The Regular Meeting of the Mayor and Council of the City of Milton was held on May 20,
2019 at 6:00 PM, Mayor Joe Lockwood presiding.

Mayor Joe Lockwood called the meeting to order.

Motion and Vote: Councilmember Mohrig moved to approve the First Presentation Item .
Councilmember Longoria seconded the motion. The motion passed (6-0). Councilmember

PUBLIC HEARING
ALCOHOL BEVERAGE LICENSE APPLICATION
1. Consideration of the Issuance of an Alcohol Beverage License to Matildas , 850 Hickory
Flat Road , Milton , Georgia 30004.

This evening we have a bring your own beverage application from Matildas. The contact
person is Mary Potter. They are doing business as Matildas. This is for any place of business
that is open to the public and allows them to bring their own beer or wine, so it is excluding
distilled spirits. They have met all the requirements of the law and we are recommending
approval.
Councilmember Longoria
Help me understand because I get the idea that the license is for Matildas to not serve alcohol
but to allow their patrons to bring beer or wine. Does the license imply some kind of
enforcement qualification to Matildas? In other words , do they have to ensure that people are
only bringing beer and wine if they are bringing alcohol on the premises ?

There is a requirement that the owner and all the managers apply for a pouring permit. The
pouring permit has stipulations and regulations ensuring that the people running the
establishment are keeping a look out that no one is overly intoxicated . They can charge a
corking fee and they can cork but they have not told us they are going to do so . But, they are
not to serve or open, but they are supposed to be keeping a watchful eye that no one is past the
intoxication level of being able to drive.
Mayor Lockwood
So , also they are allowed up until 9:00 pm to carry alcohol onto the property?
Bernadette Harvill
That is correct. So , anyone entering after 9:00 pm would not be able to bring in their cooler or
their drink.

Councilmember Jamison
An open container law was mentioned by the speaker. We have that for Crabapple but not for
Birmingham, correct?
Bernadette Harvill
We actually have it for Birmingham. There is a Deerfield , Birmingham and a Crabapple open
container district. The open container district includes the Mixed Use C-1 , T-4 , T-4 Restricted ,
T-5 , T-6 and adjacent CX Transect Zones so, it has some limitations. 7 Acre Bar and Grill
would be included in there and they could bring their beer or wine from there. At this time,
distilled spirits would be excluded unless the map was changed.
Councilmember Longoria
So, the ability to walk around with your beverage once yo u 've opened it is not part of this
property?
Bernadette Harvill
A portion of the property is C-1. So , now with bring yo ur own beverage you can take yo ur
beer or wine from the open container and that would be your beverage and you could bring it
in ; you just cannot bring distilled spirits at this time. The other open container districts you can
bring your margarita, your drink, and yo u can bring it throughout the zones; this would be a
cutoff for hard liquor.
Councilmember Longoria
So , they don 't have a license today.
Bernadette Harvill
They have a temporary license. For all of our businesses , we have a provision for them to get
all their ducks in a row.
Councilmember Longoria
So , they have already had two events there. Have we had any issues with alcohol at one of the
events?
City Manager Krokoff
Not that I am aware of.
Councilmember Mohrig
So , can the y have any kind of container? They can't take glass or whatever, correct?
Bernadette Harvill
The open container district has container rules; plastic or paper. Bring your own beverage does
not so they could have a cooler with a couple of bottles , only wine or beer, and they would
have to discard them appropriately.

Councilmember Mohrig seconded the motion. The motion passed (5-0). Councilmember
Bentley recused herself from the vote. Councilmember Kunz was absent from the meeting.

1. Consideration of a Resolution Requesting Sales Tax Information from the Georgia
Department of Revenue Pursuant to O.C.G.A. § 48-2-15(d.1) and Naming a Designated
Officer for all Related Purposes.

This is a resolution that the Department of Revenue requires to get a list of the businesses that
pay sales tax within our jurisdiction. This is something that we can use to compare with our
business licenses database, so we can see if there is anyone who has a business license and the
sales tax is not being appropriated properly. Or, they may be paying sales tax but do not have an
occupational tax certificate. The one thing we cannot do with this list is use it to go after
businesses that are on their list but not on ours. We have to notify the Department of Revenue
and then they can contact the businesses. This is a way for us to check the information to ensure
we have the appropriate businesses operating properly in the city. We have to appoint a person
at the city as the contact person and we have appointed Bernadette Harvill our Finance Director.
Motion and Vote: Councilmember Longoria moved to approve Agenda Item No. 19-115.
Councilmember Bentley seconded the motion. The motion passed (6-0). Councilmember Kunz
was absent from the meeting .

STAFF REPORTS
Department Updates

Courtney Spriggs, Community Outreach Manager
I was ab le to take an Advanced Public Engagement class and I am looking forward to
implementing what I learned. I completed the Leadership No rth Fulton class and we assisted North
Fulton Charities on how to make their thrift shop perform better. We had the Mayor 's Run and a
total of $12 ,767 was raised and after expenses , $7,500 was donated to the families with children
who are suffering from cancer. We had a Community Egg Hunt and it was a joy to partner with
Stonecreek Church and Cambridge High Schoo l. We had about 250 vo lun teers and 3,000
attendees. Rock for Rescues was April 27 th and about 10 ,000 people attended. We have made a
great community connection with Atlanta Wi ldli fe and Rescue. They are one of the only places
that rescue and rehabilitate wild life. Sid Verma has been our intern for the past couple of months.
He did a fantastic job and we wi ll miss him. We have participated in some Better Together
vo lunteer opportunities. We helped with Creative Enterprise which is a special needs day program
based in Forsyth County but assists individuals all over the region . We hosted the Crabapple
Crossing field trip and everyone h ad a wonderful time learning about government and how it
works. Our third Citizens Government Academy graduated a few weeks ago. Lastly, our
Equestrian Committee hosted a Birmingham Park clean up day and this weekend they hosted a
"meet the neighbors" event with several vendors participating . Our firefighters demonstrated the
T-Layer rescue eq uipment, and everyone was very impressed . We have the Memorial Day
ceremony coming up and our Independence Day walkin g parade occurring shortly after that.

Currently, we are finalizing the draft master plan of the former Milton Country Club and we hope
to present this to you during the July work session. We have sent out a survey regarding the
planning of the clubhouse and we will receive those results soon. We have one item that wi ll be
presented at our Board of Zoning m eeting regarding a Haygood Road property and it has created
a lot of community int erest. We have not received any requests for rezonings or use permits. We
have completed the first round of stakeholder meetings for the Tree Canopy Ordinance and we
hop e to present the draft to you during the July work session.

Rich Austin, Police Chief
We are currently down 3% in accidents since this same time last year. We are down 9% in crime
from where we were last year. Last week , we had several police week activities. We had "coffee
with a cop" at Laurel and May , we conducted a shredding event and filled up an entire truck, there
was an opioid crisis seminar held at Stonecreek Church, our blood drive yielded 29 units of blood ,
and we ended the week with a Police Officer Memorial Service commemorating the s ix officers
who lost their lives last year in Georgia as well as 163 officers killed in the line of duty nationwide.
We held an awards ceremony where we celebrated the accomplishments of our police department
during the past year.
