AN ORDINANCE FOR A RIDING AREA (SEC. 64-1840) LOCATED AT 14725 WOOD
ROAD ON 13.25 ACRES ZONED AG-1 (AGRICULTURAL)
BE IT ORDAINED by the City Council for the City of Milton, Georgia while in regular
session on May 1, 2023, at 6:00 p.m. as follows:
SECTION 1. That the Zoning Ordinance of the City of Milton be amended, sc
that the following property located at 14725 Wood Road consisting of a total of
approximately 13.25 acres as described in the legal description attached hereto as
Exhibit "A", be approved for a Use Permit for a Riding Area subject to the
Conditions of Approval described in Exhibit "B", and
SECTION 2. That the Riding Area listed in the attached conditions of
' approval, be approved under the provisions Sec. 64-1840 of the Zoning Ordinance
of the City of Milton: and
SECTION 3. That the Concurrent Variance (VC23-01) be approved as
described in Exhibit "C"; and
SECTION 4. That the property shall be developed in compliance with the
Conditions of Approval as described as attached; provided that no uses or
conditions hereby approved (including any site plan) shall authorize the violation of
any district regulations or other zoning regulations other than as authorized by the
Concurrent Variance as described in Exhibit "C" approved hereby; and
SECTION 5. That all ordinances or part of ordinances in conflict with the
terms of this ordinance are hereby repealed: and
SECTION 6. This Ordinance shall become effective upon adoption by the
Mayor and City Council and the signature of approval of the Mayor.

EXHIBIT "B"
CONDITIONS OF APPROVAL
Property located at 14725 Wood Road for a Use Permit would be approved for a
Riding Area (Sec 64-1840) subject to the owner's agreement to the following
enumerated conditions.
1) To the owner's agreement to restrict the use of the subject property as follows:
a) Covered Riding Area not to exceed 180 feet by 130 feet in size and
associated equestrian training uses on 13.25 acres.
2) To the owner's agreement to abide by the following:
a) Substantial compliance with the Revised Site Plan submitted to the
Community Development Department on March 14, 2023, and
whereby the exact layout of the project may contain minor deviations
approved by the Community Development Director provided the
deviations remain consistent with the purpose and intent of the
Council's approval of the Use Permit. Notwithstanding the contents of
the site plan, the project must meet or exceed the requirements of the
Zoning Ordinance, all other applicable city ordinances, and these
conditions. The site plan may be revised with the approval of the
Community Development Director in order to comply with city codes
and zoning conditions. Unless otherwise noted herein, compliance
with all conditions shall be in place prior to the issuance of the first
Certificate of Occupancy.
3) To the owner's agreement to the following site development considerations:
a) Provide runoff reduction for the new impervious surface from the covered
riding area as approved by the Community Development Department
prior to the Certificate of Completion.
b) Remove existing wood stand and wood deck located within the 25-foot
state stream buffer.
c) Height of covered riding area structure shall not exceed 30 feet as
measured from the ground to the peak of the roof.

d) Color of roof of covered riding area structure shall be approved by the
City of Milton Design Review Board.
e) Covered riding area structure and expansion of existing barn shall be
reviewed by the City of Milton Design Review Board prior to the issuance
of building permits.

APPROVED CONCURRENT VARIANCE (VC23-01)
a) To allow parking within 75' of the east property line as shown on the
revised site plan submitted on March 14, 2023, with additional horse trailer
parking in the triangular area southeast of the riding area. (VC23-01, Part
1)
b) To reduce the 50' City undisturbed stream buffer and 25' impervious
setback as shown on the revised site plan submitted on March 14, 2023,
except for the existing wood stands. (VC23-01, Part 2)
c) To allow a riding ring/area that is covered to be located less than 100'
from property line as shown on the revised site plan submitted on March
14, 2023. (VC23-01, Part 3)
d) To allow an existing stable and the additions to the stable to be located
closer than 100' to any property line as shown on the revised site plan
submitted on March 14, 2023. (VC23-01, Part 4)
e) To allow an existing accessory building (northeast corner) to be closer
than 25' to a side property line and closer than 50' to a rear property line
as shown on the revised site plan submitted on March 14, 2023. (VC23-01,
