' COUNTY OF FULTON
A RESOLUTION OF THE CITY COUNCIL OF MILTON, GEORGIA TO
TERMINATE THE CURRENT MILTON SOLICITOR
WHEREAS, the City of Milton, Georgia ("City") and the City of Alpharetta, Georgia
("Alpharetta") (collectively the "Cities") wish to appoint a shared prosecuting attorney ("Shared
Court Solicitor"), and to effectuate same, as required by O.C.G.A. § 15-18-91 et seq., the Cities
shall create an "Office of Prosecuting Attorney" ("Office"), and the Cities thereafter — pursuant
to the terms of a separate intergovernmental agreement - will share the same Court Solicitor
appointed to hold the created Office; and
WHEREAS, the City, pursuant to the Code of the City of Milton Georgia, in Part 1,
Subpart A, Article III, Section 3.10 (a), (b), and (c), and other laws of the State of Georgia, has
the power, by resolution, to abolish positions of employment with the City as it shall deem
necessary for the proper administration of the affairs of the government of the City; and
WHEREAS, the City contemplates that having a Shared Court Solicitor will provide for
greater efficiencies than exist under the current arrangement; and
WHEREAS, the City, after investigation, has determined that to implement the
appointment of a Shared Court Solicitor to the aforementioned Office of Prosecuting Attorney, it
is necessary and in the best interest of the City to terminate the employment of the current
Solicitor Fran McQueen ("McQueen"); and
NOW THEREFORE, BE IT RESOLVED BY the Milton City Council that there exists
a legitimate and good faith need to terminate the employment of current Solicitor McQueen in
order to accommodate and fill a Shared Court Solicitor position in the newly created Office.
BE IT FURTHER RESOLVED the termination of the existing Solicitor and the
creation and filling of the Office and the Shared Court Solicitor are hereby declared necessary
for the proper administration of the affairs of the government.
BE IT FURTHER RESOLVED that terminating the existing Solicitor is occasioned
solely for the public policy reasons set forth in this Resolution, and for no other.
BE IT FURTHER RESOLVED that in order to effectuate terminating the employment
of the current Solicitor, by this Resolution, and in accordance with Part 1, Subpart A, Article III,
Section 3.10, (a) (b) and (c) of the Code of the City of Milton, Georgia, the employment of
McQueen is hereby terminated.

' BE IT FINALLY RESOLVED that this Resolution shall be effective immediately upon
its adoption by the City, and McQueen's employment with the City of Milton shall be deemed
terminated upon such adoption.
