PLANNING COMMISSION ACTION MINUTES
City Council Chambers

1. Pledge of Allegiance
2. Call to Order -The meeting was called to order at 7:00 p.rn.
Members Present: Peyton Jamison Mark Bittner Paul Moore
Gariel Burchett Fred Edwards
Members Absent: Terry Herr Chris Doty
3. Public Comment -There was one public comment.
A motion was made by Paul Moore and seconded by Fred Edwards to close
Public Comment. The motion passed unanimously 5-0.
4. Approval of Action Minutes
1) December 18, 2013 Planning Commission Meeting -
Peyton Jamison stated that RZ13-21 should read 7-0 instead of6-0 and RZ13-19
should read 7-0 instead of 6-0. In addition, Paul Moore stated that instead of Fred
Edwards made the correction of the November 20,2013 Planning Commission
meeting it was Paul Moore for an amendment be made from the November 20
meeting.
A motion made by Mark Bittner and seconded by Fred Edwards with the
proposed changes. The motion passed unanimously 5-0.
5. Election of Officers -Fred Edwards made a motion to delay the election of
officers to the next PC meeting when afull commission is present and
seconded by Peyton Jamison. The motion passed unanimously 5-0.
6. Deferred Items
1) RZ13-21-975 Birmingham Road and 15755 Birmingham Hwy containing a total

of 22.3 acres by Acadia Homes and Neighborhoods LLC to rezone from
MIX(Mixed Use) and AG-l (Agricultural) to CUP (Community Unit Plan) to
develop 55 single family residences.
The applicant has requested to withdraw the request. A public hearing will be held
if necessary.
There was no comment for this request.
A motion was made Paul Moore and seconded by Fred Edward to approve the
withdrawal ofRZ13-21. The motion was passed unanimously 5-0.
2) RZ13-18 -14738 Birmingham Hwy by Piedmont Atlantic Capital to rezone from
AG-l (Agricultural) to CUP (Community Unit Plan) to develop 17 single family
residences.
The Planning Commission recommended Deferral to the January 29, 2014
meeting to allow further information be collected by the City Staff. Since that
time, it has been determined that the parcel in question has not been dedicated to
the City. In addition, an additional legal action has been taken on a portion of the
property. The situation remains unresolved and therefore, Staff recommends an
additional Deferral until the April 23, 2014 meeting. A public hearing will be held
if necessary.
The City Attorney, Ken Jarrard explained to the Commission the current situation
regarding the inter-parcel access from the Acaro at Triple Crown subdivision to
the subject site. In addition he stated that there was litigation pending on a portion
of the subject site. These are the reasons for the recommendation for deferral to
the April 23, 2014 meeting.
There were two comments in opposition to the requested rezoning.
A motion was made by Paul Moore and seconded by Fred Edwards to close
Public Comment. The motion passed unanimously 5-0.
A motion was made by Gariel Burchett and seconded by Paul Moore to
recommend deferral to the April 23, 2014 Planning Commission Meeting. The
motion passed unanimously 5-0.
3) RZ13-20 -16340 Birmingham Hwy with additional frontage on New Bull Pen
Road containing a total of approximately 65.71 acres by Christopher Perry to
rezone from AG-l to CUP (Community Unit Plan) to develop 54 single family
residences.
The applicant has requested for a Withdrawal without prejudice for RZI3-20.
There were seven comments in opposition to the requested rezoning.

A motion was made by Paul Moore and seconded by Fred Edwards to close
Public Comment. The motion passed unanimously 5-0.
A motion was made by Fred Edwards and seconded by Peyton Jamison to
withdrawal RZ13-20 without prejudice.
7. Adjourn -A motion was made by Paul Moore and seconded by Peyton Jamison
to adjourn the meeting. The meeting was adjourned at 7:40 p.m.

Text Amendments
1) RZ13-22 -To amend Chapter 64, Article VII, Division 6 Northwest Fulton
Overlay District
2) RZ14-01 -To amend Chapter 64, Article I, Section 64-1 Definitions
3) RZ14-02 -To amend Chapter 64, Article IX Administrative Permits and Use
Permits
Staff presented the proposed changes for text amendments RZI3-22,
RZI4-01, and RZI4-02. These items will be presented at the March 26,2014
Planning Commission Meeting.
