The petitioner intends to subdivide the overall parcel into 6 residential lots with a separate parcel for a detention facility. The intent is to develop similarly to AG1 requirements under a CUP rezoning requesting modified front building setbacks to 20 feet. The Comprehensive Plan designates this area as AEE (Agriculture, Equestrian, Residential) consisting of single-family homes on at least one acre. As indicated on the conceptual site plan, each proposed lot meets this designation. Environmental Impacts of the Proposed Project a. Wetlands: Per the National Wetlands Inventory and field observation, there are no wetlands on the subject property. b. Floodplain: Per FEMA Map 13121C0014G, Community Map 1306730014G, dated June 19, 2020, there is no floodplain on the subject property. c. Streams/Stream Buffers: Per survey field location, streams and associated stream buffers are shown as indicated on the survey. d. Slopes exceeding 25 percent over a 10-foot rise in elevation: Per field observation and verification, the steep slope area is shown as indicated on the conceptual grading plan. e. Vegetation: The subject parcel currently consists of a 1-acre homesite with associated improvements/landscaping and 8 acres of woodlands. The proposed residential development shall meet current City of Milton tree canopy coverage requirements. f. Wildlife Species (including fish): Per the US Fish and Wildlife Service the site contains birds common to the area. No alterations to habitats are proposed. g. Archeological/Historical Sites: Absent per Georgia Department of Natural Resources (GNAHRGIS) website. h. Specimen Trees: There are specimen trees on the subject property as indicated on the tree survey. Project Implementation Measures a. Protection of environmentally sensitive Areas: Sensitive areas include the stream and associated stream buffers shown on the survey. These areas will be protected during development of homes as required. b. Protection of Water Quality: Water quality will be provided per City of Milton requirements and addressed during design and permitting. c. Minimization of negative impacts on existing infrastructure: With the addition of 5 homes, negative impacts on existing infrastructure are not anticipated. d. Minimization on archeological/historically significant areas: N/A, the subject parcel is not within an archeological/historically significant area. e. Minimization of negative impacts on environmentally stressed communities: N/A, the subject parcel is not within an environmentally stressed community. f. Minimization of impacts to wildlife habitats: The subject parcel is indicated as having birds common to the area with no habitat alterations proposed. Additionally, fish are only a consideration with the US Fish and Wildlife Service for drainage basins greater than 1 square mile. Since the drainage basin is less than 1 square mile, the US Fish and Wildlife Service does not require monitoring for fish.. Starting in 1997, The Farm started hosting a variety of uses and events including equine breading, boarding and training, animal husbandry, an annual Easter egg hunt, ticketed live music events and various corporate events and weddings at the Property, including using valet services as needed. Starting in 2002, and continuously since then, The Farm has hosted summer camp as a week long day camp for children, birthday parties and other boy and girl scout types of events. There have been a variety of ancillary uses to the farm (including various fruit tree and apiary agricultural uses) historically for more than twenty years. Over the years, and as events have necessitated, Owner has voluntarily limited activities at the Property: limiting hours and days of operation, engaging valet parking services and off-duty police officers for traffic, and limiting the intensity of the event or activity. Conformance with the Comprehensive Plan The Farm at Pamelot and Painted Horse Winery seeks to obtain one or more use permit(s) to host events at the existing 17.82 -acre farm and farm winery at the corner of Bethany Way and Hopewell Road. The site is located adjacent to other farms and residences. The property contains one (1) potentially jurisdictional stream with associated stream buffers. No impacts to the stream or stream buffers are anticipated to occur. The Farm at Pamelot and Painted Horse Winery intends to make minimally impactful changes to the site to allow for the appropriate parking facilities and a future winery building. Please refer to the site plan included with the Use Permit application for additional detail (Figure 5). In accordance with the 2016 City of Milton Comprehensive Plan, the existing and future uses of The Farm at Pamelot and Painted Horse Winery will maintain the City's vision of the "maintenance of unique agricultural elements" as well as the preservation of 'rural character, community heritage, and a "small town" quality of life". 2. Environmental Impacts of Proposed Project The subject property is approximately 17.82 acres and is located south of Bethany Way and west of Hopewell Road, in the City of Milton in Fulton County, Georgia (Figure 1). A desktop analysis was performed using various online and GIS data sources to gain an understanding of the property's conditions and potential resources. These sources include wetlands, floodplains, streams/stream buffers, topography, slope, vegetation, and documented protected species and cultural resources. A detailed site delineation of streams and wetlands was not performed. a. Wetlands According to the National Wetlands Inventory (NWI), there are no mapped wetlands located within the property boundary. Three (3) mapped freshwater ponds were identified south of the project boundary. Potential aquatic resources are illustrated on Figure 2. b. Floodplain Areas classified as 100 -year floodplains are subject to regulations that limit the extent to which development and fill activities can occur. According to the Federal Emergency Management Agency (FEMA) Flood Insurance Rate Map (FIRM) Information, the subject property does not contain Zone A 100 -year floodplain (Figure 2) c. Streams/Stream Buffers Possible streams were identified using vegetative signatures on aerial photographs as well as a boundary survey provided by GeoSurvey dated July 29, 2020 (Figure 4). The stream, as depicted on