I moved here almost 4 years ago from Massapequa NY. While living in NY and for the first 2 years here I was a member and cochairman of Tuesdays Children a non for profit 9/11 charity that was formed to help the families affected by 9/11. Today it is one of the last active 9/11 charities. I worked in the North Tower for 3 years on the 102nd fl. After living here for a year I gave the former police chief and fire department chief flags containing the names of all the people who passed on 9/11 in hopes that the city could use them. Nothing was done with them so the following year I gave one to the Milton HS principle who I was told on 9/11 put it on his couch. In frustration last year I emailed the mayor who put me in touch with Jim Cregge our commissioner of Parks and Recreation. Jim is from NJ and wanted to help. He found the flags and we did a small ceremony at Freedom Park. This year we hope to do even a bigger one. Earlier this year I was speaking to a Tuesdays Children board member who lost his dad on 9/11. The discussion lead to why Milton does not have a permanent memorial, I contacted Jim Cregge and he said good idea but as far as he knew the city had no plans. I then contacted Matt Kunz my local councilman who liked the idea. We had a meeting with Jim, Matt and Steve Krokoff and they thought it was a good idea. I have contacted the law firm of Kilpatrick, Townsend and Stockton who have agreed to do a 501c3 document for me pro bono to get the ball rolling. I have also contacted the 9/11 memorial organization in NY about getting something for our memorial. They require a letter from the city on their letterhead requesting that. I have also recently found out that there are family members of people who died at the Trade Center on 9/11 who are Milton residents. My goal is to form an exploratory committee of family members and anyone else impacted by 9/11. Then add New Yorkers and then others from the community. I would hold an open contest for a rendering of what our memorial should look like and, with the help of the Arts Committee choose the proper memorial. With the number of local constructions firms around the city I thought that I could get some pro bono work done on the memorial or at least have it built for the cost of materials and discounted labor costs. My hope is that the city would donate land for this project and that we would hold fund raisers so that the cost to the City would be minimized. I do support the approval of conditional variances for lots 3 through 7. I also support the variance request for a building height increase on several lots. I have shared my specific concerns with City Council in the email below. However I will not be able to attend tonight's meeting. I oppose Agenda Item No. 16-131 requesting multiple variances for the Reserve at Providence. However, I support variances for lots 3 through 7 with specific conditions that will improve the viewshed along Providence Road. The developer is seeking setback relief on 13 of the 36 lots in the subdivision (36.1%), and height relief on 7 of the 36 lots in the subdivision (19.4%). The developer purchased a property with significant areas having slopes greater than 25%. The developer determined the location and elevation of the subdivision roads and the configurations of each lot. He now seeks relieve from preexisting conditions of topography the he chose to ignore when designing and constructing the subdivision. The topography of the site is so severe in locations that the 10 -foot change in elevation of the road that developer elected not to make when rock was encountered would not have significantly increased the constructibility of homes on these lots. No relief should be granted when the developer is constrained by circumstances within his control. For example, lots 23 and 30 have small build able areas due to the developer's choice of subdivision layout. The developer is not an innocent victim of overly restrictive zoning conditions who fell into unusual circumstances. The developer created the situation that he finds himself in by his own choices. However, since this development was permitted before the rural viewshed ordinance was adopted and the developer has indicated he is willing to abide by the viewshed requirements, I support variances for lots 3 through 7 with the following conditions: o A 60 -foot viewshed will be applied to lots 1, 2, 3, and 4 and planted with at least two rows of trees including a mix of cedars and magnolias or similar evergreen trees. (In addition to the few trees the developer has already planted). A replanting requirement must be mandated and enforced to benefit the viewshed. o The homes on lots 1 through 7 will be designed with 360 -degree architecture and will be approved by the city architect. o The buildable area of the lot is not to be increased by reducing the front setback. The rear setback will be increased by the same number of feet that the front setback is decreased. This will ensure that the developer is not rewarded for laying out lots that do not support the size homes he desires to construct. A reduction in the front yard without an increased setback from Providence Road will not provide enhanced viewshed protection. The viewshed enhancements are important because the back of these homes will be prominently seen from Providence Road. (See attached photographs.) Lots 1 through 4 were previously open pasture and have no preexisting trees that will screen the back of these houses from view along Providence Road. Lots 4, 5, 6 and 7 are located across from Summit Hill Elementary School. The back of these homes will be viewed by hundreds of residents each day when dropping off and picking up students. Providing an enhanced viewshed will help screen the back of these homes from view. Lot 22 is a corner lot subject to a 60 -foot setback on both streets. Subject to approval of the location of the house and 360 -degree architecture approval by the city architect, setback relieve may be justified for this lot. I am not opposed to variance request to increase the allowed height from: 28 feet to 33 feet on lots 5, 6, 7, 8, 9, 19, 20.
