Remove the 2 individual windows between the two clusters. Match the muntin pattern from windows to the storefront windows near the door. For pavilion: Change the roof from gable to hip roof. Provide non-polished concrete for flooring with brown stain. Widen the base of columns to 18 inches. For Office / Retail building: Remove outdoor deck. We will not be removing any trees or disturbing any other areas. The current zoning code (R2) for my property, located at 505 Dorris Road, states that structures must be "set back" at least 15 feet from the side property line. According to the city, the structure in question is 13 feet from my side property f i n e and is therefore two feet closer than current zoning code allows. The structure in question was built over thirty years ago by a previous owner of the property and was present prior to my ownership. Granting of a variance would not result in any change to current structures on the property and would not allow any further encroachment on the property line. Due to the shape and orientation of the property line, demolition of the structure would be the only way to correct this violation of R2 zoning requirements. The structure is used to store critical farm equipment and materials and without the shed, the equipment and materials would be exposed to the elements. Relief of this ordinance, if granted, would not cause any detriment to the adjacent property. The existing structure abuts a wooded section of the adjacent property and is not visible from any dwellings on the adjacent property. Demolition of the structure to meet current zoning requirements would be unreasonable and would create undue hardship as the structure has been present on the property for over thirty years and is not a new addition to the property. Relief, if granted would not offend the spirit or intent of the Ordinance and there are such extraordinary and exceptional situations or conditions pertaining to the particular piece of property that the literal or strict application of the Ordinance would create an unnecessary hardship due to size, shape or topography or other extraordinary and exceptional situations or conditions not caused by the variance applicant. Relief of this ordinance would not offend the spirit or intent of the Ordinance and would not cause any risk to public safety, health, or welfare. There is a detached garage on the property that appears to have been built in the early 19.90's. The garage is not sheet rocked so the framing is all. visible. Greg and Laura Routt bought the property in 2018. When.`the Routt's purchased the property they also acquired the small strip of land behind the property. The. Hello, The Purpose of this letter is to identify the reason we are asking for a variance to have a swimming pool and paver deck constructed at the above address. The variance we are asking for is a 3% Impervious exception from the 2S% to 28%. The reason this 3% is needed is due to the existing structure and driveway alone sit at the 25% number. The reason for this is due to the lots topography and the need for an excessively long driveway needed to enter the home. The area where the pool is proposed to be built is directly behind the home and doesn't encroach on any existing setbacks or easements. We also have addressed the extra water run off created by adding approximately 1500 sqft impervious area to the property. Flow wells measuring 24" in diameter and 24" high will be installed to accommodate per the equation enough relief to accommodate approximately 1700 sgft of impervious area. Therefore eliminating concerns for excessive water runoff into neighboring yards or streets. Due to accommodating this square footage we are minimizing the effect of rain water runoff and not offending the intent of the ordinance. If there was a better place to build the pool and deck we would entertain that but there just is not. We have already obtained approval from both the county in regards to the septic and the homeowners association in ragards to the pool design and placement. In the packet we have included letters from neighbors and the homeowners assoc executive members voicing their approval as well. Hello, The Purpose of this letter is to identify the reason we are asking for a variance to have a swimming pool and paver deck constructed at the above address. The variance we are asking for is to encroach on the 25' creek setback approx. 900 sgft- The reason this square footage is needed is due to the creek setback line running very close to the home. Just to be clear we are not asking for relief from the state buffer of 25" nor are we asking relief from the additional city buffer of 25'. We are asking for just a small amount of relief from the city setback. We have addressed the additional water run off created by this impervious area with the installation of flow wells to accommodate the extra square footage over the setback. This will mitigate the additional run off from flowing directly into the creek. We are also not asking for an impervious exception due to the impervious including our project is still at 17%. 8% less then the maximum allowed. Therefore eliminating concerns for excessive water runoff into neighboring yards or streets. Due to accommodating this square footage we are minimizing the effect of rain water runoff and not offending the intent of the ordinance. If there was a better place to build the pool and deck we would entertain that but there just is not.
