RESOLUTIONNO.
RESOLUTION OF THE CITY COUNCIL OF THE MILTON, GEORGIA
CREATING AN ELECTION FEASIBILITY COMMITTEE
WHEREAS, the Charter for the City of Milton provides that all committees shall be
appointed as prescribed by ordinance or resolution of the city council (Charter, Section 3.14(b));
WHEREAS, the City of Milton believes it in the best interest of the City for the Council
to establish an election feasibility committee ("Committee");
WHEREAS, the objective of the Committee is to review and make recommendation to the
Mayor and Council as to whether it is feasible, both practically and financially, for the City to
conduct its own municipal elections, taking into consideration cost -benefit, process and execution,
liability, and other considerations;
WHEREAS, the Committee, as contemplated herein, is substantively different from a
board, commission, or authority (as contemplated in Section 4.11 of the City Charter), as each of
those entities are generally designed to serve external constituencies, whereas the Committee is
designed to serve an internal constituency, i.e., the City Council; and,
' WHEREAS, the Committee shall have six months from the date of this Resolution to
complete its work and provide a recommendation to the Council.
NOW THEREFORE BE IT RESOLVED, that there is hereby created the Milton
Election Feasibility Committee ("Committee");
BE IT FURTHER RESOLVED, that the Committee shall be comprised of the following
six (6) persons, to wit:
1. Mark Amick, Community Member
2. Lisa Cauley, Community Member
3. Rick, Mohrig, Councilmember
4. Paul Moore, Councilmember
5. Stacey Inglis, City Staff
6. Tammy Lowit, City Staff
BE IT FURTHER RESOLVED, that the Committee's function is to study, inquire, fact -
gather, and ultimately make a recommendation to the Mayor and City Council as to whether it is
feasible for the City to conduct its own municipal elections, taking into account the costs,
obligations, liabilities, and potential risks of such an undertaking (the "Work");
I BE IT FURTHER RESOLVED, that the Committee's recommendation shall not have
the force of law;
BE IT FURTHER RESOLVED, that the Committee shall be subject to the Open
Meetings Act, and is required to adhere to all obligations thereunder;
' BE IT FURTHER RESOLVED, that the Committee is authorized to self -regulate
(bylaws) if it is believed by the Committee that such internal controls are necessary, but there is
no obligation the part of the Committee to appoint officers;
BE IT FURTHER RESOLVED, that there shall be no obligation on the part of any
Committee member to be sworn or secure bonding;
BE IT FURTHER RESOLVED, that on that day that is one -hundred eighty 180 days
from the date of this Resolution, or October 15, 2022, the Committee shall be automatically
terminated by operation of this Resolution with no further action required for such termination to
occur;
BE IT FURTHER RESOLVED, that all documents generated by the Committee shall be
retained by the City of Milton in accord with the State of Georgia's and City of Milton's record
retention requirements;
BE IT FURTHER RESOLVED, that the City of Milton is authorized to provide the
Committee reasonable access to and use of City facilities, staff, and equipment as are needed by
the Committee to complete the Work; and,
BE IT FURTHER RESOLVED, that the Committee's point of contact for engaging City
' staff or resources shall be the City Manager.
SO RESOLVED, this 18a' day of April, 2022.
