My name is Benjamin Nations. I am a resident of Milton and live in the
White Columns neighborhood.
Per a City of Milton ordinance, personal transportation vehicles (PTVs)
are considered legal for use on city -maintained roads. The City
ordinance includes safety parameters such as age restrictions, speed
limits, seat belts, headlights, blinkers, etc ... We own a PTV as defined in
the ordinance. The roads in the non -gated sections of White Columns
meet the criteria for legal PTV usage.
The covenants of White Columns restrict golf carts (NOT PTVs) from the
neighborhood. Georgia Code Sections 40-1-1(17.2) and 40-1-1(43.1(A)
provide separate definitions for golf carts and PTVs. Our covenants
were written with the intent to keep private golf carts from being used
to play golf on the golf course. There is no Georgia case law that speaks
to an HOA's authority to limit the types of vehicles that may be driven
on public streets. The case law cited by the city attorney deals with a
different set of facts that do not apply here. We feel that it was
inappropriate for a City of Milton affiliate to opine on this
neighborhood issue.

The authority of the City of.Milton should not be extended to advise the
types of legal vehicles that can be driven in neighborhoods. There are
many legal vehicles being driven on our subdivision public roads that
may seem dangerous to some; bicycles, motorcycles, cars driven by
teens, to name a few. However, it is not a proper function of a city to
give an opinion on whether certain vehicles can be restricted by an

This is a clear issue. The covenants of White Columns do not restrict
PTVs on the streets in our neighborhood. We ask that the City of
Milton not get involved with this neighborhood disagreement.

Public Comment
My name is Benjamin Nations, and I am a resident of Milton and live in the White Columns
neighborhood. I would like to vocalize a strong opposition to the comments made by residents that
attended the meeting dated February 22, 2023 and March 6, 2023. A small, but very vocal number of
our neighbors oppose PTV usage in White Columns although they are now legal on city -maintained
streets.
Per a City of Milton ordinance, personal transportation vehicles (PTVs) are considered legal for usage on
city maintained public roads. When making this decision, the City included many safety parameters in
allowing PTV usage; i.e. only to be driven on streets with a speed limit of 25mph and under, age of driver
restrictions, seat belts, headlights, blinkers, etc... We fully agree that, as with other legal vehicles, non-
conformance with these restrictions should be enforced by local police to ensure safety. The roads in
the non -gated sections of White Columns meet the criteria for legal PTV usage.
The covenants of White Columns state that golf carts (NOT PTVs) may not be driven in the

the City and with the intent to keep private golf carts from being used to play golf on the golf

guidance on HOA authority to restrict parking on public streets. Those facts do not apply here, and we
feel that it was inappropriate for a City of Milton affiliate to opine on this neighborhood issue.

city with a commonsense approach to governance, a city where the government lets us make our own
decisions regarding our personal safety. We ask that the City of Milton not get involved with this petty
neighborhood disagreement.
