2. Call to Order - The meeting was called to order at 7: 00 p.m.

3. Public Comment — There was no public comment.
4. Approval of Action Minutes
1) June 24, 2015 Planning Commission Meeting —
A motion was made by Paul Moore and seconded by Mark Butner to approve
the June 24, 2015 minutes as presented by Staff. The motion passed
unanimously 6-0.
New Items
1) R.Z15-141U15-041VC15-43 - 3503 and 3505 Bethany Bend by Wisdarium
LLC to rezone from 0-1 (Office -Institutional) and AG-1 (Agricultural) to
O-I (Office -Institutional) and a Use Permit for a Private School (Sec. 64-
1831) to expand the existing school from 2,000 square feet to 6,000 square
feet for up to 150 students. A two-part concurrent variance to reduce the
50 foot undisturbed buffer and 10 foot improvement setback to a 10 foot
landscape strip along the north property line (Sec. 64-1091(a)) and to
reduce the 100 foot setback for recreation areas to 40 feet along the north
property line (Sec. 64-183 1 (b)(4)).

A motion was made by Paul Moore and seconded by Chris Doty to defer
RZ15-14/U15-041VC15-03 to August 26, 2015. The motion passed
unanimously 6-0.
2) RZ15-15 -To amend the Rural viewshed within the Rural Milton Overlay
for Single -Family type uses. (Sec. 64-1141 (a))
A motion was made by Noel Carpenter and seconded by Gariel Burchett
to Deny RZ15-15. The motion failed by a vote of 3-3 with
Commissioners Moore, Doty, and Butner voting in the negative.
A second motion was made by Paul Moore and seconded by Mark
Bittner to recommend approval as submitted by Staff. The motion jailed
by a vote of 3-3 with Commissioners Carpenter, Burchett and Jamison
voting in the negative.
A third motion was made by Paul Moore and seconded by Mark Butner
to recommend approval with no change to Sec. 64-1141 (a) (1) a. and to
approved the proposed Sec. 64-1141 (a) (1) a. H The motion failed by a
vote of 3-3 with Commissioners Carpenter, Burchett and Jamison voting
in the negative.
A fourth motion was made by Gariel Burchett and seconded by Peyton
Jamison to recommend deferral until the August 26, 2015 Planning
Commission Meeting. The motion passed by a vote of 4-2 with
Commissioners Moore and Butner voting in the negative.
3) RZ15-16 - To amend Private Swimming Pool Standards for detached
dwellings. (Sec. 64-1069 (b))
A motion was made by Chris Doty and seconded by Paul Moore to
recommend approval with the following changes to the proposed
ordinance; to approve Sec. 64-1609 (a) (b) updating the years in the
International Building Code and deny the proposed change to Sec. 64-
1609 (b)(1)(b) but to keep the existing 150 foot distance from the water's
edge of the pool. The motion passed by a vote of 4-2 with Commissioners
Burchett and Carpenter voting in the negative.
4) RZ15-17 - To create a definition for "barrier" in definitions (Sec.64-1)
A motion was made by Chris Doty and seconded by Noel Carpenter to
recommend denial of the new definition. The motion passed
unanimously 6-0

b. Adjourn —A motion was made by Paul Moore and seconded by Mark Bittner to
adjourn the meeting at 8:45 p.m. The motion passed unanimously 6-0.
