Executive Summary:
RZ21-15 – A text amendment to create a new Use Permit – Assembly Hall, Indoor
Auditorium (Sec. 64-1846)
In June 2012 when the Crabapple Form Based Code was adopted, within the
Use and Function Table, it required an “Assembly Hall, Indoor Auditorium” to be
granted with a Use Permit. At that time, the necessary Use Permit was not
created and adopted.
The proposed Use Permit will require that all requests go through the public
hearing process that includes CZIM (Community Zoning Information Meeting),
DRB (Design Review Board), PC (Planning Commission) and ultimately the Mayor
and City Council. There are several proposed standards for this use that are
intended to provide sufficient protection of adjacent and nearby properties.
RZ21-16 – Article XIX Crabapple Form Based Code, Article 6.1 Definitions – To

This amendment provides for a definition of Assembly Hall, Indoor Auditorium
and is the same as the definition in the Deerfield Form Based Code. Staff
researched other jurisdictions for guidance in creating the definition.

RZ21-17 – Article XX Deerfield Form Based Code, Article 5, Table 10 – Specific
Function and Use
When the Deerfield Form Based Code was adopted in 2014, this use was
permitted by Warrant (administrative approval by the Community Development
Director). It is Staff’s opinion that within the Deerfield Form Based Code, it should
also be required to obtain a Use Permit. The table reflects changing the
requirement from “Warrant” to a “Use Permit”.
RZ21-18 - Article XX Deerfield Form Based Code, Article 6.1 – To define Assembly
Hall, Indoor Auditorium
This amendment provides for a definition of Assembly Hall, Indoor Auditorium
and is the same as the definition within the Crabapple Form Based Code. Staff
researched other jurisdictions for guidance in creating the definition.
Community Zoning Information Meeting – November 30, 2021 – There was no
one in attendance at the meeting and Staff has not received any feedback via
phone or e-mail.
Sec. 64-1846- Assembly Hall, Indoor Auditorium.
(a) Assembly Hall, Indoor Auditorium in the Deerfield Form Based Code or the Crabapple
Form-Based Code shall only be permitted subject to the issuance of a use permit.
(b) Standards.
(1) Days and Hours of Operations shall be the following:
i. Sunday through Thursday, 9 a.m. to 10 p.m.
ii. Friday and Saturday, 9 a.m. to 11 p.m.
iii. Deliveries shall be limited to Sunday through Saturday, 7:30 a.m. to 7:30 p.m.
(2) No amplified sound permitted unless it is within an enclosed structure.
(3) The maximum number of attendees will be evaluated by the mayor and city council
on a case-by-case basis for each site to protect the public’s health, safety and welfare.

purpose of private party events, whether family, group, or corporate in nature, where access by
the general public is restricted, and with or without the sale, serving, or consumption of food
and/or alcoholic beverages. The owner or operator must hold all other appropriate licenses and

RZ21-21-A text amendment to update the definition of Fence

Executive Summary:
This proposed text amendment is an ongoing effort by the Community
Development Department to explain the existing Zoning Ordinance in regard to
fences with exhibits and modify where needed to clarify fence related issues.
The regulations related to the fences are spread out in various sections of
Chapter 64 of the Milton’s Zoning Ordinance. The following set of proposed text
amendments address the definition, general provisions and regulations relating
to the fence.
RZ21-21 - Article I, Definitions
RZ21-21 is updating the definition of ‘Equestrian Fence’ so that the term can be
used uniformly in the Ordinance as proposed in RZ21-19 to RZ21-20. In the current
Zoning Code, the equestrian fence is defined adequately. However, residents
often attach the welded wire to their equestrian fence. The proposed text
amendment incorporates acceptable placement of the wire with exhibits and
clarifies that the City acknowledges both sides of the fence as finished sides.
RZ21-19 - Article II, Division 8 – Additional Provisions
RZ21-19 focuses on solidifying the regulations and removing inconsistency about
the height of the fence. Two other minor changes include clarifying that the
intercom system of a private gate shall be 20 feet from public right of way and
chain link fences are to be prohibited around storm water facilities.
RZ21-19 also proposes streamlining the requirement of an equestrian fence when
the side, side corner or the rear of any property abuts an exterior road. For
example, if a property abuts an exterior street, the current code allows an

