Good afternoon. I want to encourage you to review tonight's renewed rezoning
and variance request from the developer for the Southeast corner of the
Birmingham crossroads through the lens of your constituents, not an outside of
Milton developer. In recent months when a previous version of this rezoning and
variance request was first considered, the City Council unanimously denied the
developer's request. That was the right call then and it is the right call tonight. I
believe that giving developers repeated bites at the apple puts our community at
a critical disadvantage. We don't need to be overrun with development like
Alpharetta and Johns Creek.
I personally devoted a great deal of time assessing and evaluating the previous
rezoning and variance request that you ultimately unanimously denied. However,
your consideration of this renewed variance request by this developer puts our
community at long-term grave risks from being perceived as easily manipulated
by developers. When you and the City Council make a decision on these issues, it
would be a good and wise practice to stand by those decisions and not waffle on
subsequent reapplications for variances on the same property. In this case, it
appears that you and the City Council are being asked to, in effect, do just that at
tonight's meeting.

You have received letters and emails from local citizens such as Tim Becker, Julie
Bailey, and many others, expressing their sincere and valid concerns in a more
precise fashion than I have done in this letter to you. Nonetheless, I join them in
asking you to deny tonight's petition for a variance at the Southeast corner and
any future reapplication for subsequent variances on this property.
On yet a second occasion, the developer has failed to meet the standards by
which these matters should be considered. For me personally, as a nearby
property owner, I believe any growth in the commercial footprint at the
Southeast corner of the Birmingham Crossroads will likely jeopardize the value of
my business property located at the Southwest corner. Yet again, there has been
no traffic impact study performed on this already dangerous Birmingham
Crossroads intersection. Also, as far as I know there has been no study performed
on the adequacy of the sewage processing at the Northeast Corner for serving the
projected intense growth at the Southeast corner.
In conclusion, outside developers will always achieve their objectives reducing the
quality of life in Milton, if you set a precedent tonight by keeping the door open
for reapplications for variance requests. As is often said in life and politics, the
opposing team will always win if they can keep moving the goal posts. Tonight I
ask you to not move the goal post and hold the line against higher density at the
Southeast corner of the Birmingham Crossroads. Again, the health, safety and
quality of life of our community is truly at risk if you permit greater density than
contemplated by years upon years of precedent from the time the Southeast
corner was in Fulton County to recent years when we have been incorporated as
the City of Milton. Denial is the right choice for our community.

to the local government official during the two years immediately preceding the filing of
the application for the rezoning action and the date of each such contribution.
(d) The disclosure required by subsection (c) of this Code section shall be filed at least five
calendar days prior to the first hearing by the local government or any of its agencies on the
rezoning application.
