Agenda Item: Financial Statements & Investment Report for Period 2 – November 2020
Overview and Financial Highlights:
General Fund
Revenue collections for the General Fund are 2.55% over what is
anticipated for the second period of the fiscal year.
Please remember as you look at the financial statements that there are
several revenue sources whose collections in the first two periods of a new
fiscal year will be accrued back to the previous fiscal year. It is a generally
accepted accounting principle to apply the revenue to the period it is
intended for.
Total expenditures to-date are $4,587,986 and are 10.92% less than
expected for this period of the fiscal year.
Capital Project Fund
Expenditures within this fund continue to occur on a project-by-project
basis. With a total project expenditure budget of $16,778,755, capital
expenditures-to-date total $1,350,311.
Please note that the financial statements for capital related funds include
current encumbrances. This will provide a clear picture of future
commitments of resources prior to an actual payment being made.

Project Description: The City of Milton entered into a Professional Services Agreement
with Brumbelow-Reese & Associates on August 19, 2019 to provide Engineering Services
for layout and design of the new trails at Providence Park. The scope for the layout ,
design and bid package were amended to accommodate the grant requirements
and incorporate the restrooms and pier in the bid package. As a result, Brumbelow-
Reese submitted a change order to the original Professional Services Agreement.
Change Order #1 represents the additional services required by the consultant in order
to complete the original scope of services.

CHANGE ORDER #1 FOR PROFESSIONAL SERVICES AGREEMENT
Surveying Services and Construction
Drawings — Providence Park Trails
WHEREAS, the City of Milton, Georgia ("City") and Brumbelow-Reese and Associates, Inc. ("Consultant")
have entered into a Professional Services Agreement (the "Agreement") dated August 19, 2019,
incorporated herein by reference, for providing surveying services to locate and design four trails, providing
construction drawings for the future construction of such trails at Providence Park; and
WHEREAS, the parties desire to issue an addendum pursuant to Section 4 of the Agreement, it being to
the mutual benefit of all parties to do so, as set forth herein for the reasons and consideration set forth herein;
and
WHEREAS, the City determined the grant and the engineering scope of services did not agree, and
therefore the City amended the scope of service to provide for a design change from 8% ADA compliance
to 5% grade, including Land Disturbance Plans and permit requirements, and staking of centerline of trail
for construction; and
WHEREAS, the parties desire to modify the timing of the Agreement, it being to the mutual benefit of all
parties to do so;
NOW THEREFORE, the parties hereto agree to amend the Agreement as follows:
1. The parties acknowledge that the purpose of this Change Order is to modify the original scope of
work based on the layout approved by City of Milton Mayor and Council. Section 2 and Exhibit A
of the Agreement are amended to add this Work, which is described in more detail in the quote for
work attached hereto.
2. Section 3 and Exhibit A of the Agreement are amended to state that the Work added by this
Change Order shall be completed by February 15, 2021.
3. Section 5 of the Agreement is amended so that the total amount paid under the Agreement as
compensation for Work performed and reimbursement for costs incurred shall not, in any case,
exceed $33,382.50 (the "Maximum Contract Price"). The compensation for added Work
performed under this Change Order shall consist of the flat fee of $16,382.50, notwithstanding any
contrary provisions in the quote for work attached hereto. Consultant represents that the amount of
$16,382.50 is sufficient to perform all of the Work set forth in and contemplated by this Change
Order,
4. It is agreed by the parties hereto that all of the other terms and conditions of the Agreement,
including all unamended portions, shall remain in full force and effect other than as modified herein.
Upon execution by all parties, this Change Order shall be attached to and form a part of said
Agreement.

Department Recommendation:
Approve the Resolution to Set Qualifying Fees for the 2021 Municipal Elections.
Executive Summary:
The City of Milton is committed to conducting City business in a manner that complies
with all legal requirements, fosters citizen confidence in City government, and promotes
efficient and effective government operations.
Funding and Fiscal Impact:
In compliance with its Charter, the City of Milton will be holding elections for Council
Seats for Mayor, District 1/Post 1, District 2/Post 1, and District 3/Post 1 in 2021. Georgia
Election Code Section 21-2-131(a)(1)(A) provides that qualifying fees shall be fixed not
later than February 1st of any year in which a general election is to be held, and State
law provides that such fees shall be three percent of the total gross salary of the office
paid in the preceding year if a salaried office, including all supplements authorized by
law.
The following qualifying fees shall apply to candidates seeking municipal office in the
election to be held on November 2, 2021: Mayor $690 and City Councilmember
$390.00. A copy of the Resolution shall be published in the City’s legal organ following
its adoption.

