Adjourn Prepared by the Community Development Department for the City of Milton Planning Commission Meeting on January 29, 2020 1/24/2020 Page 1 of 3 RZ20-01 RZ20-01 Sec. 64-1 Definitions Brewpub means an accessory use to a permitted restaurant where distilled spirits, malt beverages or wines are licensed to be sold and where beer or malt beverages are manufactured or brewed for consumption on the premises and solely in draft form. Brewpub means any restaurant that also qualifies as an eating establishment in which beer, wine and/or distilled spirits are licensed to be sold for consumption on the premises and beer or malt beverages are manufactured or brewed, subject to the barrel production limitation prescribed in O.C.G.A. § 3-5-36 for retail consumption in draft form on the premises. For the purposes of this chapter, a Brewpub shall fall under the Use and Retail Use categories of General Service, Restaurant, Liquor Selling Establishment and “Retail and/or service establishment.” Brewery means a domestic manufacturing facility for malt beverages that is licensed by the state. For the purposes of this chapter, a Brewery shall fall under the Other Industrial Use category of Manufacturing and Liquor and package sales. City Food Market. The term City Food Market shall have the same definition as set forth in Chapter 4 of the Milton Code of Ordinances. For the purposes of this chapter, a City Food Market shall fall under the Use and Retail Use categories of General Retail, General Service, Liquor Selling Establishment, Liquor and package sales, Retail Store or Shop and “Retail and/or service establishment.” Courtyard Market. The term Courtyard Market shall have the same definition as set forth in Chapter 4 of the Milton Code of Ordinances. For the purposes of this chapter, a Courtyard Market shall fall under the Retail Use categories of General Service, Liquor Selling Establishment, Restaurant and “Retail and/or service establishment.” Craft Beer and/or Wine Market. The term Craft Beer and/or Wine Market shall have the same definition as set forth in Chapter 4 of the Milton Code of Ordinances. For the purposes of this chapter, a Craft Beer and/or Wine Market shall fall under the Use and Retail Use categories of General Retail, General Service, Liquor Selling Establishment, Liquor and Package sales, Retail Store or Shop and “Retail and/or service establishment.” Distillery. The term Distillery shall have the same definition as set forth in Chapter 4 of the Milton Code of Ordinances. For the purposes of this chapter, a Distillery shall fall under the Other Industrial Use category of Manufacturing and Liquor and package sales. Eating Establishment. The term Eating Establishment shall have the same definition as set forth in Chapter 4 of the Milton Code of Ordinances. The term Farm Winery shall have the same definition as set forth in Chapter 4 of the Milton Code of Ordinances. For the purposes of this chapter, a Farm Winery shall fall under the Retail Use categories of xxxxxxxxxxxx.” Food Hall Café. The term Food Hall Café shall have the same definition as set forth in Chapter 4 of the Milton Code of Ordinances. For the purposes of this chapter, a Food Hall Café shall fall under the Retail Use categories of General Service, Liquor Selling Establishment, Restaurant or “Retail and/or service establishment.” Growler Shop. The term Growler Shop shall have the same definition as set forth in Chapter 4 of the Milton Code of Ordinances. For the purposes of this chapter, a Growler Shop shall fall under the Use and Retail Use categories of General Retail, General Service, Liquor and Package sales, Retail Store or Shop and “Retail and/or service establishment.” Micro-brewery. The term Micro-brewery shall have the same definition as set forth in Chapter 4 of the Milton Code of Ordinances. For the purposes of this chapter, a Micro-brewery shall fall under the Other Industrial Use category of Manufacturing and Liquor and package sales. Micro-distillery. The term Micro-distillery shall have the same definition as set forth in Chapter 4 of the Milton Code of Ordinances. For the purposes of this chapter, a Micro-Distillery shall fall under the shall fall under the Other Industrial Use category of Manufacturing and Liquor and package sales. Off premise beer/wine retailer or store means any person or entity that sells or provides to the public unbroken packages or growlers, only to consumers and not for resell. For the purposes of this chapter, an Off premise beer/wine retailer or store shall fall under the Use and Retail Use categories of General Retail, General Service, Retail Store or Shop, “Retail and/or