Consideration of Primary Variances Todd Chernik recuses himself from the proceedings of variance petition V21-25. a. V21-25, 810 Bethany Green Court Request(s): • To allow the lot coverage for an R2-A zoned property that fronts a public street to go from 20 percent to 28.7 percent. (Sec. 64- 1141(d)(1)(b)). • To allow the pool house in the rear set back 19 feet from the North property line (Sec. 64-485(d)). Motion to add 3.5 minutes to applicant’s time (since the opposition time exceeded by 3.5 minutes): Hodge 2nd: Brenda Vote: 4/0 (Approved) Motion to deny the request: Brenda 2nd: none Motion failed Motion to approve with condition that impervious percentage not to exceed 24% and 75% trees to remain: Jason 2nd: none Motion failed Motion to deny the request: Hodge 2nd: Brenda Vote: 1/3 (Motion did not pass) Motion to approve with condition that impervious percentage not to exceed 24% and 13 out of 17 trees to remain or no more than 4 trees to be removed: Jason 2nd: Brenda Vote: 3/1 (Approved), (Hodge opposed) Motion to deny the part two of the variance requests: Hodge 2nd: Jason Vote: 4/0 (Denied) b. V21-26, 1745 Dinsmore Road Request(s): • To allow the existing garage to encroach rear yard setback up to 9.33 feet to North property line on the property zoned AG-1(Sec. 64- 416(d)). Motion to allow existing garage in the setback to remain as per location shown in the site plan received on November 2nd 2021, intended use to be storage facility at the same location with 3 conditions: Todd 2nd: Hodge Vote: 5/0 (Approved) Conditions: 1. Architecture of the garage to be approved by the City Architect. 2. Building material of proposed garage to match the existing house. 3. Water mitigation to be assessed by the city-staff at the plan review process. 7. Consideration of Appeals/Secondary Variances None 8. Old business None 9. New business a.
