Call to Order -The meeting was called to order at 7:04 p.m. Members Present: Terry Herr Peyton Jamison Mark Bittner Chris Doty Fred Edwards Paul Moore Members Absent: Gariel Burchett 3. Public Comment -There was no public comment. A motion was made by Paul Moore and seconded by Fred Edwards to close public comment. The motion passed unanimously 6-0. 4. Approval of Action Minutes 1) August 28, 2013 Planning Commission Meeting -A motion was made by Peyton Jamison and seconded by Paul Moore to approve the minutes as presented by Staff. The motion passed unanimously 6-0. 5. Use Permits 1) To request a Use Permit to develop a total of256 residential units at an overall density of 12 units per acre. The applicant is also requesting the following two part concurrent variance: 1) To provide 100% of the site for apartments (Chapter 64, Division 5.A. 4.6.6.a.i) and 2) To delete the requirement to provide a minimum of 300 cubic feet of separate contiguous storage space shall be provided for each dwelling unit (Sec 64-1839(8.)). The applicant requested a total time of 20 minutes to present their case. The applicant presented their case and there were a total of three residents that spoke in opposition to the request. A motion was made by Paul Moore and seconded by Fred Edwards to close the Public Hearingfor U13-02/vC13-03. After further deliberation by the Planning Commission, the following comments were made by the Planning Commissioners : 1. The request doesn't meet the requirements of the Fonn Based Code and goes against all the work the community has done. 2. There is a lot of retail currently, looking forward to seeing the result of the Fonn Based Code to provide mixed use developments . 3. Even though there may be a demand detennined by the applicant for apartments , the vision for this area of the City is for mixed use development. The Planning Commission felt it would not serve the vision for the area to compromise the code that the City adopted. The Planning Commission believes the code needs to be allowed to work and the applicant has requested changes too far removed from the vision and intent of the code. A motion was made by Paul Moore and seconded by Peyton Jamison to deny U13-02 and VC13-03. The motion passed unanimously 6-0. 6.
