Executive Summary: This is change order to the original agreement drafted May 27, 2016 and approved by council in the June 20, 2016 Council Meeting. The change involves the addition of Station 42 (Thompson Road) to the landscape maintenance contract. The original contract included the gateway facilities in the Birmingham and Arnold Mill areas. This left the city with only the small lot occupied by Station 42 not under the contract. Funding and Fiscal Impact: Funding for this project is available in the Grounds Repair and Maintenance budget, and will cost an additional $3,000 annually (the initial Landscape Services contract is $30,000). Alternatives: The city can continue to maintain the equipment and use field personnel to perform those duties. Maintenance and operating costs for this (including staff salary, fuel, landscaping supplies and equipment) make this alternative a little more cost effective, but also less efficient and the work will not be consistent with the other two facilities. Legal Review: Sam VanVolkenburgh – Jarrard & Davis (9/12/2016) Concurrent Review: Steve Krokoff, City Manager Attachment(s): Change Order #1 for Professional Services Agreement 1 CHANGE ORDER #1 FOR PROFESSIONAL SERVICES AGREEMENT Fire Station Landscape Maintenance Services WHEREAS, the City of Milton, Georgia, and Ed Castro Landscape Inc. have entered into a Professional Services Agreement (the “Agreement”) dated May 27, 2016, incorporated herein by reference, for landscape maintenance services; and WHEREAS, the parties desire to issue an addendum pursuant to Section 1.4 of the Agreement, it being to the mutual benefit of all parties to do so, as set forth herein for the reasons and consideration set forth herein. NOW THEREFORE, the parties hereto agree to amend the Agreement as follows: 1. The second full paragraph of the Agreement is amended to read: “WHEREAS, the City of Milton will require certain landscaping services at City of Milton Fire Stations #41, #42 and #43 beginning upon the issuance of a Notice to Proceed by the City (the “Project”); and” 2. Section 1.2 is amended by replacing “$30,000.00” with “$33,000.00” 3. Exhibit A to the Agreement is amended by adding to the existing contents of that exhibit the document attached hereto as Exhibit A. 4. It is agreed by the parties hereto that all of the other terms and conditions of the Agreement, including all unamended portions, shall remain in full force and effect other than as modified herein. Upon execution by all parties, this Change Order shall be attached to and form a part of said Agreement. This Change Order may be executed in multiple original copies, identically worded, and each such executed copy constitutes an original. In the event of any conflict between the terms and conditions of this Change Order and the terms and conditions of the Agreement, this Change Order shall prevail. Executive Summary: An artifact from the World Trade Center was acquired from the Port Authority of New York and New Jersey with the intent for it to be used in a memorial to honor those lost. Until the memorial is ready, the artifact will be displayed at City Hall and kept in the possession of the City at all times. Upon execution of the attached agreement we are wholly responsible for the artifact. It is an honor that the Port Authority of New York and New Jersey gifted the City of Milton with this important piece of American history to ensure we educate our community on the sacrifices our public safety team make every day. Alternatives: None Legal Review: Paul Frickey – Jarrard & Davis September 7, 2016 Attachment(s): World Trade Center Steel Transfer Agreement Monday, October 3, 2017 The Port Authority of New York and New Jersey 4 World Trade Center 150 Greenwich St. New York, NY 10007 The purpose of this letter is to confirm and memorialize the full and complete legal transfer by The Port Authority of New York and New Jersey (the “Port Authority”) to Milton, GA of that certain piece of steel of the former World Trade Center, identified as I-0018g in the Port Authority’s World Trade Center Archive: Artifact Inventory Report of January 31, 2007 (the “Steel”). Milton, GA has requested that the Steel be made available to them, in its present condition. 1. A property interest in the above-described Steel is hereby conveyed, and full and complete legal ownership of the Steel is given. 2. The Port Authority makes no representation or warranty whatsoever as to the condition or fitness of the Steel, either express or implied, and no Commissioner, officer, agent, or employee of the Port Authority is authorized to make any representation or warranty as to the Steel. Milton, GA shall have no claim against the Port Authority for any defect or other condition of the Steel and agrees to accept the Steel “as is.” There are no warranties, express or implied. 