service establishment,” and Liquor and Package sales. Off premise distilled spirits retailer or store means any person or entity that sells or provides to the public distilled spirits and malt beverages and/or wine in unbroken packages, not for consumption on the premises; and which derives from such retail sale of alcoholic beverages in unbroken packages at least 75 percent of its total annual gross sales from the sale of a combination of distilled spirits, malt beverages, and wine. For the purposes of this chapter, an Off premise distilled spirits retailer or store shall fall under the Retail Use categories of Liquor and Package sales and “Retail and/or service establishment.” On premise consumption retailer means any person or entity that sells or provides to the public alcoholic beverages for consumption on the premises, only to consumers and not for resale. For the purposes of this chapter, an On premise consumption retailer shall fall under the Retail Use categories of General Service, Restaurant, Liquor Selling Establishment or “Retail and/or service establishment.” Private Club. The term Private Club shall have the same definition as set forth in Chapter 4 of the Milton Code of Ordinances. The term Specialty Shop shall have the same definition as set forth in Chapter 4 of the Milton Code of Ordinances. For the purposes of this chapter, a Specialty Shop shall fall under the Use and Retail Use categories of General Retail, General Service, Liquor and package sales, Retail Store or Shop, and “Retail and/or service establishment.” Sports Club. The term Sports Club shall have the same definition as set forth in Chapter 4 of the Milton Code of Ordinances. For the purposes of this chapter, a Sports Club shall fall under the Retail Use categories of General Service, Restaurant, Liquor Selling Establishment or “Retail and/or service establishment.” Tasting Room. The term Tasting Room shall have the same definition as set forth in Chapter 4 of the Milton Code of Ordinances. For the purposes of this chapter, a Tasting Room shall fall under the Retail Use categories of General Service, Restaurant, Liquor Selling Establishment or “Retail and/or service establishment.” Restaurant means a food service use which involves the preparation and serving of food to seated patrons. The restaurant seating area must be at least 40 percent of the gross square footage of the restaurant facility. Seating space located outside of the main structure (i.e., patios, decks, etc.) shall not be included in calculating the seating space. The term "restaurant" includes a cafeteria. Restaurant means any public place kept, used, maintained, advertised and held out to the public as a place where meals are served and where meals are actually and regularly served to seated patrons, without sleeping accommodations, such place being provided with an adequate and sanitary full service kitchen and dining room equipment, having employed therein a sufficient number and kind of employees to prepare, cook and serve suitable food for its guests. At least one meal per day shall be served at least six days per week, with the exception of holidays, vacations and periods of redecorating, and the serving of those meals shall be a principal portion of the business conducted, with the serving of alcoholic beverages as only incidental thereto. The restaurant seating area must be at least 40 percent of the gross square footage of the restaurant facility. Seating space located outside of the main structure (i.e. patios, decks, etc.) shall not be included in calculating seating space. The term “restaurant” includes cafeteria. In all zoning districts the following uses are considered objectionable and are prohibited: bars and night clubs, fortune telling establishment, massage parlor, pool hall, escort and dating services, vape shops, and tattoo and body art or piercing establishment. All uses licensed and/or permitted under Chapter 4. (2) Accessory uses. A structure or land may be used for uses customarily incidental to any permitted use and a dwelling may be used for a home occupation. Retail and service uses, and clubs accessory to recreation facilities are allowed subject to the following conditions: a. Accessory retail and service uses shall be located wholly within a building with a majority of the floor area designed for recreation uses. No outdoor advertising is allowed. b. Retail and service uses shall be limited to convenience retail and service establishments such as pro shops and personal services. Restaurants accessory to a club are allowed. c. All uses licensed and/or permitted under Chapter 4 are permitted accessory uses.
