas of Milton, concrete sidewalks are not appropriate in the rural areas of Milton. Walkways and trails and the use of gravel roads are more appropriate . The language beginning with page 51 seems to promote sidewalks in all areas of Milton without the necessary differentiation of urban from rural areas. Please give careful consideration of this text, and modified it as necessary , to ensure we do not promote concrete sidewalks where they are not warranted and not desire by citizens. As an example, on page 51 , the draft language states: "All owners , developers , or occupiers of parcels of land where a development permit or building permit is issued and any portion of the parcel is within Yi mile of a school or active public park and the parcel is not identified on the current bike and pedestrian master plan shall be required to provide a sidewalk, consistent with the city standards ." In the instance of Birmingham Park, concrete sidewalks do not need to be constructed to that parkland. Granted the language references "active " parks , of which Birmingham is not , but this is an example whereby a concrete sidewalk would not be appropriate as it is out of character with the area. Instead, a trail of an alternative material, and not next to the road would be applicable. The current language in the draft document, however, does not seem to make this distinction. 5 This issue is a significant one, and I know you have heard from lots of folks over time regarding concrete sidewalks that go nowhere , and that are in conflict with the more rural environments. Please make changes to the current draft language to ensure more of the same does not take place; such unintended consequences when AG I enhancements are supposed to be the focus would be unfortunate. Page 53, City Street lights. The paragraphs reference ways in which citizens and businesses can request additional city street lights . There is no language within these paragraphs, that references the importance, too , of protecting our night sky. The night sky of Milton is another treasure that makes Milton unique . We need to continue to proactively protect it. As a result, I would ask that language be added to ensure the "protection of the night sky" is at least one of the considerations when determining if additional city street lights are warranted, and if they are in the best interest of the public or not. In some cases, more street lights negate the night sky, and therefore, would not be appropriate. Thank you very much for your consideration. Specific Issues: Because the proposed Rural Viewshed enhancement eliminates the current 40-foot undisturbed buffer and replaces it with a 40-foot primary setback, action on the proposed enhancement should be deferred . 1 The majority of the City of Milton is included in the Milton Rural Overlay District including Birmingham Crossroads as described in the attached map. Sec. 64-1119. The Rural Milton Overlay District requires rural viewshedprotection for single family residential uses . The existing rural viewshed protection prescribes by the Rural Milton Overlay District states: Provide a 40-foot undisturbed buffer and an additional 20-foot no improvement setback for single-family lots adjacent to exterior streets. Where sparsely vegetated , replant the undisturbed buffer in a natural fashion, per the approval of the city arborist. Submit landscape plan to arborist for the preservation of the rural view shed. Sec . 64-1141. -Single-family type uses. Three provisions in the Milton Rural Overlay District currently protect Milton's rural viewshed. A) 40-foot Undisturbed Buffer: Disturbances are prohibited. No grading is allowed and no remov al of understory trees and vegetation is allowed . B) 20-foot no improvement setback: The constructions of structures are prohibited in the 20 feet adjacent to the 40-foot undisturbed buffer. C) Enhanced Natural Buffer: Where the existing undisturbed buffer is sparsely vegetated and therefore inadequate, planting to provide additional vegetative screening per the approval of the city arborist is required. No disturbance, including grading , is allowed except for the initial planting in a natural fashion of the undisturbed buffer. The proposed rural viewshed "enhancement" eliminates the 40 -foot Undisturbed Buffer and replaces it with a 40-foot primary setback. A setback in land use is the distance that a building or other structure is set back from the road. Within the 40-foot primary setback disturbances are allowed with the approval of the city arborist. The proposed rural viewshed enhancement eliminates the prohibition on grading and removal of trees within the existing 40-foot Undisturbed Buffer. The protection of the rural viewshed shifts from a prohibition against disturbance to an allowance of clear cutting and grading and minimal replanting subject to the approval of one individual. One individual and his subjective opinion is the only protection of the rural viewshedprovided in the proposed rural viewshed "enhancement". One individual regardless of his determination to protect the rural viewshed must be able to stand strong when challenged by a developer and his team of land planners , engineers , landscape architects and attorneys . This is an unfair burden to place on any individual and a taking of the protections provided by the existing rural viewshed ordinance from citizens . Due to the lack ofrecent enforcement of the 40-foot undisturbed buffer requirement for recent residential subdivision developments, many people may not be aware that Milton currently has a rural viewshed ordinance . The proposed rural viewshed enhancement includes several good first efforts at providing additional enforcement standards . Sec. 64-416 (k) (5) requires the installation of tree save fence at the 60 foot primary setback. However the paragraph notes the purpose of the fence is to protect heritage trees , protected trees and specimen trees . Protection of a few select trees is a significant departure from the current requirement to maintain a 40-foot Undisturbed Buffer. Sec. 64-420 provides penalties for any disturbances of the rural viewshed before the appropriate appro vals for disturbances are issued . However the proposed enhancements remain silent regarding an y penalties for disturbances after permits are issued . And that is exactly why we have a problem today with enforcement of the 2 .. existing ordinance. There is no stated penalty for violating the existing undisturbed buffer requirement. Without adding a substantial penalty for violating the viewshed requirements, there is no enhanced compliance requirement. The rural viewshed is one of the most important features of our City. It is very important to correctly make the appropriate enhancements to the rural viewshed ordinance. Please defer action on the rural viewshed ordinance until an ordinance is drafted that addresses these concerns and provides the protections necessary to ensure the rural viewshed is maintained.