3. To the extent permitted by applicable law, Milton, GA agrees to defend, indemnify and hold the Port Authority, its Commissioners, officers, representatives and employees harmless from and against all losses, liabilities, damages, injuries, claims, demands, costs, attorney fees, and other expenses incurred by the Port Authori ty and/or its Commissioners, officers, representatives and employees in any manner resulting from or arising with respect to Milton, GA possession, use or operation of the Steel or the possession, use or operation of the Steel by any person under the control and authority of Milton, GA 4. Milton, GA will be responsible for all costs of the removal and transportation of the Steel to its facility. 5. This agreement may not be assigned by either party without the approval of the other party. 6. This Agreement is subject to all the terms and conditions of either or both of a Court Order dated December 4, 2009 or July 22, 2010, of the United States District Court for the Southern District of New York, both annexed hereto. 7. A RESOLUTION OF THE CITY OF MILTON, GEORGIA EXTENDING UNTIL FEBRUARY 7, 2017, AN EXISTING MORATORIUM BARRING THE ACCEPTANCE OF APPLICATIONS FOR ZONINGS AND DEVELOPMENT PERMIT APPROVALS, INCLUDING APPROVAL OF FINAL PLATS, PURSUANT TO CHAPTER 64 OR CHAPTER 50 OF THE CODE OF THE CITY OF MILTON, GEORGIA FOR PROPERTY ADJACENT TO AN UNPAVED OR GRAVEL ROAD TO INCLUDE THOSE GRAVEL ROADS WITH A PAVED EXTENSION WHEREAS, the Section 1.12(b)(26) of the Charter of the City of Milton, Georgia (“City”) empowers the City to regulate development within the City limits through zoning; and WHEREAS, Chapter 64 of the current Code of the City of Milton, Georgia (“zoning ordinance”) divides property within the city into various districts, and regulates the use and development of property based on the district to which the property is designated; and WHEREAS, Chapter 50 of the current Code of the City of Milton, Georgia (“subdivision ordinance”) provides for various permits and approvals for development of subdivisions in the City; and WHEREAS, Section 64-416 of the zoning ordinance limits the size of lots in the AG-1 zoning district based on the type of road to which the property is adjacent, as follows: “(e) Minimum lot area shall be as follows: (1) One acre with frontage on paved road. (2) Three acres with frontage on unpaved road;” and WHEREAS, Section, 50-71, of the subdivision ordinance, provides as follows: For the division of land in the AG-1 (Agricultural) zoning district adjacent to or has access to unpaved roads, the following rules shall apply: a. Each proposed lot shall contain a minimum area of three acres. b. Each proposed lot shall provide at least 100 feet of road frontage, the minimum dimension of which shall be maintained to the building line of the lot. c. Each proposed lot shall provide at least 200 feet of lot width at the building line; and 2 WHEREAS, the City Council is concerned that these two sections of the code pertaining to AG- 1 lots along paved or gravel roads may be in need of greater clarity to reflect the public policy objectives of the City of Milton; and WHEREAS, to that end, the City Council has directed the Community Development department to consider changes to the zoning ordinance and the subdivision ordinance to ensure that the division of land in AG-1 with frontage along unpaved/gravel roads is undertaken consistent with the policy objectives of the City Council; and WHEREAS, these changes may involve clarifying that if an AG-1 lot has double frontage (i.e., frontage along both a paved road and gravel road), that the subdivision rules involving frontage along a gravel road will control; and WHEREAS, there may be additional changes, to include a more precise definition of ‘paved road,’ a more precise definition of ‘gravel road,’ and changes involving subdivision where the frontage is along a road that is neither paved nor graveled; and WHEREAS, due to recent events in Milton, the Council hereby finds that there is time urgency associated with these possible code changes and that a moratorium is the most legally appropriate way to ensure citizens and property owners are not confused by those local ordinances implicating development of property in the AG-1 zoning district with frontage along gravel/unpaved roads; and WHEREAS, the City Council intends to consider amendments to the zoning ordinance and the subdivision ordinance in due course and as promptly as possible; and WHEREAS, on September 7, 2016, pursuant to Resolution No. 16-09-382 the City Council imposed a 30-day moratorium barring the acceptance of applications for zoning and development permits and approvals, to include acceptance of final plats, pursuant to Chapter 64 or Ch apter 50 of the Code of the City of Milton, Georgia, for properties in the AG-1 zoning district having frontage along a gravel or unpaved road and also for those AG-1 properties