Councilmember Mohrig seconded the motion. The motion pass ed (7-0). PUBLIC HEARING ALCOHOL BEVERAGE LICENSE APPLICATION 1. Consideration of the Issuance of an Alcohol Beverage License to The Farm at Pamelot, 2105 Bethany Way , Milton , Ga. 30004 . (Agenda Item No. 19-108) (Bernadett e Harvill, Finan ce Director) Bernadette Harvill, Finance Director You have before you an alcohol beverage license application for a Farm Winery. A Farm Winery per Milton 's code will sell its wine and the wine of any other Georgia Farm Winery for wholesale distribution , retail sales , and consumption on premises. The applicant has worked with staff to understand that any other acti v ities may require certain zoning permissions and application for those activities would have to be approved separately from this license. And , lastl y, thi s license would be approved as conditional pending the appro val by the State of Georgia. Georgia requires a permanent local license to be issued before they will issue their license . We h av e checked with Regular Meeting of the Milton City Council Monday, May 6, 2019 at 6:00 pm Page 5 of 15 legal and the conditional approval is allowed under this circumstance. I will pull up the map so you can see which parcels we are referring to . Please let me know if you have any questions. Councilmember Bentley Is a winery an AG-1 "by right" use? Robyn MacDonald The agricultural district allows for the production, growth , and propagation of fruit and vegetables so wine grapes would be one of those items and that would be permitted to be grown. And, as far as a winery , and you can even sell the products from your property that you grew. So , after that, if you want to have activities related to it , then it would be my opinion that they would need to pursue additional use permits if they went beyond just propagating the grapes and producing the wine on the property. Again , they can go ahead and sell it wholesale but if they want to do anything more then , yes , the y would need to have an additional use permit. Steve Krokoff Doesn 't that include the sale of wines from outside that aren 't propagated on the property but located in the State of Georgia. Robyn MacDonald The sale of wine there then they would need to go ahead and to be able to get the alcohol license to sell or to serve. Bernadette Harvill The farm winery ABL allows for wholesale distribution , retail package and consumption through a small tasting room of their own wine produced on the property or any other Georgia Farm Winery. Robyn MacDonald It is a little conflicting with what we typically allow an AG-1 to be sold because we would really , it only addresses items that are grown and sold there. So , I would recommend that they pursue a use permit that would allow such sales and other activities that might be associated with it. Councilmember Cookerly Isn 't the way that it works is that you can have a certain number of vines , but it is really just a percentage and you mix it with a concentrate like a chardonnay that is shipped in? How many vines are we talking about? How much acreage has to be dedicated to have a winery? Bernadette Harvill The state has some specific requirements including that 40 % of annual production is from agricultural produce grown in the state where the wine is located . It also says that the premises has to have a substantial portion of which is used for agricultural purposes including cultivation of grapes , berries and fruits . So , they are trying to designate that you have a large enough piece ofland that you are producing a large profit from this production. So , Mrs. Jackson has another plot of land in which she does her other business on and this would be for the farm winery. Pamela Jackson, applicant, 2105 Bethany Way, Milton, GA 30004 We have just a little less than an acre that has been already planted about 300 vines. Where the grapes are? About an acre of land has been dedicated to that maybe a little bit more. We have · planted a little less than that, but I have 20 acres. I have plenty of space. And, then we are breaking into olive trees after this becau se Georgia has a great olive tree thing but that is another story. Councilmember Cookerly With this opportunity, are you looking to get a special use permit for some of the other activities or is that needed; like the music at night , just so we are fair across the spectrum . Pamela Jackson I already own the farm and so the winery is part of the farm , but it is a whole different section with the vines and the wine tasting and all of that and the winery where we make the wine, all of that is separate. I have a farm where we would like to be able to do some other activities, but they are not crossed activities. I think what happened is that they got kind of blended together. I need to do the special use permit for any of the other activities yo u were mentioning and that would be on the fam1 side, thi s is the winery side. Councilmember Cookerly I am very familiar with your property because I dri ve by that way. So, when you say the other side, which one .. .I am looking at both plats. Pamela Jackson The map has been done incorrectly, can I correct it? This right here , coming down like this is where the vineyard is and that is my house right there . Then yo u come down and the v ines are planted all back here , well, I don 't quite understand what this is , well that is probably how the tracts were purchased probabl y, okay , so the vines come this way a little bit and down here and all this area is , now that other part, all of this , I own