Pledge of Allegiance 2. Call to Order- The meeting was called to order at 7:07 p.m. Members Present: Paul Moore Joe Creamer - Departed at 10:32 p.m. Fred Edwards Jennifer Fletcher Chris Doty Curtis Mills - Arrived at 7:13 p.m. Members Absent: George Ragsdale 3. Public Comment -There was no one to make public comment. A motion was made by Joe Creamer and seconded by Fred Edwards to close public comment. The motion passed 5-0. 4. Approval of Action Minutes -April 26, 2011 Planning Commission Meeting A motion was made by Fred Edwards and seconded by Joe Creamer to approve the minutes as presented by Staff. The motion passed 5-0. 5. New Business- 1) RZ11-13/VC11-02 - 14355 Providence Road and Haystack Lane by Segars and Snidow, LLC to rezone from C-1 (Community Business) and AG-1 (Agricultural) to 0-1 (Office -Institutional) and AG-1 (Agricultural) to expand an existing building and two existing buildings for a total of 5,740 square feet with the following four -part concurrent variance: 1) Sect.64-730(c) (1) To reduce the 40 foot side yard setback to 10 feet along the east property line; 2) Sect. 64-1433(e) To allow off-street parking within the side corner yard along the east property line; 3) Sect. 64-1141(3) a. To reduce the 50 foot buffer and 10 foot improvement setback along the west property line to 20 feet; 4) Section 64-1 141 (3) a. To reduce the 50 foot buffer and 10 foot improvement setback along the north property line to 0 feet. Staff presented the proposed rezoning and four-part concurrent variance with their recommendations. The applicant presented their comments and issues 1 City of Milton Deerfield Professional Centre 13000 Deerfield Parkway Building 100, Suite 107 C Milton, GA 30004 concerning the subject site. The applicant's representative presented the following proposed changes to the Recommended Conditions: • Condition 1.a. to insert "other than church or cemetery use after "0-1 (Office - Institutional) zoning district" • Condition l .b. to include "common area/30' detention access easement after "Haystack Lane". • Condition 3.e. to include "as shown" at the end of the sentence. • Condition 4.a. to replace the word "if" with the word "as "in the last line. A motion was made by Joe Creamer and seconded by Fred Edwards to close the public hearing. The motion passed 6-0. The Planning Commission deliberated on the proposed rezoning and proposed an additional condition that reads as follows: Condition 3.g. - If subject property is to be sold, a 50 foot undisturbed buffer along the north property line shall be required. A motion was made by Fred Edwards and seconded by Curtis Mills to approve RZ 11-13 and VC 11-02, Parts I through 4 as recommended by Staff to include the requested changes made by the applicant and to include the proposed Condition 3.g. The motion passed 6-0. 2) RZ11-14/VC11-03 - 14375 Providence Road by Segars and Snidow, LLC to rezone from C-1 (Community Business) and AG-1 (Agricultural) to C-1 (Community Business) and 0-1 (Office -Institutional) for an existing building and proposed building for a total of 4,585 square feet with the following four-part concurrent variance: 1) Sect 64-1 141(3) a. To reduce the 50 foot buffer and 10 foot improvement setback along the west property line labeled point 18 and 19 to 0 feet; 2) Sect 64-1 141(3) a. To reduce the 50 foot buffer and 10 foot improvement setback to a 20 foot undisturbed buffer and 10 foot improvement setback along the north property line. 3) Sect 64-1 141(3) a. To reduce the 50 foot buffer and 10 foot improvement setback to a 20 foot undisturbed buffer and 0 foot improvement setback along the east property lines. 4) Sect 64-1410 To reduce the required parking from 20 spaces to 15 spaces. STAFF NOTES THAT THIS ITEM WILL BE DEFERRED UNTIL THE JUNE 281h PC MEETING A motion was made by Fred Edwards and seconded by Joe Creamer to defer RZ 11-14 and VC 11-03 to the June 28, 2011 Planning Commission meeting. The motion passed 6-0. 3) RZ11-11 - Text Amendment to the Zoning Ordinance to amend definitions in Section 64-1 2 City of Milton Deerfield Professional Centre 13000 Deerfield Parkway Building 100, Suite 107 C Milton, GA 30004 After the presentation by Staff of the proposed amendments to Section 64-1, the Planning Commission deliberated and made additional changes on the following pages; page 7 and asked Staff to provide a new definition for "commercial equipment" and to delete the last paragraph in the "commercial vehicle" definition, pages 11, 17, 18,19, 22, 24, 27-29, and 36. A motion was made by Joe Creamer and seconded by Fred Edwards to approve the amendments to Section 64-1 as recommended by Staff with the additional changes made by the Planning Commission. The motion passed 6-0. 4) RZ11-12 - Text Amendment to the Zoning Ordinance to amend Roadside vending in Section 64-1607 A motion was made by Joe Creamer and seconded by Curtis Mills to approve the proposed changes to Section 64-1607 as recommended by Staff. The motion passed 6-0. 6. Old Business- 1) RZII-06 - Text Amendment to the Zoning Ordinance to create the "Film and Movie Media Productions Administrative Permit" (Sec. 64-1616) A motion was made by Joe Creamer and seconded by Jennifer Fletcher to approve Section 64-1616 as recommended by Staff and minor changes discussed by the Planning Commission. The motion passed 6-0. 2) RZ11-07 - Text Amendment to the Zoning Ordinance to revise the "Use Regulations" for the C-1 (Community Business) District (Sec 64-775) A motion was made by Fred Edwards and seconded by Curtis Mills to approve Section 64-775 as recommended by Staff. The motion passed 6-0. 3) RZ11-08 - Text Amendment to the Zoning Ordinance to revise the "Use Regulations" for the C-2 (Community Business) District (Sec 64-798) A motion was made by Joe Creamer and seconded by Fred Edwards to approve Section 64-798 as recommended by Staff with recommended changes. The motion passed 6-0. 4) RZI 1-09 - Text Amendment to the Zoning Ordinance to create "Prohibited Uses in All Districts" (Sec 64-395) A motion was made by Fred Edwards and seconded by Joe Creamer to approve Section 64-395 as recommended by Staff with recommended changes. The motion passed 6-0. 5) RZ11-10 - Text Amendment to the Zoning Ordinance to create "Separation Standards for High Traffic Uses" (Sec 64-218) City of Milton Deerfield Professional Centre 13000 Deerfield Parkway Building 100, Suite 107 C Milton, GA 30004 A motion was made by Curtis Mills and seconded by Jennifer Fletcher to approve Section 64-218 as recommended by Staff. The motion passed 5-1 (Mr. Creamer voted to deny the motion.). 6) Update by Staff regarding on -going projects. 1) Discussion and review of Purpose for Code Enforcement Matrix. The Planning Commission discussed that since Chairperson Ragsdale was heading up the project and was not in attendance, the item should be deferred to the June 28, 2011 Planning Commission. 2) Director Tully reviewed the progress of the City's Strategic Plan. 7. Adjourn - A motion was made by Fred Edwards and seconded by Jennifer Fletcher to adjourn the meeting. The motion passed 5-0.