having frontage along a gravel road with a paved extension; and WHEREAS, the City finds extension until February 7, 2017, of the existing moratorium barring the acceptance of zoning applications and applications for development permits and approvals, to include acceptance of final plats, pursuant to Chapter 64 or Chapter 50 of the Code of the City of Milton, Georgia, to be reasonably necessary, the least restrictive means available, a reasonable exercise of the City’s police power, and in the best interests of the public health, safety, and welfare; NOW, THEREFORE IT IS HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF MILTON, GEORGIA THAT: 1. The statements and representations set forth in the above preamble are hereby adopted by the City Council as if set forth verbatim. 3 2. The City does hereby extend until February 7, 2017, the existing moratorium barring the acceptance of applications for zoning and development permits and approvals, to include acceptance of final plats, pursuant to Chapter 64 or Chapter 50 of the Code of the City of Milton, Georgia, for properties in the AG-1 zoning district having frontage along a gravel or unpaved road and also for those AG-1 properties having frontage along a gravel road with a paved extension in order to consider amendment of the zoning ordinance and/or the subdivision ordinance as set forth in the preamble. 3. The moratorium imposed by this Resolution shall terminate on the earliest date of (1) February 7, 2017; (2) approval by the City Council of an additional moratorium after a public hearing; (3) any vote by a majority of a quorum of the Council terminating all or a portion of the moratorium, or (4) the adoption of an amendment of the zoning ordinance and/or the subdivision ordinance pertaining to the division of land in the AG-1 zoning district having frontage along a gravel or unpaved road or subdivision of land in the AG-1 zoning district having frontage along a gravel road with a paved extension. 4. The moratorium imposed herein does not limit the ability to submit applications for development plans or approvals for property other than property in the AG-1 zoning district having frontage adjacent to an unpaved/gravel road or AG-1 properties having frontage along a gravel road with a paved extension. 5. The moratorium imposed herein does not limit the ability of any property owner to develop their land in accordance with previously submitted applications or approvals or to develop their property if the right to so develop has lawfully vested. This Resolution shall be effective upon a majority vote by the City Council as ratified by the Mayor of the City of Milton, Georgia. Creation. There is hereby created the Milton Public Art Committee (“MPAC”) to serve as the official citizen’s committee of the City of Milton with respect to public art. The mission of the MPAC shall be “to advocate for, promote, and participate in the selection and interpretation of public artwork and public arts events, to encourage local exploration, generate civic pride, showcase local artists, and increase tourism.” 2. Membership. Membership on the MPAC shall include those voting members appointed to the governing Board of Directors by the Mayor and City Council as described in paragraph 3, below, and any non-voting volunteers appointed by the Board to the MPAC as described in paragraph 6, below. 3. Governance. MPAC governance shall be provided by a seven-member Board of Directors. Each member of the Board of Directors shall be nominated by the Mayor or an individual member of the City Council and approved by the Mayor and City Council. Members of the Board of Directors must maintain their primary residence in the district Page 2 of 3 of the council member nominating them, or within the City limits in the case of the member nominated by the Mayor. Members of the Board of Directors must be at least 21 years of age and have experience with the arts. Members of the MPAC Board of Directors shall undertake their respective duties in a volunteer capacity and shall not be compensated for any time or expenses associated with any assignment or function with respect to the MPAC. 4. Term. Members of the MPAC Board of Directors shall be appointed to terms of two years while they remain eligible and are willing to serve. Upon the natural expiration of their term, members of the Board of Directors shall continue to serve until a replacement is appointed by the Mayor and City Council. Members of the Board of Directors may be appointed to serve an unlimited number of terms. Members of the Board of Directors may be removed by a majority vote of the MPAC Board of Directors based on a finding of (1) malfeasance or misfeasance in carrying out official functions, (2) unwillingness to carry out official functions, (3) unreasonable number of absences from meetings and/or official events, or (4) any other act or omission