RESOLUTION NO. R23-05-647
RESOLUTION OF THE CITY OF MILTON ESTABLISHING AN
URBAN GROWTH BOUNDARY
WHEREAS, the City of Milton, Georgia ("City") is a duly formed political
subdivision of the State of Georgia, with all the powers attendant thereto; and
WHEREAS, the Mayor and City Council of the City of Milton, Georgia
(hereinafter referred to as "Mayor and Council") recognize the historic role played by
the availability of sewer service with respect to the location, scope, scale and timing
of development in general as well as in the City specifically; and
WHEREAS, the City and Fulton County, Georgia ("County") currently have
in place an Intergovernmental Agreement for the Extraterritorial Provision of Sewer
Service ("Sewer IGA"), establishing the authority of the County to provide sewer
service to certain parcels within the City's municipal limits; and
WHEREAS, the Sewer IGA included as an exhibit a sewer service map
setting forth the boundaries of where sewer service existed or could be expanded
("Sewer Map"); and
WHEREAS, the Mayor and Council seek to sustain, protect, and further
enhance the high quality of life enjoyed today by the residents of the City; and
WHEREAS, the Mayor and Council seek to responsibly balance residential,
and commercial growth; and
WHEREAS, the Mayor and Council desire to manage growth proactively
rather than reactively; and
WHEREAS, the Mayor and Council seek to establish an Urban Growth
Boundary as a growth management practice; and
NOW THEREFORE BE IT RESOLVED, by Mayor and City Council as follows:
' 1. The Milton Urban Growth Boundary, based in part on the existing Sewer Map,
is hereby established as depicted on the Urban Growth Boundary Map for the
City of Milton, Georgia attached hereto as Exhibit "A"; and
2. The Urban Growth Boundary is intended to augment and enhance the existing
master plans and the comprehensive plan, but not to amend either, and in the
event of a deviation between any master plan or the comprehensive plan, the
pertinent master plan or comprehensive plan will control; and
3. The Director of the Milton Community Development Department is instructed
to initiate the process of amending the Milton 2040 Comprehensive Plan to
include the Urban Growth Boundary on the City's Future Land Use Map and to
include the language attached as Exhibit `B" in the Land Use portion of the text
of the Milton 2040 Comprehensive Plan;
SO RESOLVED, the public health, safety and welfare demanding it, this447

"The City has adopted an Urban Growth Boundary as reflected on the Future Land Use Map. The
purpose of the UGB is to reflect the City's desire to constrain development such that future
development is encouraged to occur within the UGB while being limited outside of the UGB in
order to:
- maintain and preserve the rural character of the area outside of the UGB;
- sustain, protect and enhance the high quality of life enjoyed today by the residents of
the City;
- provide for an efficient and desirable pattern of development that encourages
redevelopment and discourages sprawl; and
- responsibly balances residential, industrial and commercial growth.
The UGB is intended to be used by the City when considering the advisability of future rezoning,
land use and development proposals, as well as to guide future City Councils in understanding and
effectuating the desires and intent of the City's residents with respect to growth and development
in the City."
