Pledge of Allegiance Members Present: Sumeet Shah Fred Edwards Kurt Nolte Ron Gilbert Marty Lock Zach Middlebrooks Jan Jacobus 2. Call to Order -The meeting was called to order at 6:00 p .m. 3. Public Comment -There was no public comment. 4. Approval of Action Minutes a) June 22, 2020 Planning Commission Meeting A motion was made by Kurt Nolte and seconded by Sumeet Shah to approve the minutes as presented by Staff. The motion passed unanimously. 5. Preliminary Plats a) Providence Point , Birmingham Hwy and New Providence Rd 5 Lot Single Family Subdivision on 6.55 acres -A motion was made by Kurt Nolte and seconded by Fred Edwards to recommend approval of the preliminary plat and to make subject to engineering review for the detention pond and recommendations made during the discussion. The motion passed unanimously. Michele McIntosh-Ross, Principal Planner, spoke via Zoom regarding the upcoming CPAC meeting scheduled for August 12 , 2020. 6. Text Amendments a) RZ20-10 b) RZ20-11 To amend Sec 64 -1 Definitions. -A motion was made by Fred Edwards and seconded by Jan Jacobus to recommend Approval as recommended by Staff. The motion passed unanimously. To amend Sec. 64-775 . -Use regulations -C-1 (Community c} RZ20-12 d) RZ20-13 e) RZ20-14 f) RZ20-15 g} RZ20-16 Business) -A motion was made by Ron Gilbert and seconded by Fred Edwards to recommend Approval as recommended by Staff. The motion passed unanimously. To create 64 -1 608.1 "Temporary consumer fireworks retail sales facilities" Administrative Use Permit -A motion was made by Fred Edwards and seconded by Ron Gilbert to recommend Approval as recommended by Staff with the following change to read "(12) Temporary consumer fireworks retail sales facilities shall not be located within three hundred (300) feet of the property line of a nursing home, hospital, other health care facility, day care facility, school, residential dwelling, equestrian facility, active farm, or veterinary facility." The motion passed unanimously. To amend Article XIX-Crabapple Form Based Code, Definitions Article 6.1 -A motion was made by Ron Gilbert and seconded by Kurt Nolte to Withdraw as recommended by Staff. The motion passed unanimously. To amend Article XIX -Crabapple Form Based Code, Article 5, Table 9, subsection d (Retail) -A motion was made by Ron Gilbert and seconded by Fred Edwards to recommend Approval as recommended by Staff. To Amend Article XX-Deerfield Form Based Code, Definitions Article 6. 1 -A motion was made by Ron Gilbert and seconded by Kurt Nolte to Withdraw as recommended by Staff. The motion passed unanimously. To Amend Article XX -Deerfield Form Based Code, Article 5, Table 10, subsection (Retail) -A motion was made by Ron Gilbert and seconded by Fred Edwards to recommend Approval as recommended by Staff.