that would lead a reasonable person to conclude the member is unfit for continued service on the Board of Directors. Conduct of Business. The MPAC Board of Directors shall meet at regular intervals as necessary to perform the tasks and duties associated with MPAC’s mission, including recommending actions to the city staff or Mayor and City Council. The Board of Directors shall elect a chairman, vice-chairman, and secretary by majority vote to assist in the conduct of its business. The Board of Directors may establish and appoint representatives to as many committees and sub-committees as are determined by the Board to be necessary for the accomplishment of MPAC’s mission. The MPAC Board of Directors may adopt bylaws and/or rules of procedure governing the conduct of its meetings; Roberts Rules of Order, latest edition, shall apply in the event that no bylaws or rules cover a particular issue regarding conduct of the Board’s business. 6. Executive Summary: The Federal Emergency Management Agency requires that jurisdictions regularly reassess and update their Hazard Mitigation Plan. Because of the regional nature of disasters, the primary vehicle for the creation and submission of this Plan is at the County level, with local jurisdictions taking an active part in the development process to ensure that it meets the needs of the local community as well as the overall region. The current iteration of the plan has been developed over the past year, with all relevant City departments weighing in on the hazard and needs assessment, and the Emergency Manager working with municipal, county, and state partners to complete the project for submission to FEMA. The Plan has been tentatively approved, and is awaiting final passage of the attached enabling Resolution to take final effect. Funding and Fiscal Impact: There is no cost to this agenda item. However, if the City does not approve it, we will be ineligible for federal grant funding for mitigation and possibly recovery programs if a disaster strikes Milton. On the positive side, upon passage and final submission to FEMA, infrastructure projects and other items addressed in the plan may be eligible for grant funding if the county is part of a Stafford Act declaration during the life of the current plan. COUNTY OF FULTON A RESOLUTION AUTHORIZING THE CITY OF MILTON’S ADOPTION OF THE 2016 FULTON COUNTY MULTI-JURISDICTIONAL HAZARD MITIGATION PLAN PURSUANT TO THE DISASTER MITIGATION ACT OF 2000 WHEREAS, the Federal Disaster Mitigation Act of 2000 (DMA) provides the legal framework for the Federal Emergency Management Agency’s (FEMA) mitigation, planning requirements for state, local, and tribal governments as a condition of mitigation grant assistance; and WHEREAS, the DMA requires that states—as a condition of disaster assistance and with support from local governmental agencies—develop hazard mitigation plans to prepare for and reduce the potential hazards and facilitate cooperation between state and local authorities; and WHEREAS, the Atlanta-Fulton County Emergency Management Agency (“AFCEMA”) serves as the leading coordinating agency for mitigation planning and coordinates with the Hazard Mitigation Planning Committee (“HMPC”); and WHEREAS, AFCEMA through County Code, Chapter 130 (Sections 130.1 to 130.30) is designated as the Emergency Management Agency for Fulton County; and WHEREAS, the purpose of the Fulton County Multi-Jurisdictional Plan is to identify and address certain vulnerabilities that exist prior to and during a disaster in Fulton County; and WHEREAS, through a comprehensive planning process and risk assessment, the plan creates a unified approach through which all Fulton County communities can deal with identified hazards and associated risks and thereby serves as a guide for local governments in their ongoing efforts to reduce community vulnerabilities; and WHEREAS, Fulton County submitted its Multi-Jurisdictional Hazard Mitigation Plan to FEMA and FEMA subsequently determined that the County’s Multi-jurisdictional Mitigation Plan was acceptable in September 2016; and WHEREAS, DMA requires local hazard mitigation plans be formally adopted by the governing body of each of the participating jurisdictions within Fulton County; and WHEREAS, in 2016, AFCEMA made revisions to the hazard mitigation plan (2016 Fulton County Multi-jurisdictional Hazard Mitigation Plan) based upon the hazard mitigation assistance planning guidelines provided by the Federal Emergency Management Agency (FEMA); and WHEREAS, federal regulations require that the 2016 Fulton County Multi-jurisdictional Plan be formally adopted by the City of Milton; and Page 2 of 2 WHEREAS, the City of Milton desires to accept the 2016 Hazard Mitigation Plan as revised by AFCEMA based on the hazard mitigation assistance planning guidelines provided by FEMA for purpose of ensuring mitigation and preparedness from