HomeMy WebLinkAboutOrdinances 22-12-526 - 12/19/2022 - Creating the Milton Sustainability Advisory CommitteeSTATE OF GEORGIA COUNTY OF FULTON ORDINANCE NO. c2J-/ (}_-Jo2 /p AN ORDINANCE CREATING THE MIL TON SUSTAINABILITY ADIVSORY COMMITTEE WHEREAS, pursuant to its Charter and other laws of the State of Georgia, the City of Milton , Georgia, has the power to adopt reasonable ordinances, resolutions and regulations for the protection and preservation of the public health, safety and welfare of its citizens ; and WHEREAS, in 2009, the Mayor and City Council for the City of Milton ("City") adopted the 2008 -2018 Solid Waste Management Plan; and WHEREAS , the City of Milton Strategic Plan 2021 -2025 noted an objective to identi fy opportunities to improve the management of solid waste collection that aligns with sustainable best practices; and WHEREAS , the City has deemed it advisable and in the best interests of the citizens of the City to create a Sustainability Advisory Committee to pai1icipate in the development of an updated Recycling and Solid Waste Management Plan in conjunction with City Cow1cil and staff, to facilitate achievement of sustainability initiatives and goals of the City, to establish policies and procedures to govern the committee, and to assist City Council and staff in an advisory role on an as-needed basis; and WHEREAS , the City has determined that it would also be in the best interests of the citizens of Milton for the City Council to select the members of the Sustainability Advisory Committee through city-wide nominations. NOW THEREFORE, the Council of the City of Milton hereby ordains , while in a regularly called council meeting on Oecern her /0/ , 2022, at 6:00 p.m., as follows: SECTION 1. The Code of Ordinances of the City of Milton , Georgia, is hereby amended to add a new Division 9 to be titled "Sustainability Advisory Committee," under Article V (Boards, Commissions , Committees and Authorities), Chapter 2 (Administration), as provided in Exhibit A attached hereto and incorporated herein by this reference. SECTION 2. All ordinances , parts of ordinances , or regulations in conflict herewith are hereby repealed. SECTION 3. This Ordinance shall become effective upon its adoption. Attest: EXHIBIT A CHAPTER 2 -ADMINISTRATION ARTICLE V. -BOARDS, COMMISSIONS, COMMITTEE AND AUTHORITIES DIVISION 9 -SUSTAINABILITY ADVISORY COMMITTEE Sec. 2-300. -Creation and Governance. There is hereby created the Milton Sustainability Advisory Committee ("MSAC") whose mission and purpose shall be to , "participate in the development of an updated Recycling and Solid Waste Management Plan in conjunction with City Council and staff, to facilitate achievement of sustainability initiatives and goals of the City, to establish policies and procedures to govern the committee, and to assist City Council and staff in an advisory role on an as-needed basis". a. Membership MSAC shall consist of the following: (1) Seven (7) members; (2) A quorum for the conduct of business shall be four (4) members; (3) Each councilmember and the mayor shall nominate his or her designee for one of the seven positions on the committee ; (4) The nominees shall be confirmed by a majority vote of the Council before . . commencmg service; (5) Each MSAC member must swear an oath prior to commencement of service ; (6) MSAC members must be at least twenty-one (21) years old; (7) The mayor's and councilmember's designees shall reside anywhere within the city; (8) MSAC members , following appointment and swearing, shall be subject to the City of Milton Ethics Code , and shall be considered "City officials" or "City officers" under Section 2-798 of the Milton Code ( defining a City officer as "any member of a board, commission, or authority appointed by the council , the city manager, and any other ... appointed officer of the City of Milton"); (9) The City Council may remove a MSAC member, for convenience , upon majority vote of the Council; (10) MSAC shall be subject to the State of Georgia Open Meetings Act (O.C.G.A. § 50-14-1 et seq.); (11) No City Council member shall enter into any closed or executive session of MSAC unless the executive session is a duly-called joint executive session of MSAC and the City Council. MSAC shall determine who is needed in executive session to properly conduct such meeting in a manner that is both effective and otherwise in conformance with the Open Meetings Act ; (12) A MSAC member that misses more than three (3) consecutive MSAC meetings , absent extenuating circumstances, shall be deemed automatically removed from MSAC and the City Council shall forthwith nominate and approve a replacement member. Any such replacement member shall fulfill the remainder of the term of the member so removed and shall be entitled to all rights and privileges of any other MSAC member. Section 2-157(c) of the Milton City Code shall also be binding on MSAC ; and , (13) The City Council shall retain the discretion, but no obligation, to authorize a per diem payment to MSAC for meeting attendance. Any such authorization must be approved by Resolution of the City Council. This authorization for compensation, set forth during the creation of the MSAC , is intended to fulfill the mandate of Section 2-160 of the Milton City Code. b. Governance MSAC members shall select officers and may draft and adopt by-laws. In the event no MSAC-specific by-laws or internal rules of procedure are adopted, MSAC shall be subject to the City Council's adopted internal rules of procedure. Members must also be able to fulfill the time commitment required to serve on the MSAC. Members must be willing to agree with the goals of the Milton 2040 Comprehensive Plan and 2021 -2025 Strategic Plan and work towards achieving those goals for the best interests of the Milton community as a whole. Members of the MSAC shall undertake their respective duties in a volunteer capacity and shall not be compensated for any time or expenses associated with any assignment or function with respect to the MSAC, except for a potential per diem as set forth in "a. Membership". c. Term The committee members shall serve concurrently with their respective nominating councilmembers. d. Conduct of Business MSAC shall meet at regular intervals as necessary to perform the tasks and duties associated with MSAC's mission , including recommending actions to the city staff or Mayor and City Council. MSAC may establish and appoint representatives to as many committees and sub- committees as are determined to be necessary for the accomplishment of MSAC's mission. e. Stakeholder Liaisons MSAC shall be authorized to utilize community volunteers and stakeholders to assist in accomplishing MSAC's mission. Such volunteers and stakeholders shall not be considered MSAC members , but will function as liaisons to receive , disseminate , and provide information by and between the community and MSAC regarding the strategy, plans, and progress of implementing a proposed Recycling and Solid Waste Management Plan and various sustainability initiatives. f. Staff Staff of the City of Milton shall attend the meetings of the MSAC and shall serve in an official capacity. City staff shall assist the MSAC members in the fulfillment of the committee's work. g. Logo MSAC may adopt an official logo for the MSAC .
