PLANNING COMMISSION ACTION MINUTES
Tuesday, July 26, 2011
7:00 pm
1. Pledge of Allegiance
2. Call to Order - The meeting was called to order at 7:04 p.m.

3. Public Comment - There was no public comment.
A motion was made by Fred Edwards and seconded by Paul Moore to close public
comment. The motion passed 5-0.
4. Approval of Action Minutes - May 24, 2011 Planning Commission Meeting
A motion was made by Joe Creamer and seconded by Paul Moore to approve the
minutes as presented by Staff. The motion passed 4-0-1 with Chairperson Ragsdale
abstaining based on the fact that he was not at the May 24, 2011 meeting.
5. Rezonings and Use Permit Applications
1) RZ71-14/VC11-03 - 14375 Providence Road by Segars and Snidow, LLC to rezone
from C-1 (Community Business) and AG-1 (Agricultural) to C-1 (Community
Business) and AG-1 (Agricultural) for an existing building for a total of 3,085 square
feet with the following three-part concurrent variance:
1) Sect 64-1 141(3) a. To reduce the 50 foot buffer and 10 foot improvement
setback along the west property line labeled point 18 and 19 to 0 feet;
2) Sect 64-1 141 (3) a. To reduce the 50 foot buffer and 10 foot improvement
setback to a 20 foot undisturbed buffer and 10 foot improvement setback along
the north property line.
3) Sect 64-1 141(3) a. To reduce the 50 foot buffer and 10 foot improvement
setback to a 20 foot undisturbed buffer and 0 foot improvement setback along
the east property lines.
This item was deferred at the May 24, 2011 Planning Commission Meeting to allow
the applicant to revise the request and site plan. It was also deferred from the
June 28, 2011 meeting because of the Planning Commission not having a quorum.
The Planning Commission thoroughly deliberated on the request.

George Ragsdale made the following motion: To approve RZ11-14/VC11-03, Parts
1-3 as recommended by Staff with the following additions;
1) To include gas stations, convenience stores, restaurants and service stations in
the list of exclusions in Condition 1.a. and the other standard exclusions for C-1
(Community Business) requests.
2) For condition 3.i. to read "To provide a berm and additional vegetation along
the west property line adjacent to Pleasant Hollow Farms subdivision provided that
the berm can be constructed without disturbing existing vegetation and that prior
to the change in the use of the property, a public hearing would occur to include
consideration of parking. If the change in use requirements can't be met, the
petition should be denied".
The motion was seconded by Paul Moore. There was further discussion and the
Commission voted 0 -5 to approve and the motion failed.
The following new motion was made by George Ragsdale: To approve RZ11-
14/VC11-03, Parts 1-3 as recommended by Staff with the following additions;
1) To include gas stations, convenience stores, restaurants and service stations in
the list of exclusions in Condition La. and the other standard exclusions for C-1
(Community Business) requests.
2) Condition V. to read as follows: "To provide a 50 foot undisturbed buffer and 10
foot improvement setback along the west property line with a berm and
additional vegetation provided that the berm can be constructed without
disturbing existing vegetation and a 50 foot undisturbed buffer and 10 foot
improvement setback along the north property lines within the AG-1 (Agricultural)
district as depicted on the revised site plan submitted on June 20, 2011."
3) Condition 3.i. to read as follows: "In the event that the current use of the
property is changed, the City would be given the opportunity to consider
additional conditions of a changed use."
The motion was seconded by Joe Creamer and was approved 5-0.
6. Text Amendments to the Zoning Ordinance
1) RZ11-15 - Text Amendment to Chapter 64, Article VII, Division 5 (State Route 9
Overlay District) as it pertains to Public Amenity Areas (Section 64-1089).
The Planning Commission deliberated on the proposed edits to Public Amenity
Areas.
A motion was made by Paul Moore: To approve RZ11-15, to amend Section 64-
1049, Outdoor Amenity Areas to include changes as discussed by the Planning
Commission and the Staff.

The motion was seconded by Curtis Mills and was approved 5-0.
7. Update/discussion of on -going Community Development projects.
1) Purpose for Code Enforcement Matrix - Chairperson Ragsdale
The Planning Commission recommended that the submitted "Purpose for Code
Enforcement Matrix" be forwarded to the City Attorney for his review.
2) Staff update on on -going Community Development projects
The Staff and the Planning Commission reviewed the various projects and
proposed that a work session be scheduled to discuss the text amendments to the
sign ordinance on August 10, 2011 at 6:00 pm.
8. Adjourn
A motion was made by Fred Edwards and seconded by Paul Moore to adjourn the
meeting. The motion passed unanimously 5-0. Time of adjournment was 10:50 p.m.
