A RESOLUTION TO REIMBURSE THE CITY OF MILTON'S GREENSPACE BOND ACCOUNT WITH
TSPLOST FUNDING TO SUPPORT AND ACCOMMODATE THE IMPROVEMENTS BEING
CONSTRUCTED AS PART OF THE FREEMANVILLE ROAD AT BIRMINGHAM ROAD
ROUNDABOUT INTERSECTION PROJECT
WHEREAS, in November 2016, City of Milton (the "City") voters passed a bond for
greenspace land acquisition; and
WHEREAS, in April 2019, one of the parcels acquired by the City with greenspace
bond funding was Tax Parcel No. 22 422003820362 located at the southwest corner of
the intersection of Freemanville Road and Birmingham Road (the "Greenspace Parcel");
and
WHEREAS, Transportation Special Purpose Local Option Sales Tax ("TSPLOST")
provides funding for transportation improvements such as roads, bridges, sidewalks,
bicycle paths, and other transportation related purposes; and
WHEREAS, In November 2016, citizens throughout Fulton County voted in favor of
a proposed TSPLOST; and
WHEREAS, expenses related to the Freemanville Road and Birmingham Road
intersection improvement project (the "Project") was included as part of the dedicated
list of projects as approved by the voters in November 2016 as part of the TSPLOST
referendum; and
WHEREAS, construction of the Project impacts the real property abutting the City's
right -or -way at the corners of the subject intersection, including the Greenspace Parcel;
and
WHEREAS, the Project requires the City to acquire additional right-of-way and
other property interests (e.g., permanent and/or temporary easements) from abutting
property owners; and
WHEREAS, in designing the Project, impacts to abutting private properties was
minimized opting, rather, to take advantage of City -owned property at the southwest
corner of the subject intersection, i.e., the Greenspace Parcel; and
WHEREAS, it is appropriate that the City's TSPLOST funding related to the Project
should be used to reimburse the City's greenspace fund for that portion of the
Greenspace Parcel that is required to complete the construction of the Project, to will
0.193 acres of additional right of way including roadway features and associated utilities;
and
WHEREAS, the appraised value of that portion of the Greenspace Parcel required
for the Project (0.193 acres) is $33,800.00.
BE IT THEREFORE RESOLVED, that the City Council hereby directs City staff to make
the appropriate fund transfer of $33,800.00 from the TSPLOST Project fund and into the
Greenspace Bond fund for the purposes stated hereinabove.
