There was no public comment – A motion to close public comment was made by
Curtis Mills and seconded by Cary Schlenke and passed unanimously by 5-0
5. Approval of Minutes – April 28, 2009 Meeting
A motion was made by Joe Creamer and seconded by Cary Schlenke and
passed unanimously 5-0. George Ragsdale made a request that a copy of the
audio file of the April 28, 2009 meeting to be made for his review.
6. U09-02/VC09-02 – To obtain a use permit for a landscaping business on 3.926
acres at a density of 387.93 square feet per acre (Article 19.4.27). Applicant is
also requesting a 3 part-concurrent variance: 1) to allow access to Taylor Road, a
local street. 2) to allow the existing structures, gravel drive and septic system to
encroach into the 50-foot undisturbed buffer and 10-foot improvement setback
along the south property line as shown on the site plan (Article 12H.3.1.C.1 and 3)
to allow the existing structures along the south property line as shown on the site
plan to remain within the 50-foot setback adjoining the AG-1 District (Article
19.4.27.). Staff recommendation is for Deferral until June 23, 2009.
A motion was made by Joe Creamer to approve Staff’s recommendation to defer
the request to allow a revised survey/site plan to be submitted. The item will be
heard at the June 23, 2009 Planning Commission meeting. It was seconded by
Jennifer Fletcher and the motion passed unanimously 5-0.
7. RZ09-02 – Text Amendment to Article 22.3.1 Appeals, Variance Considerations of
the City of Milton Zoning Ordinance.
Staff recommendation is for Approval.

A motion was made by Cary Schlenke to approve the text amendment as
recommended with the exception of deleting the word “maximum”. It was
seconded by Jennifer Fletcher and passed unanimously 5-0.
8. RZ09-03 – Text Amendment to Article 33, Signs Section 11 Variance Considerations
of the City of Milton Zoning Ordinance.
Staff recommendation is for Approval.
A motion was made by Curtis Mills to approve the text amendment as
recommended with the exception of deleting the word “maximum”. It was
seconded by Joe Creamer and passed unanimously 5-0.
9. Further discussion of Landscape Businesses and Agricultural Uses.
A motion was made by Joe Creamer to defer this item to a special called
meeting on Tuesday June 9, 2009 at 5:30 p.m. It was seconded by Curtis Mills and
passed unanimously 5-0.
10. Adjourn
A motion was made by Cary Schlenke to adjourn the meeting and seconded by
Joe Creamer and passed unanimously 5-0. Time of adjournment was 7:47 p.m.
