OF A RESOLUTION OF FULTON COUNTY, 2004Z-043 PROPERTY LOCATED 980 BIRMINGHAM ROAD WITHIN LAND LOT 380, 2ND DISTRICT 2N° SECTION CONSISTING OF APPROXIMATELY 19. 92 ACRES. BE IT ORDAINED by the City Council for the City of Milton, Georgia while in regular session on May 15, 2017 at 6:00 p.m. as follows: SECTION 1. That the condition of a resolution by the Fulton County Board of Commissioners, approved on November 3, 2004, for petition 2004Z-043 that approved a zoning to C-1 (Community Business) and AG-1 (Agricultural) Conditional, property located at 980 Birmingham Road consisting of a total of approximately 19 .92 acres, attached hereto and made a part herein; SECTION 2. That the property shall be developed in compliance with the conditions of approval as attached to this ordinance (ZM 17-02). Any conditions hereby approved (including any site plan) do not authorize the violation of any district regulations; and SECTION 3. That all ordinances or part of ordinances in conflict with the terms of this ordinance are hereby repealed; and SECTION 4. This Ordinance shall become effective upon adoption by the Mayor and City Council and the signature of approval of the Mayor. ORDAINED this 15th day of May, 2017. Approved: Attest: Sudie Gordon, City Clerk I I I RECOMMENDED CONDITIONS Should the Mayor and City Council approve this petition, the recommended conditions (ZM 1 7-02) should be revised to read as follows: 2. To the owner's agreement to abide by the following: a. To the revised site plan received by the Community Development Department on April 10, 2017 (Petitions 2004Z-043 NFC and 2004Z-0116 NFC combined). Said site plan is conceptual only and must meet or exceed the requirements of the Zoning Resolution and these conditions prior to the approval of a Land Disturbance Permit. Unless otherwise noted herein, compliance with all conditions shall be in place prior to the issuance of the first Certificate of Occupancy. 3. To the owner's agreement to the following site development considerations: e. f. Within the "Village Green" in the northeast quadrant, provide a minimum of two benches or two picnic tables which shall be timber form construction or as approved by the Design Review Board. Provide one trash receptacle within the "Village Green" in the northeast quadrant as approved by the Design Review Board. g. There shall be a minimum of eleven trees. The type of trees planted within the area of construction is depicted on the site plan received on April 10, 2017 and within the "Village Green" in the northeast quadrant and shall be approved by the City Arborist h. Provide a "right only" allowed for a new driveway as depicted on Revised Site Plan received by the Community Development Department on April 10, 2017. i. Require a conservation easement for any greenspace (including "Village Green") outside of septic fields in tracts # 1 #2, and #3 as referenced in site plan dated 8/09/04 in RZ2004-043 file and attached to this ordinance.
