PLANNING COMMISSION ACTION MINUTES

1. Pledge of Allegiance
2. Call to Order -The meeting was called to order at 7:02 p.m.
Members Present: Gariel Burchett Peyton Jamison

3. Public Comment
There were no public comments. A motion was made by Paul Moore and
seconded by Gariel Burchett to close the public hearing. The motion
passed unanimously 7-0.
A motion was made by Gariel Burchett and seconded by Fred Edwards to move
the agenda items that are to be deferred, RZ13-20 and RZ13-21, before RZ13
18. The motion passed unanimously 7-0.
4. Approval of Action Minutes
November 20,2013 Planning Commission Meeting -Paul Moore requested an
amendment be made to the phrasing of the #5 condition of the Jeff Runner
zoning to read "artificial noise may only be emitted on the west side ofthe
property." There were no objections to this change. A motion was made by
Fred Edwards and seconded by Paul Moore to approve the minutes as
presented by Staff with the amendment The motion passed unanimously 7-0.
5. Deferred Items
1) RZ13-20 -16340 Binningham Hwy with additional frontage on New Bull Pen
Road containing a total of approximately 65.71 acres by Christopher Perry to
rezone from AG-l to CUP (Community Unit Plan) to develop 54 single family
residences.

Public Comment: There were two public comments. Paul Moore made a
motion to close public comment seconded by Fred Edwards. The motion passed
unanimously 7-0.
Peyton Jamison made the motion to DEFER RZ13-20 to the January 29,2014
Planning Commission meeting seconded by Gariel Burchett. The motion was
approved with an amendment to require the applicant to be available to at least
one meeting with the community and that the applicant also provide staff with
requested math. The motion passed unanimously 7-0.
2) RZ13-21-975 Birmingham Road and 15755 Birmingham Hw-y containing a total
of22.3 acres by Acadia Homes and Neighborhoods LLC to rezone from
MIX(Mixed Use) and AG-l (Agricultural) to CUP (Community Unit Plan) to
develop 55 single family residences.
Public Comment: There was one public comment. Paul Moore made a motion
to close public comment seconded by Gariel Burchett. The motion was passed
7-0.
Paul Moore made a motion to DEFER RZ13-21 to the January 29,2014
Planning Commission meeting seconded by Fred Edwards. The motion passed
unanimously 7-0.
3) RZ13-17 -13980 Freemanville Road by Fuqua and Associates to rezone from
AG-l (Agricultural) to CUP (Community Unit Plan) to develop 9 single family
residences on 16.98 acres.
There were three public comments. A motion was made by Paul Moore and
seconded by Terry Herr to close public comment. The motion passed
unanimously 7-0.
A motion was made by Paul Moore to deny RZ13-17 as a CUP and ask that the
applicant reconsider AG-1 conditions to be brought forward at the next
meeting. There was no second. The motion failed.
A motion was made by Peyton Jamison to APPROVE RZ13-17 with Staffs
recommended conditions and seconded by Gariel Burchett. The motion passed
6-1 with Commissioner Moore voting in the negative.
6. Rezoning Petitions
1) RZ13-18 -14738 Birmingham Hwy by Piedmont Atlantic Capital to rezone from
AG-l (Agricultural) to CUP (Community Unit Plan) to develop 17 single family
residences.

There were four public comments. A motion was made by Paul Moore and
seconded by Fred Edwards to close public comment. The motion passed
unanimously 7-0.
A motion was made by Chris Doty to DEFER to the January 29th Planning
Commission Meeting to allow for the determination ofownership ofthe road.
Fred Edwards seconded the motion. The motion passed unanimously 7-0.
2) RZl3-19 -13941 and 13943 Hwy 9 North by Ashton Atlanta Residential, LLC to
rezone from 0-1 (Office-Institutional) to TR (Townhouse Residential) to develop
24 single family residences.
There were four public comments. A motion was made by Paul Moore to close
public comment and seconded by Fred Edwards. The motion passed
unanimously 7-0.
A motion was made by Paul Moore to support StafFs recommendation and
DENY RZ13-19 to allow the balance ofthe study area to be completed and not
be inconsistent with the form based code plan. Fred Edwards seconded the
motion. The motion passed'1-0.
7. Other Business
I) 2014 Planning Commission Schedule
Gariel Burchett made a motion to accept the schedule as presented. Mark
Bittner seconded the motion. The motion passed 7-0.
8. Adjourn -A motion was made by Terry Herr and seconded by Chris Doty to
adjourn the meeting. The meeting was adjourned at 10:06 p.m.