all of thi s going all the way down to here. All of that is mine . I have two entrances on Hope we ll Road and I have three entrances on Bethany Way. The yellow area I own it is just not where the vines are planted , the vines are actually planted over in this area. Mayor Lockwood So, this is actually through the state allows a farm winery , so to speak ? Pamela Jackson I had to get a federal permit too. So, yo u have to have a federal , state, and a city permit. I've gotten the federal permit and now the problem that we were hav ing is that the state requires that you have to have a city licen se before they will issue their permit and the city was requiring that Regular Meeting of the Milton City Council Monday , May 6, 2019 at 6:00 pm Page 7 of 15 you had to have a state license before the city would issue a license so that is where the conflict occurred. So , the state is just waiting for the city license. Mayor Lockwood Just to clarify, Robyn , you made the comment that if it wasn 't a winery , and this were just a regular agricultural use , for the city the rules would be a little different, is that correct? Robyn MacDonald Right , typically , for agricultural uses , let 's use corn as an example, if a farmer grew the corn he could grow it , harvest it , wholesale it , sell it , even have a stand in his entrance and sell the corn to Mr. and Mrs. Smith coming off the road and that is totally a part of what the AG-1 zoning allows for. And , so , I am just comparing this to if you are raising grapes to produce a crop and to produce the wine , that is all allowed in agricultural. As far as having activities and serving the wine and having wine tastings , it would be my opinion that she should go ahead and get an additional use permit for the additional traffic that comes onto the property to come and purchase it as well as the wine tasting . And , then after I looked at the website, I do see that she has other activities going on and I think that is what she is referring to that we could work with her on the other portion of her development. So , she may end up with two different special use permits. Pamela Jackson They are two different things and I think that when we started this it all kind of got mushed together but it is not , it is two separate things that are going on . Mayor Lockwood My question is , typically if it is AG-1, let's use the example of corn, per our ordinances, you would have to produce 100% of the corn that you sell. Robyn MacDonald Correct. Mayor Lockwood We are also talking about the rules for a farm winery and I am not arguing it , I just want to make sure I am clear. You are allowed to grow X number of percent on your property ... Pamela Jackson 40%. Mayor Lockwood And , another percent of like properties or whatnot , other agriculturally grown grapes in Georgia, is that correct? Robyn MacDonald I think that is correct. You can import some additional .... Regular Meeting of the Milton City Council Monday, May 6, 2019 at 6:00 pm Page 8 of 15 Mayor Lockwood I guess what I am asking and again, I just want clarification, will that still fit in our ordinance since our ordinance says AG-1 if you are going to produce something and sell it but it has to be all on the property but does the state; does that supersede ours ? Robyn MacDonald This is our first time having a winery. I think what we were looking at is that if the y did the special agricultural event permit and then that would cover for being able to serve wine. Pamela Jackson Which I am going to apply for; but this is just for the winery side of it , that is for the other events. Bernadette Harvill We brought this forward because the state would not even enter the property to do the walk through or see if it was compatible with their regulations until the city issued a license. So, in order to try to help Mrs. Jackson get the state out there to walk the property , identify a tasting room and consider it, that is the alcohol beverage portion of it. Mayor Lockwood So, even if the city approved it , it doe s not guarantee that the state would. Bernadette Harvill We would be asking for a conditional based on the state's decision and then if the state says no then ours would go to a no and then if they say yes then we would continue every year for a renewal that state license would have to be shown again to prove that it is being approved under the same circumstances each year by the state. Steve Krokoff Mayo r , I have an answer to your specific question. A farm winery may sell its wine and the wine of any other Georgia Farm Winery , licensee or retail in a tasti_ng room or other facility on the premises of the winery for the consumption on the premises and enclosed packages for consumption off the premises. So, it specifically addresses for the wines that are coming from other Georgia Farms. That is our city ordinance. Councilmember Kunz I am all for business adventures and AG-1 because we need to do that , so I do not have a problem with that. I love the idea . I think it is going to be a good thing. But, the question is that everybody is going to have , a concern, is that as you progress , what is the traffic going to be like , what is the business going to look like , what are the number of people you are going to have in your building at any one time. Things like that. What is your intent? Regular Meeting of the Milton City Council Monday, May 6 , 2019 at 6 :00 pm Page 9 of 15 Pamela Jackson As far as the winery goes , I am a private estate and I am staying a private estate. My doors are not going to be open from 9 to 5 