TO SET QUALIFYING FEES FOR MUNICIPAL ELECTIONS
WHEREAS, the Georgia Elections Code provides at § 21-2-131(a)(1)(A) that qualifying
fees shall be fixed no later than February 1 of any year in which a general election is to be held;
and
WHEREAS, State law provides that such fees shall be three percent (3%) of the total

Executive Summary:
The Georgia Department of Community Affairs (DCA) requires that local governments
conduct and complete a comprehensive plan every five (5) years . The City of Milton,
since its incorporation, has completed two (2) Comprehensive Plans (in 2011 and 2016)
in accordance with the rules of Georgia Department of Community Affairs (DCA), and
has maintained its Qualified Local Government (QLG) status. Milton’s next
Comprehensive Plan is due to the state DCA in the fall of 2021 in order to fulfil this
requirement and continue to maintain QLG.
Per City code, the Mayor and each Councilperson shall nominate his or her designee for
one (1) of seven (7) of the 16 positions on the City of Milton Citizens Advisory Committee
for the City of Milton 2040 Comprehensive Plan – The Comprehensive Plan Advisory
Committee (CPAC). The 16 positions shall consist of the seven members of the City of
Milton Planning Commission (PC), the Chairman of the City of Milton Board of Zoning
Appeals (BZA), and the Chairman of the City of Milton Design Review Board (DRB) and
shall serve on the Citizen Advisory Committee to the City of Milton 2040 Comprehensive
Plan – The Comprehensive Plan Advisory Committee (CPAC) consistent with their terms
on their respective board or commission.
On August 10, 2020 the Mayor and City Council appointed Ron Gilbert as the Chairperson
of the City of Milton Citizens Advisory Committee for the City of Milton 2040
Comprehensive Plan – The Comprehensive Plan Advisory Committee (CPAC). Ron Gilbert
has since resigned from that position and a new Chairperson is required.

A RESOLUTION NAMING A CHAIRPERSON OF THE CITIZENS ADVISORY
COMMITTEE (ALSO KNOWN AS THE COMPREHENSIVE PLANNING ADVISORY
COMMITTEE (“CPAC”)
WHEREAS, the City of Milton, Georgia is engaging in the process of updating its
Comprehensive Plan; and
WHEREAS, Sec. 2-183 of the Charter of the City of Milton, GA states, “The citizens
advisory committee will be involved in all phases of the creation, from inc eption to completion,
of the city's comprehensive plan”; and
WHEREAS, the Comprehensive Planning Advisory Committee constitutes the citizens
advisory committee contemplated in section 2-183; and
WHEREAS, the Georgia Department of Community Affairs has established procedures
for local governments to follow when adopting, amending and updating their Comprehensive
Plans, including that “members of the governing authority must be included among the selected
stakeholders and be actively involved in plan preparation, such as serving on the steering
committee that guides development of the plan” (Ga R. & Reg. 110-12-1-.02(2)(a)); and
WHEREAS, pursuant to the DCA procedures, on June 1, 2020, the City Council of the
City of Milton met in regular session and adopted a resolution appointing 16 members to the
Citizens Advisory Committee (also known as the Comprehensive Plan Advisory Committee
CPAC) (“Appointing Resolution”); and
WHEREAS, Section 10 of the Appointing Resolution resolved that, “the Mayor and City
Council shall choose one of the members of the Citizens Advisory Committee to be the
Chairperson”; and
WHEREAS, on August 10, 2020 at a regular City Council meeting, the Mayor and City
Council named and approved Ron Gilbert as the Chairperson of the Citizen Advisory Committee

Department Recommendation:
Approve the issuance of an alcohol beverage license for Milton Wine & Crystal, LLC, for
Consumption on Premise: Wine, Craft Wine Market and Alcoholic Beverage Catering
License: Wine.
Executive Summary:
City of Milton Code of Ordinances Chapter 4 allows for the issuance of alcohol beverage
licenses to businesses that properly submit application for and meet all of the legal
requirements to hold such license. This application is submitted due to the desire of the
establishment to add the listed licenses to the Alcohol Beverage License they already hold
for Retail Package: Wine, Ancillary Wine Tasting and Sunday sales related to the existing
retail package license. Please note, Sunday sales for this location are only permitted for
retail package sales as the establishment does not meet the State’s 50:50 rule for Sunday
consumption on premise.
