Notary Public: (SEAL) My Commission Expires: �l . liyz Z This form is to be filed in the OFFICE OF THE CITY CLERK, City of Milton, 2006 Heritage Walk, Milton, Georgia 30004. www.cityofmiltonga.us Revision Date: 05.2018 November 19, 2018 To: Milton City Council From: Peter Hernandez, President Brookshade Homeowners Association Subject: RZ18-13 / VC18-0713090 Hopewell Road Kai Chiang Su Dynasty' The residents of Brookshade respectfully ask that the City Council deny the zoning change and concurrent variance because higher density development on Hopewell Road would: 1.) create safety and environmental hazards that would not exist if the current zoning remains unchanged, 2.) decrease the value of every home in Brookshade, and 3.) violate the founding principles of the City of Milton and CLUP that were adopted to preserve its rural character.2 a a s Brookshade is located in a peaceful wooded setting in North Fulton County, in the City of Milton. The southeast gateway to Milton is surrounded by single family homes and small communities nestled among tall forests and neighboring horse farms. Brookshade was developed by Chatham Holdings, with homes featuring top quality craftsmanship on lots that average 0.91 acres. With towering canopies of shade trees and a crystal clear brook winding through the property, Brookshade is naturally suited for rural family living. A carefully planned walking trail takes residents on an enjoyable journey throughout the scenic property and provides them with an opportunity to admire the sights and tranquil sounds. Su Dynasty's rezoning request must be denied because it would irreparably damage the Brookshade community's ethos and diminish the aesthetic and financial value to homeowners. When Dr. Su purchased the original land, it was zoned as AG1.Over the decades that the family has lived here, they sold unwanted parcels to developers and created a private oasis where they have enjoyed their forested surroundings. Now Su Dynasty wants the City of Milton to change the zoning so they can sell the remaining parcel to a developer whose primary goal would be to maximize profit by building higher density housing without regard to the adverse impact it would have on their adjacent long- time neighbors. The addition of 73 new households on these 47 acres would require Fulton County to provide access to the existing sewer system. The immediate impact would be to destroy at least one Brookshade resident's property with an unwanted barren easement in perpetuity and create an added burden for the Fulton County Water Treatment Authority. This easement and increased sewage utilization would not occur if the current AG1 designation remains unchanged.6 As noted at the outset, Brookshade homeowners request that the proposed zoning change and variances be denied. Thank you for the opportunity to voice our objections. Brookshade Homeowners Association, Inc. 701 Brookshade Parkway Milton, Georgia 30004 ' Petitioner Kai Chiang Su Dynasty is asking the City of Milton to rezone from AG-1(Agricultural) to R-3A (Single Family) to develop 73 single family lots on 47.1145 acres at a density of 1.55 units per acre and a 2 part concurrent variance to 1) reduce the rural trail from 10 feet to 5.2 feet (Sec 48-674 (1)) and 2) to reduce the stream setback from 25 feet to 0 feet (Sec. 20-426 (2)). 2 This higher density would decrease the value of the 138 homes in the Brookshade community to the homeowners and the city. Conversely, maintaining AG1 zoning would help retain their value and promote the construction of more valuable homes at the southeastern gateway to Milton. 3 The City of Alpharetta has adopted land use polices that maximize the value of residential construction less than one mile south of the Milton city border. Rather than minimize value by increasing zoning density. Milton should accomplish the same goal by maintaining the AGl designation for the Su property. ° As stated succinctly by the Milton Design Review Board October 2, 2018, "We don't see anything viable about this proposal." 5 Community Development Department staff (August 23, 2018): The proposed 73 lot single family subdivision is inconsistent with the City of Milton's Comprehensive Land Use Plan Update 2016 Map for "Agricultural, Equestrian, and Estate Residential" and Plan Policies. In addition, Staff recommends WITHDRAWAL of VC-18-07-Part 1 and DENIAL of VC38-07-Part 2. Therefore, Staff recommends DENIAL of RZ18-13 to rezone from AG-1(Agricultural) to R- 3A (Single Family Residential). 6 In the event the City Council overrides staff recommendation and considers granting the proposed zoning change and/or variances to Su Dynasty, the City of Milton must insist that Fulton County demand a detailed environmental impact statement pursuant to all germane federal, state, and local statutes and regulations.