where anybody can walk in. We will arrange wine tastings with a master wine maker who will come in and we will do like ten people can sign up for it on a Thursday evening and you have to sign up and that is it. So , I am not going to be open from 9- 5. This is my home. It is where I live. I understand your concern, but it is when we get to the special use permit that I think you need to come out and look at the property . Because if I do have other larger events , that is where the issue is going to be , not with the wine tasting, but that is not a part of this. As far as the winery goes, there will not be any traffic change. Councilmember Kunz So , if we pass this but the second part does not get passed , does it destroy what we pass tonight? Pamela Jackson No , because the winery is still going to exist, and the farm has been operating for 25 years so we still board , train , summer camps, etc. so it is not going to, it is going to disappoint me, but I will still be able to operate the farm . Councilmember Kunz As far as the state, do they issue a license on an annual basis as well? Pamela Jackson My understanding is that the state does but the federal does not. Bernadette Harvill The state asks for financial affidavits , etc. where you are swearing to and have a notarization that you have these revenue thresholds and are producing at certain thresholds and they check that every year as we would with any of our affidavits . And, she will have to produce the state license each year to get the city license again. Pamela Jackson And , I have to be bonded. They put you through a lot. I have a federal bond as well as a state bond. Councilmember Mohrig So , Bernadette , what we are really authorizing tonight would be the issuance of an alcohol license so that as she produces on the winery wine and brings in additional wine from Georgia farms, then she can sell that and do the wine sampling. That is what this first step and issuance is for , correct? Bernadette Harvill That is correct. Regular Meeting of the Milton City Council Monday , May 6, 2019 at 6:00 pm Page 10 of 15 Councilmember Bentley So, on the wine tasting and I think it is a great idea, are there conditions for the tasting as far as how many people or times? Bernadette Harvill As long as it is not causing a public disturbance or nuisance there would not be a need for an additional special event permit. If it were to be a large enough event to have to apply for the same special use permit that anyone else would have to have that approval first and it would fall under a different set of rules than a Farm Winery normal operations which are that you cannot spill out into the right of ways or roads and cause any type of public nuisance or noise elevation than what would normally be done on the property. Steve Krokoff There are specific times. Monday through Saturday from 9:00 am until 12:00 midnight. Sunday from 12:30 pm to 12:00 am the following day. So , it is pretty wide open. Mayor Lockwood So, what I am hearing is that you can grow grapes , produce wine , and have an invitation only type of wine tasting just like anybody , you might invite 10 people over for a dinner party at your house , and you can do that with this permit. If you were to have something big where 100 people were coming , whatever our thresholds are for a special event, then you would have to get a special event permit through the city to do anything that is large. Ken Jarrard I think part of the confusion is that we are thinking land use as opposed to permitting. This is simply a permit, typically alcohol permits are one of those things where you have a number of boxes to check and if they check all the boxes then they get a permit. Land use is totally different and to the extent that this begins to take on the character of a land use that the council is uncomfortable with, obviously we have all sorts of tools to begin to sort ofreign that in or tweak the allowable use. This is a v ery finite box we are working in right now. Motion and Vote: Councilmember Jamison moved to approve Agenda Item No. 19-108 . Councilmember Kunz seconded the motion. Consideration of an Ordinance of the Mayor and Council of the City of Milton, Georgia, to Adopt Amendments to the Fiscal 2019 Budget for Each Fund of the City of Milton, Georgia, Amending the Amounts Shown in Each Budget as Expenditures , Amending the Several Items of Revenue Anticipations , Prohibiting Expenditures to Exceed Appropriations , and Prohibiting Expenditures to Exceed Actual Funding Available. (Agenda Item No. 19-092) (First Pres entation at April 22, 2019 City Co un cil Mee ting) (B ernadett e Harvill, Finan ce Direc tor) Bernadette Harvill, Finance Director Before you tonight are the amendments to the fiscal year 2019 budget as requested by staff. Prior to going over the specific requests , I would like to remind everyone of the some of the policies that the city is required to adhere to. First, the city 's fund balance policy which is a city ordinance requires that we maintain a minimum unassigned fund balance of 25% of the subsequent year 's budgeted revenues in the general fund. Secondly , any excess beyond that 25% may be used for one time expenditures that are non-recurring in nature. As we go through the presentation you will see each non-recurring expenditure clearly marked for ease of tracking back to that excess. The general fund budget summary shows the current budget proposed amendment request by revenue source and the expenditures by department and the total budget where all requests were approved. You will see that