PLANNING COMMISSION ACTION MINUTES

2. Call to Order The meeting was called to order at 6:00 p.m.
Members Present:

3. Public Comment - There was no public comment.
4. Approval of Action Minutes
a] November 17, 2021, Planning Commission Meeting -A motion was
made by Fred Edwards to approve the minutes as presented. The
motion was seconded by Kurt Nolte. The motion passed unanimously.
5. Preliminary Plat
a) 12580 Crabapple Road to be named "Echo" Subdivision by Harrison
Development & Construction Zoned T4 Transect Zone - Crabapple Form
Based Code to subdivide 4.9 acres into 23 single family lots at a density
of 4.7 units per acre
There were comments made by members of the community that
expressed concerns about traffic patterns/addifional traffic;
hydrology/erosion/stormwater impact on adjacent lots in Heritage at
Crabapple; concerned with design of streets related to emergency
services and delivery vehicles; maintain privacy between proposed lots
and existing properties; meeting tree canopy regulations. A motion was
made by Kurt Nolte that the plat meets the development regulations but
to be aware of potential stormwater issues. The motion was seconded
by Jan Jacobus. The motion passed unanimously.
& Text Amendments
a) RZ21-15 - A text amendment to create a new Use Permit - Assembly
Hall, Indoor Auditorium (Sec. 64-1846) - A motion was made by Fred
Edwards and seconded by Jan Jacobus to recommend approval of
RI21-15 as presented with one change to (b)(3) to add "a fully"
enclosed structure. The motion passed unanimously.
b) RZ21-16 - Article XIX Crabapple Form Based Code. Article 6.1 -
Definitions - To define Assembly Hall, Indoor Auditorium - A motion was
made by Ron Gilbert and seconded by Fred Edwards to approve RI21-
16 as presented but to delete the word "party" and to change "does"
to "shall". The motion passed unanimously.
cj RZ21-17 - Article XX Deerfield Form Based Code, Article 5, Table 10 -
Specific Function and Use - A motion was made by Ron Gilbert and
seconded by Kurt Nolte to recommended approval of RZ21-17 as
presented. The motion passed unanimously.
dj RZ21-18 - Article XX Deerfield Form Based Code, Article 6.1 Definitions -
To define Assembly Hall, Indoor Auditorium - A motion was made by
Kurt Nolte and seconded by Fred Edwards to approve RZ21-18 as
presented but to delete the word "party" and to change "does" to
"shall". The motion passed unanimously.
ej RZ21-19 - Section 64-212 - To amend Fence and Walls - A motion was
made by Jan Jacobus and seconded by Ron Gilber to change 20 feet
to 15 feet for intercom system; to change 60 inches to five feet in
section (5)b.3. and delete "side corner" from section (5)c.3. The motion
passed unanimously.
fj RZ21-20 - Article V1-- Zoning Text, District Ciassificafions and Boundaries
- To amend sections on fencing --- A motion was made by Jan Jacobus
and seconded by Kurt Nolte to approved as presented with the
following changes of 60 inches to five feet and to remove side corner
from section c.3 of all zoning districts. The motion passed unanimously.
gj RT21-21 - Section 64-1 - Definitions, Equestrian Fencing - A motion was
made by Ron Gilbert and seconded by Kurt Nolte to recommend
approval as presented. The motion passed unanimously.
7. Adjourn - A motion was made by Fred Edwards and seconded by lath
Middlebrool- to adjourn the meeting at 8:45 p.m.
