Below, please find the Milton Code (click here for link) that I follow regarding regulations for Public Participation either via Email (reading into the record at the council meeting) and/or Public Comment (in-person). Pursuant to the Milton Code, Divison2-Meetings, Sec. 2-59(2a-b)- Public participation (Emails and public comment cards) in meetings of the city council shall be permitted in accordance with the provisions of this section. (2) Public participation—Emails and public comment cards. a. Public comment cards. Must be turned into the city clerk prior to the agenda item being called. An individual submitting written comments must be in attendance at the council meeting in order for the city clerk to read said written comments into the record. Written comments shall be limited to the space provided on the public comment cards and no content submitted to the city clerk shall be read into the record if it is not legibly written on the comment card. b. Emails. Emails sent to the elected officials, city manager, city clerk or department directors, which expressly declares that the email is intended to be introduced into the record for a then- pending agenda item, will be handled as follows: the sender's name, address and general position (i.e., in support or opposition to the agenda item) will be read by the city clerk into the record during public comment for the respective agenda item. The substantive comments or narrative in the email will not be read into the record unless the author of the email is in attendance at the meeting [see, [section] 2-59(2)a.] or unless the author provides evidence to the satisfaction of the city clerk of the inability to physically attend the meeting. All emails will be made part of the official record. If an email related to a then-pending agenda item is intended to be read into the record consistent with this paragraph, the email shall be no more than 300 words. If someone wishes to speak on behalf of a group, then a notarized affidavit is required to be submitted, prior to the commencement of the council meeting, stating that individual has the authority to speak on behalf of that organization. Thank you! Brad Dell (White Columns Resident) 500 Glen Hampton Drive Milton, GA 30004 My wife, little girls and I love living in Milton. Because I want to be a part of maintaining our quality of life here, I ran for the board of our HOA in White Columns. It’s been a privilege to serve…except when it comes to dealing with City Hall. When it came to making our streets safe from speeding motorists, the Milton City Council stood in the way. And, last month, you voted unanimously to make it even harder for an HOA to keep our streets safe from speeders. Then, just two weeks ago, with the mayor pro tempore presiding, the City Council heard from three White Columns homeowners complaining about residents driving legally authorized vehicles on City-owned streets. I have no doubt those complaints were part of a pre-conceived plan to insert the City deeper into the issue of PTVs on public streets. The mayor has said he has no interest in the City getting enmeshed in this issue. But, we are also told that the city attorney is about to issue a new legal memo on the topic. A memo that, no doubt, was initiated not in the interest of clarity, but in an effort to sow deeper confusion and frustration. From a citizen perspective, try following the public policy logic at City Hall. Our HOA followed the four-part test required by the ordinance code to install new radar- controlled speed signs. But, a single council member successfully pushed the City Council to put even more requirements on our HOA. Requirements that were not in the ordinance code. Put simply, we made our streets safer despite time delays and opposition from the City Council. But, you weren’t done. Just last month, you unanimously amended the City’s ordinance code to now require public safety only by public referendum. It seems you don’t want HOAs to exercise regulatory authority over city streets… …until, of course, you do. Now when it comes to PTVs, you want HOAs to have all the authority. Despite Court decisions and our governing documents to the contrary, you want HOAs to regulate what vehicles can and cannot operate on city streets. Let me make sure I get this right. HOAs don’t have authority to slow vehicles down, but we do have authority to ban vehicles from the roadways. Talk about making it up as you go along. What’s happening here is obvious. A single council member has a personal agenda and is using his position and authority to advance it. The Milton Ethics Panel unanimously found the same thing. But the City Council continues to look the other way. It’s time to put the citizens first and stop allowing these chambers to be used as the sandbox of entitled and self-interested politicians.