natural hazards; NOW, THEREFORE, BE IT RESOLVED, that the City Council of the City of Milton is directed to forward a copy of this Resolution to the Atlanta-Fulton County Emergency Management Agency, that this Resolution shall be effective upon its adoption, and that all resolutions and parts of resolutions in conflict with this Resolution are hereby repealed to extent of conflict. It was created out of the entire unincorporated northwestern part of northern Fulton County. Milton is named in honor of the former Milton County, which was named after Revolutionary War Hero John Milton. After debate, the Georgia State House and Senate approved a bill creating the City of Milton on March 9, 2006. On March 28, Governor Sonny Perdue signed the bill into law. In July 2006, voters approved a ballot referendum on July 18. On August 4, 2006, Governor Sonny Perdue appointed a five-person commission to serve as the interim government of Milton. Milton adopted the existing County ordinances on December 1, 2006 Milton is boarded by the cities of Roswell and Alpharetta on the south, and the counties of Forsyth on the east and Cherokee on the north and west. Significant Characteristics Milton is a community that is known for small-town life and heritage with its scenic landscapes and peacefulness. Population and Demographics According to the Census Bureau's 2010, the population of Milton is 32,661. Their last Community Assistance Visits (CAV) were completed in late 2009. Loss History and Mitigation Milton does have a system in place to maintain a list of properties that have been flood damaged; however, there are none to date. The floodplain administrator has the ability to make substantial damage estimates if needed. To date no property owners have expressed an interest in the mitigation process. If mitigation actions were sought in Milton it is believed the funding source would primarily be the property owner and insurance. Planning and Regulatory Capabilities Milton does use local ordinance, plans, and programs to support floodplain management. The City’s floodplain management regulations and ordinances meet the minimum requirements set forth by both the Federal Emergency Management Agency (FEMA) and the State of Georgia. Milton reviews all site plans and building plans for flood compliance, provide all inspections in house, maintain records of all developments and buildings, outreach information about flooding is on web site, assistance is provided to residents and professionals about FEMA requirements, and provide additional mapping information. Community Rating System Milton does not currently participate in the CRS program. Joining the CRS program has been considered. At that time, there were no flood policies on buildings in th e flood plain and no flood losses reported. Staff has attended the CRS course at EMI, but would be willing to attend again if offered locally. Natural Hazard Event History Specific to the Municipality Fulton County has a history of natural hazard events as detailed in Chapter 5 of this plan. A summary of historical events is provided in each of the hazard profiles and includes a chronology of events that have affected the County and its municipalities. In addition, the probability or likelihood of the hazard occurring at each particular magnitude above was categorized as:  Highly Likely – A hazard whose potential impact is very probable (100%) within the next year.  Likely – A hazard whose potential impact is probable (10% ‐ 100%) within the next year, or one whose impact has a chance of occurring within the next ten years.  Possible – A hazard whose potential impact is possible (1% ‐ 10%) or has one chance of occurrence in a hundred years.  Unlikely – A hazard whose potential impact is likely to occur less than once in a hundred years (<1%). This category can be compared to the 100‐year flood exposures used in design. This qualitative categorization was performed by HMPC members for each natural hazard identified as a potential threat. A meeting was conducted with the participating jurisdiction to complete the assessment exercise. The Planning Process appendix contains the online survey that was used as the assessment instrument and included descriptions for the levels of measurement. After an assessment was completed for the participating jurisdiction, the respective scores were combined to determine an overall County risk assessment. The individual jurisdiction risk assessments are on the following pages followed by the overall County Risk Assessment Matrix. This assessment also served to assist the City in determining which threats posed the highest or greatest threat. Once this was determined, this assessment was used to guide the development of hazard mitigation actions that were in the best interest of protecting the community from the most likely and/or the most severe hazards facing the jurisdiction.
