PLANNING COMMISSION ACTION MINUTES
City Council Chambers

1 . Pledge of Allegiance
2. Call to Order -The meeHng was called to order at 7:00 pm.
All members were present.
3. Public Comment -There was no public comment. A motion was made by Paul
Moore and seconded by Joe Creamer to close the public hearing. The moHon
passed unanimously 7-0.
4. Approval of Action Minutes
1} November 27,2012 Planning Commission Meeting -A motion was made by
Fred Edwarc;ls and seconded by Fred Edwards and seconded py Paul
Moore to approve the minutes as presented by Staff. The motion passed
unanimously 7-0.
5. Rezoning and Use Permits
Staff has requested that RZ 12-17 /U 12-02/VC 12-08 to be moved up to the first
Rezoning Item to be sounded. A motion was made by Joe Creamer and
seconded by Paul Moore to move RZ12-17/U 12-02/VC12-08 to the first item to be
heard. The motion passed unanimously 7 -0 to amend the agenda as requested
by Staff.
1J THE FOLLOWING ITEM HAS BEEN ADMINISTRATIVELY DEFERRED TO THE
JANUARY 22, 2013 PLANNING COMMISSION MEETING.
U12-01/VC12-07 -14325 Hopewell Road by Dean Riopelle for a Use Permit
for Exotic Animals to operate a Primate and Exotic Animal Preserve on
approximately 20.74 acres. A 2 part concurrent variance, 1} Not to plant to
buffer standards for a width of 75 feet along the east property (Sec. 64
1141 (3){b)). 2) To allow parking between the building and the right-of-way
(Sec 64-1145(6J(c)}.
No Action Taken
2) THE APPLICANT AND STAFF ARE REQEUSTING DEFERRAL TO THE JANUARY 22,
2013 PLANNING COMMISSION MEETING DUE TO A NEED FOR AN ALTERNATE
ZONING DISTRICT. A PUBLIC HEARING WILL OCCUR, BUT A STAFF
RECOMMENDATION WILL NOT BE PROVIDED.

RZ12-17/U12-02/VC12-08 -Northeast Corner of Bethany Bend and
Cogburn Road by Arrowhead Real Estate Partners to rezone from AG-1
[Agricultural} to TR (Townhouse Residential) and request a Use Permit (Sec
64-1825) to develop a 95 unit assisted living facility and 19 single family
detached residences on approximately 9.09 acres. A 4 part concurrent
variance, 1) To increase the height to 40 feet from average grade to
bottom of the roof eave and 2 stories to 3 stories (Sec 64-1095[m)). 2} To
reduce front periphery setback from 40 feet to 20 feet along Bethany Bend
adjacent to the single family lots [Sec 64-669 (h) (1)).3) To reduce the
minimum side yard setback for single family lots from 7 feet to 5 feet (Sec
64-669(i) (2)(a)). 4) To reduce the minimum rear setback for the single family
lots from 25 feet to 20 feet [Sec 64-669[i){3)).
A Public Hearing was held and there were three people who spoke in
opposition to the request. The applicant requested a deferral to the
January 22, 2013 Planning Commission to amend the application that is
consistent with the Zoning Ordinance. -A motion was made by Gariel
Burchett and seconded by Joe Creamer to Close the Public Hearing. The
motion passed unanimously 7-0.
A motion was made by Paul Moore and seconded by Fred Edwards to
defer RI'2-'7/U'2-02/VCJ2-08 to the January 22,20'3 Planning
Commission meeting. The motion passed unanimously 7-0.
3) RI12-16/VC12-06 -12855 Hopewell Road by Beazer Homes to rezone from
AG-1 (Agricultural) to NUP [Neighborhood Unit Plan} to develop 29 single
family homes at a density of 4.18 units per acre. A 2 part concurrent
variance, 1} Reduce the periphery setback from 40 feet to 25 feet along
the east and north property lines and 7 feet along the south property line
[Sec 64-921 (i)). 2) To allow sidewalks along only one side of the street on the
interior of the development (Sec 64-2393).
A Public Hearing was held and there were ten people who spoke in
opposition to the request. -A motion was made by Paul Moore and
seconded by Gariel Burchett to close the public hearing. The motion
passed unanimously 7-0.
A motion was made by Joe Creamer and seconded by Chris Doty to
recommend DENIAL of RlJ2-16/VCJ2-6. The motion passed unanimously
7-0.
6. Text Amendments
1) RZ12-18-To amend Chapter 64, Article VI. Division 2. AG-1 (Agricultural
District) as it pertains to fencing.
A motion was made by George Ragsdale and seconded by Paul Moore to

recommend Deferral to the February 26, 20 '3 Planning Commission
Meeting or later as needed. The motion passed unanimously 7-0.
2) RZ12-19-To amend Chapter 64, Article II, Division 8, as it pertains to fencing
and walls.
A motion was made by George Ragsdale and seconded by Paul Moore to
recommend Deferral to the February 26, 2013 Planning Commission
Meetlng or later as needed. The motlon passed unanimously 7-0.
7. Adjourn - A motion was made by Fred Edwards and seconded by Joe Creamer to
adjourn the meeting. The motion passed unanimously 7-0. Time of adjournment
was 9:09 p.m.