the boundary survey, and its associated buffers are illustrated on Figure 2. A detailed stream delineation and official jurisdictional determination was not performed. Kimsey >>> Horn Page 12 Georgia law defines State waters as "any and all rivers, streams, creeks, branches, lakes, reservoirs, ponds, drainage systems, springs, wells, and other bodies of surface or subsurface water, natural or artificial, lying within or forming a part of the boundaries of the state, which are not entirely confined and retained completely upon the property of a single individual, partnership, or corporation." Moreover, the regulations (Section 12.7.6 b (15)) states that "there is established a 25 -foot buffer along the banks of all state waters, as measured horizontally from the point where vegetation has been wrested by normal stream flow or wave action. " According to the City of Milton ordinances, "an undisturbed natural vegetative buffer shall be maintained for 50 feet, measured horizontally, on both banks (as applicable) of the stream as measured from the point of wrested vegetation." "An additional setback shall be maintained for 25 feet, measured horizontally, beyond the undisturbed natural vegetative buffer, in which all impervious cover shall be prohibited. Grading, filling and earthmoving shall be minimized within the setback." All State and City stream buffers are illustrated on Figure 2. d. Slopes Exceeding 25 percent over 10 -foot Rise in Elevation Using the Roswell, GA USGS 7.5 -Minute quadrangle topographic maps, slopes and draws were identified within the site boundaries (Figure 3). The land surface generally falls from high points in the northeastern portion of the property to the mapped stream in the central portion of the site. e. Vegetation The subject site is dominated by mixed pine/hardwood, mixed hardwood forests, and pastureland communities within the property boundary (Figure 2). The subject site is located within the Southern Inner Piedmont Ecoregion (Level IV) of Georgia. f. Wildlife An online review of protected wildlife and plant species was performed to assess threatened or endangered State and Federal species that have known occurrences on or near the site. The Federal list of species within the property boundary in Fulton County was generated through the United States Fish and Wildlife Service (USFWS) Information for Planning and Consultation (IPaC) system query report and the State list was generated through the Georgia Department of Natural Resources (GADNR) Natural Heritage Program (NHP) Species of Concern list. These reports are included in Attachment B, The IPaC report documented one (1) fish on the federal list in Fulton County. The Roswell, GA, NE Quarter Quad reports documented one (1) crayfish and two (2) flowering plants with state protection. FaC: Explore Location resources Wetlands in the National Wetlands Inventory Impacts to NWI wetlands and other aquatic habitats may be subject to regulation under Section 404 of the Clean Water Act, or other State/Federal statutes. For more information please contact the Regulatory Program of the local U.S. Army Corps of Engineers District. THERE ARE NO KNOWN WETLANDS AT THIS LOCATION. Data limitations The Service's objective of mapping wetlands and deepwater habitats is to produce reconnaissance level information on the location, type and size of these resources. The maps are prepared from the analysis of high altitude imagery. Wetlands are identified based on vegetation, visible hydrology and geography. A margin of error is inherent in the use of imagery; thus, detailed on -the -ground inspection of any particular site may result in revision of the wetland boundaries or classification established through image analysis. The accuracy of image interpretation depends on the quality of the imagery, the experience of the image analysts, the amount and quality of the collateral data and the amount of ground truth verification work conducted. Metadata should be consulted to determine the date of the source imagery used and any mapping problems. Wetlands or other mapped features may have changed since the date of the imagery or field work. There may be occasional differences in polygon boundaries or classifications between the information depicted on the map and the actual conditions on site. Data exclusions Certain wetland habitats are excluded from the National mapping program because of the limitations of aerial imagery as the primary data source used to detect wetlands. These habitats include seagrasses or submerged aquatic vegetation that are found in the intertidal and subtidal zones of estuaries and nearshore coastal waters. Some deepwater reef communities (coral or tuberficid worm reefs) have also been excluded from the inventory. These habitats, because of their depth, go undetected by aerial imagery. Data precautions Federal, state, and local regulatory agencies with jurisdiction over wetlands may define and describe wetlands in a different manner than that used in this inventory. There is no attempt, in either the design or products of this inventory, to define the limits of proprietary jurisdiction of any Federal, state, or local government or to establish the geographical scope of the regulatory programs of government agencies. When the Crabapple and Deerfield Form-Based Codes were written, the growth of the brewery industry was not anticipated. As Milton has grown and developed, we have been approached by multiple breweries that would like to create a footprint in our city – and have two actively hopeful for the allowance of breweries in T4-Open now! We recommend adding breweries, micro-breweries, distilleries, and micro-distilleries as Uses allowed by Warrant in the Crabapple and Deerfield Form-Based Codes in most zones currently allowing Chapter 4 licenses/permits by Right (see chart below). To apply for a Warrant, applicants would be required to submit the same information and pay the same fees as if they were applying for an Administrative Variance. The Warrant process ensures that the Community Development Director has the ability and responsibility to assess the Use and determine if the land is appropriate for such Use. By making it a Warrant versus by Variance, you remove the burden of a long process; similarly, by making it a Warrant versus by Right, ensures professional oversight.