if all the amendment requests are approved , the ending fund balance will still leave room to account for FYI 9 prepaids as well as other unforeseen circumstances. After reviewing the original revenue projections which are made with a very conservative approach and taking into account actuals received to date , there has been an overall request to increase revenues by $645,845 . In the taxes category, the most significant request as far as dollar amount is a $250 ,000 increase to the local option sales tax line item. Consumer confidence has resulted in an upswing in LOST collections in the past few years and this increase will account for the increased anticipations for this year. From a percent increase perspective, one of the more significant requests in the category franchise fees related to cell fiber and telecommunications. This $49 ,800 increase is the result of an annual agreement between the city and a third party for the use of the right of way. In the licenses and permits category , increases are to account for updated projections related to alcohol beverage licenses and land disturbance permits that are being requested. And , the intergovernmental category is showing an overall decrease of $58.00 which accounts for funding received from the bullet proof vest partnership program and the decrease of $4 ,500 to the school bus stop arm violation program. This program was suspended due to changes in the law which will impact this year's revenue. It has resumed at this point. In FYI 9 , the police department resumed charging for alarm registrations and you will see a request for $2 ,500 in anticipated revenue from this change . Another significant request comes in the investment category in which the city has taken advantage of beneficial interest rates and cash flow projections to increase investments of currently idle funds. An increase in $200 ,000 is being requested to account for anticipations related to investment income. Contributions and donations are not guaranteed so the city does not set a revenue budget for these line items at the beginning of the year. The increase requested will account for those donations received to date. In the miscellaneous revenue category, there are increases related to the lease agreement on Lackey Road and insurance proceeds received Regular Meeting of the Milton City Council Monda y, May 6, 2019 at 6:00 pm Page 12 of 15 are being requested . Additionally, a reduction in the other miscellaneous revenue line item is being requested. The city has determined that tracking employee wellness expenses will be more transparent in the liability account so the budget for the revenue as well as expenditures has been removed. And lastly in the general fund revenue request, there has been a request to reduce the transfer from the impact fees for administration of $27 ,000. We are proposing retaining the impact fee funding in the impact fee fund for future professional fees related to impact fee administration as opposed to transferring them to the general fund. Now to the general fund expenditures. The general fund amendments are broken down by department. There are a few employee department transfers. When Carter Lucas resigned , Sara Leaders was named Interim Public Works Director and funding from the City Manager's Department is being transferred to the Public Works Department to account for the salary change associated with that position. With the integration of our third party IT contract, staff is requesting two things : (1) to change the name of the Information Technology Department to the Information Services Department and (2) to transfer GIS from Public Works to the newly formed Information Services Department. Additionally , there is a request to transfer costs associated with the Arborist and Stormwater Plan Review from Public Works to Community Development. The city 's new Arborist will no longer have any construction inspection responsibilities deeming the position more fitting for Community Development and moving plan review for stormwater will also keep all the plan review activities within Community Development. The final benefits related request is related to Workers Compensation. Recent claims have increased the city's rates resulting in a request to increase Workers Compensation line items across several departments by a total of $23 ,000 . Additionally , in the Human Resources Department there is a decrease for the employee wellness line item that I mentioned earlier and there is an increase for the recruitment of a Public Works Director including professional fees as well as possible travel reimbursements . In the Community Outreach and Engagement Department there has been a request to increase line items related to expenditures related to the State of the City Event which are covered by a corresponding increase in donations in revenues . Also , there is a request to fund outreach programming for the Equestrian Committee in the amount of $3 ,000 and training through Leadership North Fulton for our Community Outreach Manager in the amount of $1 ,953. In both the municipal court and police department, there is a request to account for higher than anticipated common area expenses related to the Deerfield lease. Each will increase by $6 ,051. The Police Department has increases that are offset by Grant Donations and revenue collections for the bullet proof vests and the new portable fingerprint machines . Fire and Public Works have increases in their maintenance line items for damages covered by insurance proceeds revenue. The Fire Department has also