He continued by stating, "I understand this was a creative use of the rule and probably a loophole, for better terminology." I believe Milton's ordinances provide several check points that can be used to prevent developers from gaming the system and using this potential loophole. 1. The only purpose of the dual frontage created by this flag lot is to avoid compliance with the three acre minimum requirements for lots without frontage on a paved road. Sec. 64-416. - Development standards. (e) Minimum lot area shall be as follows: (1) One acre with frontage on paved road. (2) Three acres with frontage on unpaved road. 2. This one -acre lot is accessed from an unpaved road violating the idea that the "bad" is cured when access is provided from a new paved subdivision road. The "bad" being that an unpaved road can not accommodate as much stuff — traffic, density, police cars, or fire trucks. And if the access from the unpaved road is preferred to access from the paved road due to a perceived safety issue, there is something wrong with the configuration of the lot. The configuration should be fixed. Not another exception created. Sec. 50-71. - Compliance with city procedures and guidelines required (9) For the division of land in the AG-1(Agricultural) zoning district adjacent to or has access to unpaved roads, the following rules shall apply: a. Each proposed lot shall contain a minimum area of three acres. During the August 8, 2016 work session to discuss inconsistent development standards along gravel roads contained in the Subdivision Ordinance and the Zoning Ordinance, the Community Development Director stated, "If the council thinks I should interpret this differently there is room for a written opinion to be developed on this that I could use as the basis for my interpretations in the future". It is therefore apparent that the existing subdivision and zoning ordinances can be harmonized in a way that supports the intent of Council as expressed in the subdivision ordinance. 3. The Director's approval is required when access and frontage are not on the same public street. Sec. 50-114. - Access. (d) Lots may share access as stipulated herein. Lot frontage and access do not necessarily have to be along or front the same public street, if approved by the director. 4. Subdivisions must comply with the Comprehensive Plan that confirms the requirement for minimum 3 -acre lots on gravel roads (page 18 and page 61 of current draft). Sec. 50-115. - Conformance to city comprehensive plan. (a) All proposed subdivisions shall conform to the city comprehensive plan and development policies in effect at the time of submission. S. The Director must approve the configuration of the lot. The Director should not approve the configuration of a lot when the intent of a configuration is to subdivide a tract into a lot that circumvents the intent of Council. Sec. 50-159. - Lots. (a) The size, shape, arrangement, orientation of every lot shall be subject to the director's approval for the type of development and use contemplated. 6. The Director must approve double frontage lots. Approval is limited to two unique conditions. Neither condition is applicable to the Hopewell plat. The second of the two conditions requires the proposed lot suffer from three specific disadvantages. Only when the lot suffers from the three disadvantages is double frontage allowed. It is not the intent of Sec. 50.159 to allow the creation of a double frontage lot for the specific purpose of avoiding area and size requirements. Sec. 50-159. - Lots. (d) Double frontage lots shall be prohibited, except as approved by the director provided that such lots are essential to provide separation of residential development from traffic arteries or to overcome specific disadvantages of topography, orientation, and property size. 7. Council must confirm all plats before building permits can be issued. City Council should not confirm a plat that does not comply with the Zoning and Subdivision Ordinances and the intent of Council. Sec. 50-49. - Residential subdivision building permit issued only after approval and confirmation of minor or final plat. In residential subdivisions, building permits may be issued on the basis of any approved minor plat or final plat only after the approval of the director, and the mayor and city council's confirmation. 8. Approval is not required. The applicant may appeal a denial and the setting of precedent can be avoided. Sec. 50-93. - Final plat. Should the director not approve any subdivision plat, the basis for the denial shall be stated in writing to the applicant. The subdivider may file an appeal in accordance with section 50-231. 9. Plat does not comply with Rural viewshed requirements. Council approved text amendments modifying the rural viewshed requirements at the September 7, 2016 City Council Meeting. The approved amendments created an exemption for minor plats. However, the Hopewell minor plat was acknowledged by the Director, Department of Community Development on July 26, 2016 as being a revision of a previously recorded plat to address comments from Community Development. - 10. Interpretations of the ordinance are precedential. Caution should be exercised. When reviewing a request for variance relief, each case is considered on its merits. Rezoning and variance decisions are not precedential. However, ordinance interpretations are an exception to that rule. Once the director renders an interpretation, unless the ordinance is amended by City Council, it has the force of law and applies in all other similar instances.