opaque fence in the rear as long as the opaque fence is not visible from the
street at any time of the year. It has been observed by the staff that opaque
fences in rear yad, side or side corner are very difficult to hide from the road. This
has caused design irregularities in the Milton’s rural viewshed. In the proposed
text amendment, if the side, side corner, or rear yard is adjacent to an exterior
street, an equestrian fence will be required in the 60-foot rural viewshed. Outside
the 60-foot rural viewshed an opaque fence will be allowed as long as it is not
visible from the street at any time of the year. A diverse rural landscape would
be necessary to achieve non visibility year around.
RZ21-20 - Article VI, Division 2, 3, 4, and 5- Fencing
RZ21-20 proposes changes to the fence regulations in AG-1, R-1, R-2, and R-2A
Zoning Districts. In the current code the fence regulations are exactly the same
in these four Zoning Districts. Currently, the fences in these Zoning Districts are
organized for 3 circumstances
a. Fencing along exterior street
b. Fencing along interior street of subdivision
c. Fencing on side, side corner or rear of non-subdivision
The intent of the text amendment is to have uniformity across these Zoning
Districts regarding the allowed fence types. Therefore, the proposed text
amendment replicates the changes proposed in RZ21-19. In addition, it
continues to use the term Equestrian Fence instead of specifying height,
material, and color of the fence. Furthermore, it restates that an equestrian
fence is to be the only type of fence allowed if it is on the side, side corner, or
rear yard adjacent to an exterior street within the 60-foot of rural viewshed.
Allowing the opaque fence outside the 60-foot rural viewshed with a condition
that as long as it is not visible from the street and any time of the year is included
in the text. This is achieved by redirecting to subsection (a)(7) whenever a fence
is set in the side or rear but facing the exterior road.

Sec. 64-212. Fence and wall specifications; exemptions.
Fences and walls which conform to the provisions stated herein shall be permitted by the community
development department. Fences erected for agricultural purposes in the AG -1 district shall be exempt from
permit requirements.
(1) Visibility triangle. Fences, walls and vegetative materials used in association therewith must not
obstruct the minimum sight distance requirements which are specified in the city subdivision
regulations (chapter 50) administered by the director of the community development depar tment.
(2) Gates. No part of a gate and the intercom system shall be located within 20 feet of a public right-of-
way, nor shall any gate or vehicle in any way obstruct a public right -of-way or the minimum sight
distance specified in the subdivision regulations regardless of whether open, closed or in an
intermediate position.
(3) Maintenance of required landscape areas. Landscape areas or strips required pursuant to this section
shall be maintained in accordance with the requirements of the tree preservation ordinance (article III
of this zoning ordinance).
(4) Fence and wall materials. Where this zoning ordinance or zoning conditions require fences and walls to
be solid/opaque, the visual density of the fence shall be such that it cannot be seen through.
The following standards shall apply to fences and walls:
a. Adjoining right-of-way. In all zoning districts, wire fencing materials, including chainlink fencing
with plastic or wooden inserts, shall not be used adjoining a street right -of-way. This provision
shall not preclude the use of chain link fencing as a security fence around stormwater facilities or
recreational courts.
The architectural treatment of poured concrete, common aggregate block or concrete block
walls shall be approved by the director of the community development department.
b. Fences along all property lines. Walls and fences constructed along all property lines shall be
constructed with a finished side toward the neighboring property.
c. Barbed wire. Barbed wire may be used in the AG-1 district as long as its use is associated with a
legitimate agricultural pursuit. Barbed wire shall not be approved for any single-family dwelling
lots, including such lots which are located in the AG-1 district. Barbed wire shall not be permitted
in any other zoning districts.
d. Minimum landscape requirements. A minimum three-foot landscape strip shall be provided
between a fence or wall and a public right-of-way.
(5) Height. Fences and walls shall not exceed a height of eight five feet from grade along exterior street
and eight feet along the interior street in residential districts. Column and ornament heights are
permitted to exceed the maximum fence/wall height up to three feet.
a. Fencing along exterior streets of non-subdivision lots and platted subdivision shall be as follows:
1. Allowed fencing material shall be three or four board wooden an equestrian fence.ing with
wood posts.
2. Fences shall not exceed 55 inches from finished grade.
3. Fences shall be white, black, or dark brown in color.
4. Opaque fences are prohibited.
5. Chain link fences are prohibited.

