PLANNING COMMISSION ACTION MINUTES

2. Call to Order The meeting was called to order at 7:05 p.m.

3. Public Comment -There was no public comment.
A motion was made by Joe Creamer and seconded by Paul Moore to close
Public Comment. The motion passed unanimously 6-0.
4. Approval of Action Minutes
1) March 27, 2012 Planning Commission Meeting
A motion was made by Fred Edwards and seconded by Joe Creamer to approve
the minutes as presented by sta" with the correction of the second by Paul Moore
be replaced by Fred Edwards for RZJ2-03, Historic Preservation Commission Text
Amendment. The motion passed unanimously 6-0.
2) April 10, 2012 Special Called Planning Commission Meeting
A motion was made by Gariel Burchett and seconded by Joe Creamer to approve
the minutes as presented by Sta". The motion passed unanimously 6-0.
3) April 24, 2012 Planning Commission Meeting
A motion was made by Paul Moore and seconded by Joe Creamer to approve
the minutes as presented by Sta". The motion passed unanimously 6-0.
5. New Business
1) RZ12-07jVC12-04 -Redd Road (north side) with a frontage of 1,083.97 feet
by Redd Road Properties, LLC
THE APPLICANT HAS REQUESTED A DEFERRAL UNTIL THE JUNE 26. 2012

To rezone from AG-l (Agricultural) to CUP (Community Unit Plan) to
develop an 18 unit single family subdivision and a four part concurrent
variance to reduce the 50 foot setback for a new street to 10 feet along
the east and west property lines (Section 64-2397); To delete the curb &
gutter & sidewalks for all roads within the subdivision. (Section 64-2393)
A motion was made by Paul Moore and seconded by Gariel BurcheH to
defer RIJ2-07/VCJ2-04 to the June 26, 20J2 Planning Commission Meeting
as requested by the applicant. The motion passed unanimously 7-0.
2) RI12-05/VC12-02 -633 North Main Street by Jenmark Company
To rezone from MIX (Mixed Use) to C-1 (Community Business) to expand a
6,000 square foot retail building by 6,000 square feet to utilize the basement
for a total of 12,000 square feet. The applicant is also requesting a
concurrent variance to delete the 10 foot landscape strip along the south
and east property lines of the out-parcel (Sec 64-1 090(b)}.
A motion was made by Paul Moore and seconded by Fred Edwards to
close the public hearing. The motion passed unanimously 7-0.
A motion was made by Joe Creamer and seconded by Gariel BurcheH to
approve RIJ2-05 and VCJ2-02 as recommended by Staff with the applicant
submiHing the appropriate signatures for the application. The motion
passed unanimously 7-0.
3) RI12-06/VC12-03 -Deerfield Parkway by Crescent Resources, LLC
To rezone from C-1 (Community Business) and 0-1 (Office-Institutional) to A
(Medium Density Apartments) to develop a total of 256 residential units at
an overall density of 12 units per acre. The applicant is also requesting the
following concurrent variance: To encroach into the 25 foot non
impervious setback by no more than 5, 000 square feet (Section 20-426(2)}.
A motion was made by Paul Moore and seconded by Fred Edwards to
close the public hearing. The motion passed unanimously 7-0.
A motion was made by Joe Creamer and seconded by Chris Doty to
approve RIJ2-06 with the additional 3 conditions; J) To design the buildings
substantially the same as depicted in the presented drawings; 2) Tree save
areas should be considered as often as possible in regards to specimen
trees; 3) To incorporate the trail plan materials and to withdraw VCJ2-02 as
recommended by staff. The motion passed unanimously 7-0.

4) RZ12-08 -To delete Article VII, Division Crabapple Crossroads of the
Northwest Fulton Overlay and concurrently adopt a new Article XIX,
Crabapple Form Based Code.
A motion was made by Paul Moore and seconded by Chris Doty to
approve RZ12-08, Draft V4 with the edits in red and including additional
changes noted by Staff. The motion passed 4-3 with George Ragsdale,
Gariel Burchett and Joe Creamer voting in opposition to the motion.
5) Adjourn
A motion was made by Fred Edwards and seconded by Paul Moore to adjourn the
meeting. The motion passed unanimously 7-0. Time of adjournment was 9:19 p.m.