requested $50 ,000 for expenses associated with septic tank repairs and replacement as well as asbestos abatement work at Station 42. Public Works is seeking an additional $30,000 to enhance the curb and gutter clean up to address some of the issues throughout the city. The maintenance of the newly acquired properties through the Greenspace Bond is currently under the Parks and Recreation Department and an increase of $8 ,800 for grounds repair and maintenance and $16 ,000 for contract labor is requested to cover the expenses associated with those properties. Economic Development had authorized in FY 18 a contract with a firm to conduct the Deerfield Market Study . These contract negotiations were actually finalized in FYI 9 , so the funds were taken out of last year to cover the expenses in this fiscal year. The new initiatives are that the Finance Department is requesting $3 ,000 for the addition of a contract management module for our bid management program. This will allow one locatio n for all procurements as well as the resulting contract and any change orders which will enhance Regular Meeting of the Milton City Council Monday , May 6 , 2019 at 6 :00 pm Page 13 of 15 communications and audit trail data with vendors. It will help staff communicate with the vendors and other staff members regarding reminders and contract renewal dates. The Information Services Department is requesting software to allow for data transformation and workflow automation for GIS in the amount of $6 ,300. The Police Department is requesting replacement license plate readers for $7 ,800 . It is also requesting the reclassification of the part-time Records Clerk position to full-time and job share that position with Court. The Police Department is also requesting two unmanned aerial systems to enhance the search and rescue responses for a little under $5 ,000 . They are also requesting $5 ,000 for an upgrade to the investigative cellular analytics software. The Fire Department is requesting $8 ,595 for seven new tablets with upgraded features. It is also requesting a part-time inspector to handle annual inspections with a cost of approximately $37 ,000 annually for the next four years which is about 25 hours of work per week . The last initiative request is to transition the current Assistant Fire Marshal to the position of Fire Marshal. In the Capital Projects Fund we have had some donations for traffic calming. Tree recompense funds have also come in . Lastly , there is a decrease in the landfill use fees . Insurance proceeds will be used to replace a damaged vehicle. In the expenditure requests , the Information Services Department is requesting an increase of $25 ,000 for licensing agreements as well as $39 ,000 for infrastructure improvements. There is a request for an additional fuel management system. There is also a request for funds to improve the payment management system. We had lower than anticipated impact fees so additional funds are needed for infrastructure improvement projects. There is a request for $120 ,000 for Parks and Trails expansion. Lastly , the cost of the new Community Development software was higher than anticipated so there is a request for additional funds. There are increases in property taxes in the Greenspace Bond Fund , however, we were able to receive higher than anticipated returns on investments. The interest income in the TSPLOST fund is also coming in higher than anticipated. The new initiatives include the lightning detection system for the city pool. There is a request for $250,000 for the former Milton Country Club facilities improvements. Our construction projects are on schedule: Crabapp le at Green, Freemanville at Providence , and Birmingham at Batesville Road. Our upcoming projects are the Birmingham Road West Culvert replacement with a detour planned to begin on May 24 . The Charlotte extension project sho uld begin at the end of this month. We are starting to begin the design of the Freemanvill e at Birmingham project. The Hopewell corridor three intersections that are TSPLOST funded are moving alon g and we plan to start the right of way phase this summer. Bob Edgar, Fire Chief Our crews have been working a house fire si nce abo ut 2:30 this afternoon and they are still on the scene working. Everyone is okay. Thank you for the MDA proclamation. The $818 ,000 does not include the $75 ,757 we have already collected this year with one more day of collection this Friday. Fire hydrant maintenance will begin at the end of the week. All of our firefighters went through an annual physical test and everyone passed. We are working with Roswell for co ll aborative assistance similar to the agreement we have with Alph aretta. Jim Cregge, Parks and Recreation We are working on a co ll aborative project through the YMCA with the cities of Roswell , A lph aretta, and Johns Creek . On Saturd ay , July 27 th we wi ll be hosting a Special Needs Expo in which all organizations and agencies or any entity that is involved with the service and support of families with special needs members are invited to attend. It wi ll be held at the Alpharetta Community Center. The c it y pool is full y resurfaced and ready for our Memorial Day opening. The lacrosse wall project is moving forward. The parks and recreation board is working on an overall reassessment of how the lacrosse program is managed in the city. The board is also working on an agreement with the North At lant a Football League for a partnership with the city. We had the opening ceremonies of the Golden Game s for our fourth consecutive year.