6. Fences shall be set back a minimum of three feet from a public right -of-way.
7. If the side, side corner or rear yard is adjacent to an exterior street, an equestrian fence is

including opaque may be installed as long as the opaque fence is not visible from the street
at any time of the year.
b. Fencing along interior streets including front, side corner, side and rear of platted subdivision lots
shall be as follows:
1. Allowed fencing material and type along the front is limited to three or four board wooden
an equestrian fenceing or as otherwise subject to the approval of the community
development director; and
2. Along sides and rear of a lot, fencing material can be of any type.
3. Fences shall not exceed eight feet in height but not including fencing in the front which
shall not exceed 60 inches in height from finished grade.
4. If a front, side corner, side or rear lot line borders an exterior street, subsection (5)a.
applies.
c. Fencing along side, side corner, or rear of nonsubdivision lots :
1. Allowed fencing material and type is not limited to three or four board wooden an
equestrian fenceing outside the 60 feet rural viewshed.
2. Fences shall not exceed eight feet in height.
3. If a front, side, side corner or rear lot line borders an exterior street, see subsection (5)a.
(6) Setback. Fences and walls shall be set back a minimum of three feet from a public right-of-way.

(5) Chain link fences are prohibited.
(6) Fences shall be set back a minimum of three feet from a public right-of-way.
(7) If the side, side corner or rear yard is adjacent to an exterior street, an equestrian fence is required
within the 60-foot rural viewshed. Outside the rural viewshed any type of fence including opaque may
be installed as long as the opaque fence is not visible from the street at any time of the year.
(b) Fencing along interior subdivision streets, including front, side corner, side and rear of platted subdivision
lots shall be as follows:

(1) Allowed fencing material shall be three or four board wooden an equestrian fenceing with wood, stone
or masonry posts.
(2) Fences shall not exceed 60 inches in height from finished grade.
(3) Fences shall be white, black, or dark brown in color.
(4) Opaque fences are prohibited.
(5) Chain link fences are prohibited.
(6) Fences shall be set back a minimum of three feet from a public right-of-way.
(7) If the side, side corner or rear yard is adjacent to an exterior street, an equestrian fence is required
within the 60-foot rural viewshed. Outside the rural viewshed any type of fence including opaque may
be installed as long as the opaque fence is not visible from the street at any time of the year.
(b) Fencing along interior subdivision streets, including front, side corner, side and rear of platted subdivision
lots shall be as follows:
(1) Allowed fencing material and type along the front is limited to three or four board wooden an
equestrian fenceing or as otherwise subject to the approval of the community development director;
and
(2) Along sides and rear of a lot fencing material can be of any type.
(3) Fences shall not exceed eight feet in height but not including fencing in the front which shall not
exceed 60 inches in height from finished grade.
(4) If a front, side, side corner, or rear lot line borders an exterior street, section [64-4632](ja)(7) applies.
(c) Fencing along side, side corner, or rear of nonsubdivision lots:
(1) Allowed fencing material and type is not limited to three or four board wooden an equestrian fencing
outside the 60-foot rural viewshed.
(2) Fences shall not exceed eight feet in height.
(3) If a front, side, side corner or rear lot line borders an exterior street, see section [64 -4632](ja)(7).
(d) Barbed wire is prohibited on any single-family residential lots, except when part of a legitimate agricultural
use.
(e) All fences and walls shall be set back a minimum of three feet from a public right -of-way.

Sec. 64-1. Definitions.
Fence means an enclosure or barrier, composed of wood, masonry, stone, wire, iron, or other materials or
combination of materials used as a boundary, means of protection, privacy screening, or confinement, including
brick or concrete walls but not including hedges, shrubs, trees, or other natural growth.
Fence, equestrian means fences made from treated and/or painted wooden boards nailed or screwed to
posts, split rails with rounded ends that slide into holes in posts, composite board and minimum 4″ × 4″ for po sts.
The height shall not exceed 60 inches from average grade and may include a three- or four-board configuration
with a parallel or cross design. Colors shall be black, dark brown, or white. Columns constructed of brick or
masonry is also acceptable and shall not exceed 66 inches in height from average grade. Fence may be enhanced
with galvanized welded wire on either side of the fence as shown in Exhibit A and B. Either side of the equestrian
fence shall be considered finished side.
